Eueikx, J.—On the noth of September, 1873, said Ereritt Hied his petition in lankrnptcy in this court, and was ad judged a bankrupt; and, on the same day lie also filed hero a petition, partaking of tho nature of a bill in equity, asking for injunction against Johnson, Shepherd A (launders, or tbe State of Now Tork, their attorney, A. P. Wright, resident of this District, ui.’i one Luke, Hberiff of Thomas county, in this State. Ereritt, in bis bill, states in substance that he is a bankrupt, and that on the 2d of October, 1669, ho procured tho setting apart os a home stead for himself and family, lot of land No. HI, containing 400 acres; also, half of lot of land No. 62, containing £48 acres, said land being situate in Thomas county. That tho homestisal was set apart by tho ordinary, under the consti tution and laws of the State of Georgia, lie annexe* a plat of those lands to nia petition. That said Johnson, Shepherd A Saunders, at tho Juno term fbut the year is not given] of tho Superior Court of Thomas county, »>y their attorney. A. P. Wright, obtained a judgment against him, the said Evcritt. for $809 and inter est from January, IMJ1. That said Luke, the sheriff of Thomoa oounty, ha* levied an execution, issued upon sud judgment, on said lands so set apart as a homestead to him and his family, and has advertised tbe same to Im sold on tho find Tuesday in October, 1873. Tho sale day being very near at hand, and to prevent oven the possibility of ir- reparablo injury to tho said Evcritt, a provisional or temporary injunction wan granted on the 1st of October list, on I prayed for in tho bill, although at the time there was doubt in my mind os to whether it ought to be granted. Tbo in junction is now sought to be disaolvcd, I on the filing of a joint answer and affida vits, and tho petit inn dismissed. I cannot, 1 think, lie doubted, at least when it is applied to bankruptcy pro- I ccodings which have ari • n since its pas sage; and it is a law as binding on tho State courts os on tbe national, for tho Constitution and laws of tbe United States, mode in pursuance thereof, are the supreme law of the land, and tho judges in every State shall be bound thereby, anything in the constitution and laws of any State to the eontnuy notwithstanding. Const. U. S., art. VI, section 2. No one can rise from tho perusal of the petition or bills filed by fhe com plainant or petitioner, Everitt, the bank rupt, with the pleasant satisfaction that the tenor of the language used by him in hispetition is ingenuous. Tbo allegations in the petition are met and successfully overcome by answer of the defendants, and tho affidavits of Sew ard and Fosiori. But if I am singular in this view, then, turning to the bankrupt's statements in his schedule B—1, it will bo found that he has conveyed or disposed of his interest in these lands, os far bock us 1871, to Aldridge and Davis, and now he claims them nrempted—as a home- 1,toad—under the State exemption law of 1871- This cannot be allowed; he, at least, is estopped from setting up title to them, Tho temporary injunction (improri- dcntly granted, I think) is dissolved and tho iietition dismissed.
