wood vs. Weems, fieui the.Umled States
Circuit Court for the district of Florida,
was brought up in the United States Su
preme Oourt again to-day on the ques
lion of the jurors’ test oath. The court
holds that the right, under seotiou 821
of. the revised statutes, to require the
panel of jurors called to serve fer the
term to take the oath therein prescribed
or bo discharged from thb .panel is a
right whiob can be exercised only by the
district attorney; that it does uot belong
to either of tbe suitors in a case about to
he tried.
Justice Field, in • concurring opiuioo,
reiterates his previously expressed belief
that section 821 of the revised statutes is
unconstitutional and void. He holds that
Ccngress may undoubtedly prescribe the
qualification of jurora in federal courts,
bat If any of the cauits 'for disqualifi

the law had pronounced n .pnbUo offense,
it is not competent for tbe ojnrt to go
