We met him yesterday on C&erry
street—“he" elands for one of nature’s
unfinished noblemen—a boy. The day
waa snmmerish sad balmy, that we char
itably presumed waa the reason he bad
on no ooat; one of hia suspenders waa eff
on a holiday, and the other did doable
duty; only two buttons bad remained
faithful to bia pants, bo whom they seem
ed very mnoh attached, bnt the pants
clang to him faithfully; be had worn
them long, in fact waa wearing them long
when we met him ; upon reflection, how
ever, we believe that statement only
half troe; one leg of them waa, to be
precise, rolled op to the knee, the other
hang in gracefal platoons around hia an
kle. Hi* bat, the term ia flattering, waa
impaled npon a tuft of red hair that had
sprung up to meet the gladsome sun
light through a hole in the corner, and
bia left toe, which was carried slight
ly elevated bore the marks of repeated
collisions with obstacles unforeseen; in
one band he carried a string, to which
waa attached all that waa mortal of two
thrashes and a yellow-hammer; in hia
other hand he bore his weapon of eha*e (
the celebrated Alabama sling. Though
to all appearances fate had beenoareleaa
with this wanderer the neglect did not
weigh heavily npon him, “Them Golden
Slippers” fell in perfect trills from his
puckered bps as be itrelled along.tempting
the rich man’s appetite—ourselves inclu.
ded—with “three birds tor fifteen cents,'
and stopping to flatten bis nose against
some confectionery window, or aeqaea-
trate a stray peanut that tempted him
too much.
Nature ia morciful; there are none so
poor that something will not love ; even
this waif bad an admirer ; a dog fol
lowed in bis wakc^ acknowledging bis
fealty and submission by keeping close
to bia maatci'a beets. The brute was in
perfeot keeping with bis master; never
animat wore a more used up appear
ance ; one eye was gone, and tho hair
on one side of him had not answered
roll-call for years ; in days gone by,
doubtless, a pail of boiling water had
called upon bim and found him at home.
Tho most striking thing about the dog,
however, was the leg at the left front
oorner; this limb started from the shoul
der with the most straightforward inten
tions imaginable, but before it reached
the ground, had traveled toward every
point on the compass; this gave him a
kind of independence in locomotion that
was charming. This mangy, hungry,
ccarred, demoralized looking oar, follow
ed tho procession to Huff’d corner. It
will probably never bo known exact
ly wbat was said at this rendezvous, but
certain it is, that a dog, out among tho
country wagons anchored thereabouts,
pissed some remarks, at which onr cur
took offense, and he sallied forth on ven
geance bent: There were tho customary
walk-round and blackgnardfngs that pre
cedes a fight, and the combat was about
to begin, when a brick came tripping
into the arena and both warriors dodged.

tnoking hurriedly to avoid tbe brick,
crossed the rango of the males “stern
chasers." There was a flash and a thud,
and ere the mule had recovered his
equilibrium, poor “Bill" had struck
somewhere along the balcony of Ralston
Hall, and dropped back utterly wrecked.
There was a brutal laugh among the by
standers. Jones county mules will some
times kiek, and it is seldom a laughing
affair, but with the buy the effect was
different. His prizes were forgotten, his
cherished sling discarded. With stream-
ing eyes he dropped down by that mis
erable mass of dog flesh and lifted the
head into his lap as tenderly as though
it belonged to a valuable retriever. No
matter what had been his faults, the dog
bad been his friend and playmate; he had
never had tho advantages of other dogs,
and things had been sickly with
him since puppyhooJ; but he
made tbe most of what had been given
him, and with that and what he ooald
steal, had managed to get along; ho
ooald run os fast and jump as far as any
dog of hts size and disqualifications, and
could find and suok an egg before a hen
would be willing to sign an affidavit that
she had laid it. So the boy knelt there
and cried. It was only human nature.
Presently, when tho first burst of grief
bad exhausted itself, be got up, and,
having secured the brick, gave the Jones
oonnty mule a liok that shook him to tbe
very centre; having offered np this trib
ute to the memory of hia departed com
panion, bs regained his birds and sling
and we saw him no more.

Jim S. Iverson, the eaergetio oommer
oial agent of H. T. Johnson, left last
evening to embark on the steamship
“City of Savannah,” for New York, after
the festivities of the 4-.h inat. in tnst city.
Mr. Iverson will recuperate at the Thou
sand Ialanns, the lakes and Saratoga.
Knowing Jim as well as we do, we would

countenance will be imbedded in the

Mies Nettie Jackson, of Albany is

Richard F. Armstrong, of Halifax,

Yesterday the case of the State vr.
Charles Gardiner, charged with assault
with intent to murder, was called, and
about eleven o’clock a jury wta made np

This ia tbe esse in which, it will be re
membered, Charles Gardiner shot Joe A.
Massey at hia (Gardiner’s) residenoe
some five or aix miles from the eiiy. in
Msy last.
Tbe first witness introduced was Joe
Massey, who testified as follows :
I saw Gaidiner at bis boase on tbe 17th
of May ; I called at hia house ; I was
sitting in the parlor with his wife and
dsngbier when be came in; be offered me
a cigar and told me I was perfectly wel
come to stay, bm that be was going oat.
Ue came bsok at about balf-past ten
o’etock; earns tn with a shot gun; he
enrsed me and told me to get oat ;
stepped oat of the door and left the
house, closing tbe door behind me; when
some distance from the boase I heard tbe
door open ; turned to nee who it was, and
aa I did so Gardiner fired ; struck me in
leftside of f*03 and in left eye; osn’t
see with that eye now ; be was about
twenty yards fiom me; I was joit outside
of bis gate ; I waa going back to my no
de's boose when I was sbot; Gardiner
was employed at the shops; when I left
the room he was standing in tho parlor
door ; tho sbot were about number four ;
they were squirrel shot; tbe load would
kill a mao; it was nbout half-past ten
o'olook at night; I had been told by bim
I was weloome to stay; never bad staid
qoitosoltte before; Mre. Gardiner told
me she bad apprehensions about Mr.
Gardiner that night; (objected lo and
ruled on';) I was on good terms with
bim; bad never bad a previous difficulty;
don't know where Garcixer went after the
shooting; when I next saw bim be wbb

O. E. Massey aworn stated: Oa tbe
17th of Msy, abont, eleven o'olock at
night, a negro told me Joe bad been shot;
I came to Maoon for a phyeioian and re
turned with one; oflioer Wrye came
oat about daylight; went with him &Dd a
parly to Gardiner’s bonse, couldn't fled
him; banted everywhere; finally tracked
him to G/iswoldville and arrested him at
Sam Govo’s home; he had on him A pis
tol and two pocket knives: oirriad him to
the shop and then to jail.
Officer Wrye sworn: Substantially tho
testimony of preoeding witness.
Tho line of defense followed by Gard
iner’s counsel was set forth in a plea of
lunacy or temporary insanity; the whole
defense was embodied in this plea and
to support it they introduced Miss Faulk,
a visitor at the house of Gardiner at the
time of the shooting. She testified that
she bad noticed frequently tho strange
conduct of tho defendant—his abstrac
tion, irritability and mental depression.
Miss Faulk was followed by Mis3 Gardi
ner, daughter of defendant, who testi
fied as follows:
I thought Mr. Gardiner was insane; I
thought so from bis strange conduct; he
was very cross and irritabl;; he had *
never acted unkindly toward us before;
he was cross and talked all _ tbe tim»;
when sine he la notin the habit of say
ing much; he wrote to firms all over the
United States; don’t know what about;
I never saw him in tbe condition he has
been in lately since we came to Georgia ;he
was insane twioe before, but that was in.
Massachusetts; hia aotions there were
about the same as during tbe shooting;
I do not think ho has been fully in hia
right mind since we came to Georgia; he
was always friendly with Joe Massey; I
thought him insane from bia actions and
appearance; I don't think he knew right
from wrong at tho time of the shooting.
The witness was severely cross ques
tioned npon her testimony, but no mate
rial change was effected. She was fol
lowed by her brother, who 36 testimony
was entirely corroborative of hers.
Aa stated before, tbe defenso relied en
tirely npon tho plea of temporary insan
ity -, tbe opinion was freely expressed
last evening that the plea would be sus
tained. Court adjourned nntil 8:30 this
morning, at whioh boar tbe taking of
testimony will be resumed.

The question was one that nearly af
fected tbe very life and foundation of
Southern society, and was closely, nay,
even eloquently, discussed in all its bear
ings. Tbe affirmative argued cunningly
and plausibly that the racjja cannot exist
in one country npon equal footings.

On the other hand, it was vehemently
protested that the African was a tiller of
the soil; that be belongs to the Sooth ;
that he was onr strength pnotieally, onr
foundation socially, and oar greet stand
by, financially. These are fast few of the
arguments that were advanced; the
question went spinning back and forth
like a8huttle cock until the judge caught
it, and stored it away in his pocket by
deciding ia favor of the negative.
The debate was fall of interest from,
beginning to end, and the presence of
the elite and beauty of tha city attested
in anmistakkbls terms the interest felt in
old Mercer, while the generous applause
tbit greeted each bsppy hit of the orators
showed how equally divided between the
two societies were the sympathies of the
audiecca. The Phi Delta and Ciceronian
Societies are productive of la'crtid cra
