Mackey's Testimony.
Washington, May 28 —Tho following
la n continuation, from earlier telegrams,
of Jadgrt Msokoy’s testimony. Several
of the deputy marshals wero engaged in
distributing tiokets, and ohsrged oolured
persons with having Damooratio tickets in
their hands, and in a line with tho whites,
with betraying their race. All tbe de
puty marshals, with ono excepiion, wero
oolorod men. Tboir instructions were
signed by the United SlateB Marshal, tbo
words at the beau of their commissions
being, •‘stand by yonr party." Tho wit
ness saw in three or fonr instances Dflfflo-
orntia ballots destroyed hy these clSoers.
The oondcot of tbe marshals did no: fall
nnder his observation in 1878, but be
knew of one colored Democrat who was
threatened.
Cross exnminod by Mr. Teller—The
Hayes and Hampton tickets embraced
tbo Democratic nominees for office, and
tho Hayes and Chamberlain tickets om -
braced tba Republican candidates. It was
declared by Representative Sayler and
other mombors of the enb-oommitteo of
tho Hoaso of Representatives on tbo 3rd
of January, that Hayes had carried tho
State by from one thousand to two
thousand votes and such waa tho belief of
witness; Hampton was elected by
1,100 majority. He supported tbe Hayes
and Hampton ticket and all the Domo-
eratio nominees, and eido by side with
Hampton, he canvassed the State for
Hayes, hut bo voted for Tilden, endors
ing on his ballot aa n reaaon for doing so,
that bayonets were brought to tho polls
to seoure tho election of Hayes. Tbo
troops did not interfere ub a body with
the voters, but one of tho soldiers cursed
a citizen; and threatened to bayonet him.
Tho only reason given by tho citizen was
that ho was on his way to tho polls. The
troops wero at tho polling place
for an hour. He, in 1873, saw a
voter killed in Charleston and
thought the shooting in that oasis was
justifiable. In tho conclusion of hia tes
timony, witness wished to say that a jury
of tho State courts, composed wholly of
Republicans, would convict tho most
prominent Republican who should wrong
a Democrat and a Demoeratio jury would
convict tbe moat prominent Democrat
who should wrong a Republican.
A contradiction is authorized of the
statement, several times printed, that
the President has decided not to approve
tho findings of tho Conrt of En
quiry in tho Fite John Porter
case, and that ho will refer them
for i x imination and revision to tho Jadge
Advocate General of Iho army. No such
decision haa been made, end there are
special reasons crowing out of the Judge
Advocate General’s previous service on
General Pope’s stall whiob render tho
reference of the eubjeot to him, in any
event, very improbablo. The record of
tho proceedings of tbo conrt has only
just been received, and covers eighteen
hundred olotely printed pages. Until
the President shall hsvo time to exam
ino this, no dootslon will be made.
Washington.
Washington, May 23.—Tbo Senate
Committee on Privileges and Elections
to-day decided to commence taking tes
timony in tbe Spofford-Kellogg case un-
dor tho recent order of tbs Senate at tho
earliest passible day, and for this pur
pose authorized tho chairman to issue
subpoenas for Mr. Spofford’a witnesses
immediately on the receipt of a list of
their names and residences. Tho Chair
man laid before the committee to-day
tbe replies received from Messrs. Kel
logg and Spofford to tho Committee on
Privileges and Elections, request for
statements of the cumber of witnesses
they respectively desire to call and points
of the testimony* expected to bo given.
Mr. Kellogg, after repeating his protest
against the reopening of this case, which he
claims is res adjudicate, informs the com
mittee that ho remains upon tho defen
sive and cannot, therefore, respond to
their Inquiries until after some of Mr.
Spofford’a witness shall hava been exam
ined.
Mr. Spofford writes that he will desire
subtleness for about fifteen witnesses,
and that he expects to prove by them,
among other things, that five of tho
eighty-three members of the Louisiana
assembly who voted for Kellogg’s elec
tion were bribed, sevanty-nine members
being * quoroni. Spofford’a witnesses,
when named by nim, will be summoned
from Lonlaiana by telegraph and the in

Washington, Msy 2$.—Representa
tives King, Ellis andGtbaon of Louisiana,
to-dsy in conversation with the Presi-
o<nt on the inbjeet, represented to him
that from Conway’s report of hi* decla
rations with regard to tbe exodna the
impression would be crested that tho
President favored the exodns, and would
extend Government aid in fortheranoe of
it The reply of tbe President was in
traaspired in his interview with Mr. Con
I way which could bear such a construction.
His only declaration waa that the navi,
gstion of the Mississippi river should be
free, and must remain unmolested. The
President expressed tbe opinion that
while any citizen, white or colored, had
a perfect right to migrate from ono por
tion of the country to another, it wonld
certainly be very unfortunate for the
large masses of tho oolored people to
proceed to any one particular section of
tbe country, and if they sat fit remain.
It wonld be. In his opinion, better if they
oonld be generally settled throughout the
entire oonntry.
Ha expressed no opinion as to the
policy or wisdom of the present Sonthern
exodus. Upon being informed by Mr.
King that an impression was being con-
vejed among tho colored people of his
district that the Government wonld sus
tain them in migrating westward, tho
President eaid there was no foundation
whatever for the circulation of such an
idea. Ho regarded the story aa being
unfortunate, inasmuch aa it might tend
to mislead those who were contemplat
ing eucb migration.
