Sunset Cox on the Question,
i at Coal j tjj,. German vrar meeting in New
>t tho.-.e J York, on Friday, Hon. S. S. Cox laid
upply a ( j OWQ following propositions in rela-
MiiiUitf j (Jon to the capture of the Virginia*:
wonted I Assuming that tho Virgin!us was cap-
of rail- [ tured, nut in British or Spanish waters,
1 or,Gee* I but on tho high seas, and that ahe was on
the high Seat at soma time during the*
chase or detention, cannot be doubted
then, first, t he was flying the American
Bag. Second—Was she lawfully flying
that, flag? If our Government author
ized her to fly it, she was lawfully under
it. Our Government had given her an
American register, and very recently an
agent of the Government, the Consul,
had givdh her a clearance. .Everything
lad been done by oar Government to au
thorize her going upon the high seas un
der the American flag. Third—If ahe
was engaged in wrong, tho Government
was responsible to the party wroi
and able to punish the abuse of its
Fourth—If she was lawfully under the
Amoriccn flag on the high too* then
every one on hoard of her was practically
upon our coil, 1 and it does not matter
whether they wore citizens or foreigners,
good men or bad men. Fifth—Tbo
taking of these men from under
our flag on the high oca* to Cuba and
executing them was jirociseiy a like case
us if while there wo* peace between m and
England an armed force was to cross our
Under* from Canada, seizo a number of
men within our jurisdiction (no matter
whether they were our citizens or for
eigners) alleged to bo hostile to Engladd,
and when they got them on Canadian soil,
execute them under drum-head court-
martial. fi. Whnt are the obligations of
the Government to the men on board the
Virginius? Suppose an American in
foreign port, looking for employment as
a fireman, or engineer, or sailor. He
tho Virgimua Hying the American I _
Not content with this, for extra caution,
liu inspects her register. With still fur
ther caution lie irocs to the Consul and
finds ho has granted her a clearance. Ife
is justified in accepting her os on Ameri
can vessel and on n lawful voyage. If
her voyage or her character bo unlawful
his government has entrapped him. How
can our Government got over its obliga
tion to protect every man thus induced
to go on board that vessel with tho feel
ing that ho was still practically on tho
soil of liis country? 7. Tho Virginiua
was, while on tho high seas, as much un
der our protection und jurisdiction os it
she lay in Now York harbor. 8. If an
American man-of-war had found the
Virginiua on tho high seas in the
hands of Spain, would not this
man-of-war hava been bound after in
spection of her papers to rescuo her ?
Tho character of tho men executed and
their purposes have nothing to do with
tho matter. Spain has no more right to
tako a bad man from under our protec
tion than slio has to tako a good man.
10. Spain Inis taken redress into her own
hands in this ca*o within our own proper
jurisdiction a* it wero upon our soil. 11.
Tho effort* to make this caso a liko ono
to our capture of blockade-runners dur
ing our .rebellion fails. There was no
blockade proclaimed nor any war, for
Spain does not acknowledge her insur
gents as belligerents. Moreover, if tho
case were a liko one, then tho Virginius
should have been first judicially proved
in an admiralty court to bo good prize
for violating somo regulation of law or of
iicforo any rights accrued to hold her
crew or passenger* to account. Twelfth
Until tho vessel was so condemned it is
clear they could not 1» even put on trial,
much less condemned.
