logg investigation. Judge Merrick,
counsel for Spofford, offered in ovidonoa
the affidavit of Joseph J. Johnson, which
wss read yesterday, tho purpose being to
impeach tho credibility of Johnson's oral
denials of tho truth of its contents, and
alto to lay tho foundation for proof which
Merrick enid would hereafter adduce to
show that Johnson, since making tbe af
fidavit, has been subjected to influence*
contemplating intimidation.
After a long discussion between conn-
eel in regard to admitting tbe affidavit
ensued, it was decided that counsel
should submit to tho committoe the
legal authorities on which thoy relied,
and tho snbjeot was left for discussion
hereafter.

Tho bill introduced to-day by Senator
Jones, of Florida, relating to public lands,
is a duplicate of the measure recently in

government price paid therefor in full,
no suit, civil or criminal, in the namo of

the Houso to-day was the paeaage of the
Senate bill creating tho Northern Dis
trict of Texas. At two o'clock the bill
making additional appropriations for pos
tal service was taken up, and after two
hours discussion in Committee of the
Whole without action, the House ad

Senato—Alluding to Bayards oila.ion

ed by Justice Field, in the United Stated
Supreme Court, that '‘these laws are as
invalid and unconstitutional as would be
a law quartering a Federal soldier in eTery

not consider it good lav. He then read
tbe law cf Maryland to show there was
discrimination in that State against ad

absurdity of introducing politics into tha
jury system, and said it would end in

in the selection of jurers. Thurman
said Edmunds seemed to be generating
another veto message—furnishing soph
istries for people not sharp enough to in
vent them for themselves, in order that

He aaid Edmunds seemed afraid to leave
the nusliflcations of jurors with the
Stattaj but section SOO of the revised
statutes left it there, and that section was
upheld by the Republicans at least until
1375, when the law was passed prohibit-

Washington, June 6.—Thomas Mar-
ray, colored, who was Sergoant-at-arms
of tho House or Representatives in tho
legislature that elected Kellog Senator, I
was then oalled. He was e witness on
Spoffjrd’s sido of tha ease, but while de
claring he meant to tell tbe wholo trnth,
if murdered for it, ho eoomod inclined to
bd partial to Kellogg. Tho gist of his tes
timony was as to the payment of {150
and $200 to members of tho legislature
who had voted for Kellogg. He had seen
two of them paid himself _ by Sauer,
who was ohairmau of tho contingent fund
oommittee. and had seen money with
three others, who told him they got it
from Sauer, and had been informed by
othora that thoy had been paid. His un
derstanding was from them and from
common report that this money had been
paid these men for their votes for Eel-
logff- He admitted, however, on cross-
examination, that tho vote for Kellogg
had been unanimous; also, that the mem
bers of tho Legislature received vouchers
for their par diem and miloage from
Sauor, and that theao vouchers were at
one time worth in the market SO cents on
tbe dollar. The inference sought to be
deduced was that the money which the
members in question received from
Sauer was an advanco on their
vouchers. Another point on wbioh
his testimony woe more impor
tant, was as to the absence from
the joint convention on the day Kellogg
was elected, of flvo members whose pres
ence wsa neoessary to make a qnoraru,
although the journal showed there was
a quorum present. Ono of tha members
wss named Thomas, and another Seveig'
nee. The journal, however, showed both
of them as voting. He knew Thomai
was not present; had soen him the same
morning ill in bed with small pox. He
was personod by another eolored man
named Watacn, who had made affidavit
to that effect, bnt had slnoe got a place
in the New Orleans Custom Honse. An
affidavit by Seveignea was read, but, on
objeotioo, was not pnt In evldeuoe, slat-
log that be was not proeeat on the day
of the joint ballot, but bad had his vole
reoorded next day. The examination will
be resumed to-morrow.
Io tha Senate to-day Senator Lunar
reported back from tbe Committee on the
improvement of tho Mississippi river the
bill for the organization of tbe Mississip
pi river commission passed by tbe Honse
on Mondey last. The most important
amendment proposed by the Senate Com
mittee is oue increasing the number of
the Commission from five to aeven, and
providing that it shall consist of three of-
doers of the Corps of Engineers, one
officer of the Coast end Geodetio Survey,
two civil engineers and one familiar with
the habits of the river.
The Coset Sorrey has already mads e
systematic sntvey from Fort Jsekson to
Donaldsoavllle, besides doing a large
amount of work betneen the latter pilot
and Memphis. The aotion of the Com
mittee in potting the otfloers ol that sur
vey and two oivil engineers on the com
mission will secure a considerable number
of votes in tbe Senate wbioh It wonld not
otherwise have have had.

New Orleans, Jnne 6.—An editorial
in this morning’s Himes, which vigor
ously criticised the repudiation seati*
mentis of the country delegates gave rise
to a long and somewhat stormy debate In
the Constitutional Convention. Kidd,
chairman of the committee on the State
debt, declared that the country mem
bers could not be intimidated by being
oalled repodiatorf: that the State cannot,
should cot and will not pay anything ahe
does not justly owe. Several country
delegates made speeches of similar pur
port, declaring such articles wonld only
make them fiercer in acting in aooord
with the wishes of their constituent*. It
is rumored when the majority report of
the committee on the State debt comes
up Tuesday tor consideration, will Ask
leave to withdraw and ordinance attach
ed for reconsideration and amendment.
Unveiling Confederate) Monu
ments.
WinchE3TEQ, Va., Jnne 6.—The un
Telling of tbe two monuments eroded to
tbe memory of tbe Confederate dead and
tbe decoration of the graves took pla-o
here to-day. Gen. Joseph E. Johnston,
was chief marshal, and the procession
included military companies from Win
chester, Martinsborg, Alexandria and
Staunton, West Virginia. The Mary
land society of the army and faavy of the
Confederate States and snrvivora of Capt.
Murray’s command of the Maryland line
of tbe procession carried two different
banners of tbe Southern States, together
with the national flag. Tha first one of
the monuments is of marble, forty-nine
feet in height, surmounted by a statute
of a Confederate soldier resting on his
musket. It bears theinscripHon: “Erec
ted by the people of the South to eight
hundred and twenty-nine nnknown Oon-
federate dead in grateful rememberancs
of their horoie efforts and their eiampla
of unaliniad divot ion to duty- Also to
tbe unknown and unrecorded dead—who
they were none know—what they were
»U know.'' The other monument is a mar
ble shaft, surmounted by an urn, ereoted
by the ladies of Virgtna, and bean tha
inscription #l ftt memory of three hun
dred and ninety-eight Virginia soldier*
lying iu this ground, who fell in defease
of Constitutional liberty and the sover
eignty of their States from I SC f to 1865."
The graves were decorated with flowers
and evergreens, and marked by fltga of
the Southern States. Tho Confederate
flxgwaa also displayed, but in an adjoin
ing national cemetery tbo national-flag
was flying. On the speakers' stand,which
was draped with the Confederate colors,
intermingled with mourning stripes/were
Governor Holliday, Generals Johnston,
Hunton and Maury, of Virginia; Gener
als Stewart and Herbert, of Maryland,
and Senator Morgan, the orator'of the
occasion.
Governor Holliday delivered a brief
address, in which he said whatever heart
burnings or bickerings or enmities or
strife exist will be buried here, for this
graveyard is and will remain a common
heritage, and to Southern hearts a poas
esaiou forever." Tbe dead past is buried
here. Theaa noble men who have died
with or without a name have not died in
vala. This tribute :to them is not an
empty ahow. la a little while it will be
the glory-ot a oornmon oountry. Within
sight just over yonder fanco lie bodies of
thousands who fell npon these same Celds
in Federal uniform. Those were, I doubt
not, as earnout aa these, for they died by
each others hand. Think you that it
was in vain? God does not so work.
The death of tbe hero is tbe life of the
State. Just as the blood of tbe martyr
Is the seed of the church. Those died
for the rights of tbe Union; these for
tbe rights of the States. From monu
ments erected over either will oue day
spring an arch in which the hopes and
memories of both snail be interwoven
with golden threads of God’e eternal love
and truth, and on which the eyes of the
people shall ever, read how individual
rights and local government can live in
harmony with ccatral power and the
glory of the great Republic.
' Senator Morgan, of Alabama, then de
livered tbe oratiou. He said “(hose who
lie bare died in the cause of truth and
justice. What they did will never fade
from recollection as long as the people or
the United States have a sinoera regard
for a great cause. If these were traitors
in the South there were 8,000.000 of
them. Every citizen of the South was
his ova leader and the supreme judge of

to falsehood.” , The orator then reoited
tbe points of tbe qaarrel between tbe
North and South, and piludod In eulogia-
tio terms to Lse,Jackson and Johneton as
the three exponents of tbe people of Vir
ginia and the South, and Hill, Brecken-
ridge, and Price, with hundreds of others,
were aocorded a oornmon glory in the
Southern cause of jostioe and truth.

They were soldiers in tbe uma sense

length for the merits and heroism of tho
Southern soldier and especially to tho
unknown dead who had left the rioheat

driving rain,accompanied by thunder and
lightning, daring which thu orator con
tinued amid cries for him to do so. Ho
concluded bv saying the South had no
quarrel with tho Constitution of tho Uni
ted States. They can ied it with them
in tho conflict and for thia posterity will
give them duo credit. Brothers in blood,
but under different banners, all would
accord that they died for the right.
Principles represented by our age, bo
said, command onr allegiance as
fully as thoao who supported tho
Federal army. No sectional strife
now distnrbd onr oounty. We all be
li6ve that onr form of government is best
known to men and founded upon truth
and justice. A government nnder one
constitution and one flag.
The orator’d sentiments were frequent
ly endorsed and he was applauded aa ho
left the platform. Owing to the rain the
crowd of 5,000 or 0,000 had dwindled to
leas than 200. Gen. Johnston, who was
vociferously called for, thanked the com
pany for the cordiality of their greeting,
and said ho was much gratified with tho
proceedings. He endorsed them all. It
had beon an interesting day to him, es
pecially as he had held military associa
tion with many present and with the
honored dead, whose memory was here
to-day appropriately celebrated.
The company then retired to Winches
ter. The town was foil of sc-ldiera and
other visitors and bands in variona places
played “My Maryland” and "Dixie.”
Jefferson Davis had been invited to at
tend the oelebration, but was prevented
l>y private arrangements. No mention
of nia name was made at the cemetery
to day or elsewhere in the vicinity.
