says it may safely l*e stated that a major
ity, if not all tho members, have lioen
led by their iaqalries to the following
conclusion i
1. That Packard’s government has
tho heat, if not the only, d« jure title. If
tho Returning Hoard bo a constitutional
pait of tho machinery of elections, then
Packard has tho courts, and his odicers
and his Legislature ere the legitimate
produets of that mochinsry.
Tboro as room for a fair doubt as to tho
constitutional power of tho Board to
make up a Legislature and to act judi
cially on tho Supreme Court decision
denying it the power. Its return was
binding.
Tho Nicbolla’ party had, therefore, no
right to build up a government on their
own doubts as to the constitutionality of
the statutes under which tho board

however, not as a legal, bnt as a political
one, and ha may fairly satisfy himself

nised, have not been verified, reputable
gentlemen of both parties having come

localities than in Now Orleans.
Packard’s statement that nearly all the
Circuit Judges in tbo State recognize
him, lias been found to rest solely on tho
fact that those Judges wsre commis
sioned by Kellogg, end is disproved by
t ho oaths of oflico filed by them with
N icholU* Secretary of State,
It ia literally trno that Packard is a
prisoner in tho State Ilonso, and that his
claims are actually supported by nobody
in Louisiana except the members of bis
government end two or three hundred
guards, whom ho Is feeding and paying.

his right and want it enfotoed, bnt they
will nut rsiso a finger to aid him, while
tho while popnlntion aro in sotivo and do-
ti-rmined hostility to bis pretonsions.
3. That tho Nioholis administration is
maintaining order tbronghont the Stale,
nnd protcetlng the rights of both races,
and that poaoo and prosperity would re-
nnlt from its contmnanco.
4, That Packard's administration can
not bo established by eimplo recognition
on tho part of tho President, bnt only by
the use of a largo force of federal troops
to crash out tho acting Government, nnd
by Uie maintainanco of a garrison in tho
State daring tho whole of Packard's

Further, that if this course were prac-
k ticabie it would involve a continuance of
| the race conflicts, social and industrial
I disturbances, and business depression
which characterized Kellogg’s adminislra-
I tion.

Washington, April 13.—It is reliably
Sf ascertained that the Louisiana Commis
sion, in their long cipher dispatch to the
President yesterday, circumstantially
arrate tho result of conferences with
ficholls and Packard, tho rospoctivo Su
premo Judges and other parties in inter
est. They say they find that the Nich-
I oils party are not disposed to make any
[concession, but will maintain their
I ground in tho belief and hope that ulti
mately, as in tbo case of Hampton in
South Carolina, they will have full and
unobstructed possession of tho Louisiana
State government.
The Packard party aro readv to enter
into arrangements for a joint Legislature
to determico pending questions, bnt this
lieing rejected by the Nicholls party, the
Packard party ai-ka tho President to de
tormina which is the legal State Gov-
.rnment.
In addition to tho above,it can bo stated
that the President declines to act upon
tbo request, as, under present circum -
stances, he would not be justified in
making a decision, owing to the disa
greement of tbo Nicholls and Packard
parties and tho unpromising prospects of
an accommodation. The commissioner
ask for farther instructions. The telegram
from the commission was laid before the
Cabinet and read at length, and gsvo
rise to a general interchange of opinion

net deliberations, farther instructions

Views—What Ho Thinks of
Hayos.
Washington, April 13.—Tho following
interesting information with regard to
Mr. Stophena’ health and bis views in re
gard to matters vitally affecting the
South. is gathered from a conversation
with Mr. Walsh, who visited tho Georgia
statesman this morning:

His appetite is good, and he ia able to eit
np nine boars daily. Ho will not retarn
homo until after the extra session of Con
greas. which he expects to be called by
the President in Jane. He hopes to bo
ablo to tako an active part in its delibera
tions. Ho will advocate Government
snbsidy to the Texas Paeifls Railroad.
He thinks that it ia tho grandest projeot
now before tho country, and that it should
receive aid from Congress. Tho South is
specially interested in the construction of
the rood, the whole country will be beno-
fltted by if. It is not a party, but a na
tions! measure, and sbonld be bnilt ss a
work of vital importance to tho interests
of the whoio oonntiy. Tho Honth will bo
materially benefitted by it.
Mr. S. thinks that the bill can be so
framed os to protect tbo Government from
loss. He regards the Southern Pacific as
one of tho grandest projects now before
the country.
Mr. Stephens speaks hopefully of the
future of the country. Personally ho
thinks well of Mr. Hayes. He likes his
record, and he believes that Mr. Hayes
will carry ont his policy of peace and
good will to the South. Ho considers that
the solution of South Carolina’s troubles
which has resulted in tho pacification of
South Carolina and the restoration of
home rule and good government under
Hampton, will lead to like results in
Louisiana, by the recognition of tho
Nicholls Government. He considers
that Mr. Ilaycs was fully committed to
this policy. He believes that he will use
ail legitimate means in bis power to car
ry it into action, and thus aid in restoring
,eace to all sections of tho Republic.
Lie considers that Hayes has a grand op
portunity to elevate himself to a place
entirety abovo party, and, by so doing,
he will inaugurate peace and prosperity
in a country already too long distracted
and depressed by political excitement and
party bitterness.
He thinks that Congress will heartily
second Mr. Hayes in his efforts to give
the Sontb good government.

pard, ono of the proprietors of tho hotei,
gives it aa his opinion that none of tho
employos of the house, excepting those
heretofore reported, wero killed. About
twenty of them aro still unaccounted for,
but it is believed that they are alive,
either with friends in remote parts of the
city or have left town. Of the gneats.

probable presumption is that most of

The remains of George Frank Gouley,
Grand Masonic Secretary, wero removed
to tho Grand Lodge room in Masonic
