The Argument Continued Charge
of the Court—a Hong Jary.
Yesterday morning the coort oonvened
at eight o’clock, and even at tbit early
boor the court room was filled. At five
minutes p**t eight Colonel J. H. Blnnot
opened tbe argument for the defense,
and went immediately to the entjeet
matter in hand. He spoke for an hour
and forty minutes and keld his audience
and the lory completely interested. His
speech was highly impassioned and wa*
heard with marked and anabated atten
tion by tba erowded court room.
He called to his aid all the power of
carce*m and ridicule, keen satire and
piercing irony. He went over the testi
mony carefully and pointed oat what he
deemed iu defective points.
Daring the course of his argument be
took occasion to comment on the press of
the dav, falling into the popnlsr error of
a whole-ale condemnation of the en
tire guild for their endeavors to
uphold law and Jostle*, order and
harmony. Colonel Blonnt’s remarks
in this regard were those of an advocate,
and we will do him the oredit to think
that a man ef bis intelligense and who ao
will knows tho ieflaenoe of the press ia
preserving pnhlio morals, does not bold
the views expressed when nil making

fens*.
Mr. Bartlett elosed for the State in the

quent, impressive and terribly in eernor t.

point dwelt upon. The witnesses
for tbe defense, especially
Phillips, met with no mercy.
The law of the case was read and
tbe arguments for his side presented
with emphasis and power. His conclu
eion was highly impassioned and thri;
icgly eloquent, and when he eat down
hid certainly won tbe golden opinions
all. He spoke nearly two boors.
Judge Wright proceeded to chsrge the
jury.
He said : Before my charge, I will say
a few words to you. This is a transire
tion of basiness you are called upon
beoause you are cuisine, to try thi
cause. This is an issue to be tried
and nothing ilse. You have nothing
do with the result. Whs: is the truth:
not whether it will affect friend or foe

porary want of knowledge on himself by
voluntary intemperance with a knowl
edge of tbe effects of intempeiaoce upon
him. If so, it would not excuse or jus
tify the commission of a crime, other
wise it wonld.

the fear that a felony is about to be com
mitted npon his person or property he
must show by evidence the acta and
dsings, or sayings, of the one of whom
the fears are entertained, so that tbe jary
can judge from tbe evidence whether
they were sufficient to arouse the fears of
a reasonable man or not. If a man’s
fears were aroused by his mind being
excited by voluntary intoxication from
the use of attoog drink, when there was
no real or reasonable grounds for them,
then they would not exouss cr jastify

Gentlemen, in conclusion, let me again
remind you that the prisoner is entitled
to the benefit of any reasonable doubts
that you may have upon aDy or all of
the material points I h vc given you ia

find the defendant guilty of voluntary
manslaughter. If, upon the other hand,
you believe the defendant is not guilty
of either murder or manslaughter, or

guilt as charged you, then the form of

find the defendafit guilty of murder, you

from death to imprisonment for life. In

After the charge the jury were taken
to dinner and thoa locked np in the
grand jary room to make a verdict. They
seemed to disagree early in the after-
noun and complacently resigned them
selves to the contemplation of Second

mind to all appearances at 4 SO. Tester-
day morn>ng, however, it opened, at
10:30 o’clock, at 4.65. This was a falling
off of fifteen points, and as the explana
tion did not come at once, those who
deal in fntnre deliveries were surprised.
While the market has been dnll and im
active several days no decided change wa
looked for. Toe explanation sooca osme
over the wires, however, that the yellow
fever had made its appearance in Mem
phis, and a psnic had ensued in tbe meat
market. Tne bulletin boards were now
tbe points of interest. Ths second quo
tation cane iu $4 50, fifteen points lower.
Many thought this was surely the low.
est point, as the tone of the market was
active and strong, and made some brisk
iovistmenta. The next telegram showed
j still lower quotation—some as low as
4 374 cents for August clear ribs.

It is estimated that about five or six

twenty to twenty-five thousand dollar?,
Nerrly all the transactions in these
oontroeis are made with Chicago, and
the losers are known ss the Chicago
sufferers.
Tho most reliable figures closed the
marki.t at 4,45. Other telegrams receiv
ed since the closing of tho market stated
that tianractions had been made at 4 20,
and call in margins te 4 cents for August
clear ribs. These, however, were sup
posed to bo curb stone transactions. The
most intelligent brokers last evening were
of the opinion that a reaction would com
mence to-day. Spot meat at its last quo
tation yesterday was 4 75 cents. Tbe
present price of futures ia abuermo], and
a reaction is obliged to come on sooner or
later.
