The Arlington Estate.

The verdict in tbe oaae of Ibe heirs of
the Arlington estate of tbe late General
Robert E. Lee against tbe government,
given recently in tbe United States Court
at Alexandria, will not surprise any one
who understands the long accepted laws
ot this and other liberal civilisations on
the subject. The Arlington estate of
General Lee was sold by the government
for taxes, and a portion of it at once
dedicated to graves of fallen Union sold*
itra. When tbe war ended, tbe policy
of reconstruction adopted forbade tbo
confiscation of the property of Individ
uals, and the heirs of Lee havo claimed
their equity of redemption. They dis
tinctly disclaim any desire or purpose to
disturb tbo asbes of the Union soldiers
who sleep in Arlington, and declare their
readiness to perfect title to the govern
ment for such portion of tho property as
ia necessary for the perpetual mainte
nance of the national ccmotery.
Had Congress been wise, a bill would
at once have been passed, such as was
urged by this journal, returning to tbe
heirs of Lee tbe Arlington properly on
payment of taxes and coils due tbe gov
ernment, and a release from tbe boirs
for elaim to tbe grounds occupied as a
cemetery sod necessary to its preserva
tion; but wbilo none disputed tbe law,
oatiooal legislators preferred to allow tho
case to go to tbe courts of tbo govern
ment, wbero tbo government must either
be defeated or overrule its own laws. Tho
eeeo was tried beforo a Federal Judge,
wbooannotbe charged with prejudici
against tbe government.
Judge Hughes, who decided tho vital
point of the case against the government,
is a positive Republican; was tho Bepub-
lican leader ns u candidate for Governor
against Kemper in tbe last struggle that
party made in Virginia, and ho was ap
pointed to the United States Judgeship
by President Grant after bia defeat in
that contest Ho is in sincere sympathy
with tbe party that put him in hia life
position, and his judgment on tbe Loo
rase ia so rendered because the law so di
rects.
It is not creditable for tbe government
to tie disputing its own laws in its own
oonrts, and Congress shorld at once end
the controversy by passing an act direct-
log Ibe retransfer of tbe Arlington estate
to tbe beira o! Lae on payment of taxes
and oo**i and tbo release of tbs osmete*
ry grounds to tbo government in perpeln-

held by tbo United States, and Ibe pres
ent is an opportune period for acquiring
a title in fee to tbe oemetorles and return
ing tbe rosidne of tbo property to tbo
proper claimants on payment of taxes.
