A report was prevalent last evening in
the city, coming, too, Irom highly re
spectable and reliable roarcae, that Mr.
Warren Lovett, of Atlanta, had ahot and
killed Mr. James Kcynolda, of Griffin, on
aoconnt of a .ady of that city. The
particulars given were few, and
the reason all 'ged tnat tho high standing
of the pirtiea prevented publication at
present. The report is unconfirmed, no
reference to it having appeared in tho
Griffin News of yesterday, the Atlanta
lJitpalch of last evening, or the Annota
ted I'r.aa telegrams, and the report

well known in this community. They

late Jacob Scball in the shoe business,
but now liranoh out on their
own responsibility. They have been
reared in the business, and are thorough
ly acquainted with all of its details, and
are young gentlemen of enterprise and
uprightuoss. We hope tbey will get their
full share of the public patronage.
Crops In tlir Swamp*.
The damage resulting to tue crops in
tho swamp lands below the city by tho
recent freshet in the river is variously
oslimitod at from a quarter to a third of
the crop.. In many places tho water
reaohed up to and oorered the corn on
the tall stalks. All oorn so deluged will
sour and bo worthless, both for man and
beast. The ootton in many of tho fields
war entirely submerged, and the bells
will, when scorched by the sun, fail oil
from the etalk. In the upper portion of
tba swamp, where it was narrower, tho
d image is greater, but, farther down,
the water being spread ont over a great-
ersurface, oon •. qoeoily did qot do nearly
so much d imago. In places the expanse
of water extended six or seven mile*
across. Some of the planters thiok thei r
crops are almost untouched. A number
have gone to doing what they can in the
way of drainage as the water, if it remain
around the roots of the crops under the
action of the sun's rays, will have a very
dlo'.erious effect on them.

Yesterday in tr..j Court of Ordinary quite
an interesting case came op. If was a
proceeding by habeas corona by a mother
to recover her little seven-year-old bey
from a woman to whom she had bound
him out, eomo ten months since.
The mother is a resident of claesic
Bridga Row, and is named Heldy
Knowles. She is employed at the cotton
factory in East Macon. The action waa
bronght against Mrs. Mattie Simmons,
wife of Mr. Asa P. Simmons, commonly
known as Jadgo Simmons, as he was for
merly a ins*.ice of the peace in this city.
It ecems that the mother, some two or
three years since, gave this child to the
father of Mrs. Simmons, Constable
Bright, who took him, in the kindness of
his heart, and turned him over to his
daughter to raise. The little fellow has
developed into a very pretty, healthy and
bngnt boy.
About a year since, papers of appren
ticeship were drawn up, stating condi
tions under which tbe child should be
reared, one of which was that he shontd
be educated for a lawyer. The mother
now seeks to break it, on tbe ground of
ill treatment and general violation of the
contract of apprenticeship by Mrs. Sim
mons.
The mother in her evidence stated that
when the gave the child awoy she was in
ill health, but thst now sho was in but
ter health and able to care for it. She
cited instances when she had seen the
ohild poorly and insufficiently clad. She
stated that she was from Wilkinson conn*
ty and the father of the child was in
Texas. Mrs. Simmons testified to uni
form good treatment and ears for tbe
child, as also did her father and hus
band.
The mother almost wept as she spoke
of tbe child.
During the trial the little fellow, who
is a bright cheeked and pretty boy, with
dreamy eyes, sat in his adopted mother's
lap, quite unconcerned-
After full evidence on boih sides. Judge
McManus called for the authorities relied
on by counsel, and reserved his decision
until this morning at 9 o’clock.

Tho digging out of the cellar for the
handsome store for Messrs. C. n. Rogers
A Co., steadily progresses. The debris
from theburnod building is thrown into
the street, and makes quite a mountain,
extending halt-way across Cherry street.
The cellar below Merkel’s confectionery
has also been cleaned oat, and about the
filthiest mass of corruption we havo seen
recently was taken ont in buckets and
thrown into the street alongside the
larger pile, and the cellar limed and dis
infected. After the fire the debris in tbe
street caused the rain water passing
down Cherry street to be diverted into
tho cellar, and from pissing through the
rains, booaase impregnated with syrups,
molasses, and other things. These
ingredients bare soured, and
now emit a most sickening and un
healthy odor. The pile consisting of
many oart loads from the cellar alono is
left festering and corrupting in the hot,
snltry annoblne, and will oertainly gener
ate disease, if no: removed very prompt
ly. Tbe odor is almost unbearable in the
looality and for half a block away, and
the contents of the cellar ooutain the vital
germ of i yphoid and other fevers. Tbe
cellar, too, of tho burned building where
the heavy goods, sash as molasses, were
stored, has also become very soar snd tbe
vapors arising from it are noxious and
disagreeable. A portion of the dirt ex
cavated nnd thrown on tho largo pile in
the street is open to the same charge.
The pi icing of the dirt on tbe -tree's is a
necessity, and it has through long custom
become thn duly of tbe city authorities to
havo it removed. The street
foroe is small and engaged in
repairing sewers in several parts of the
city, which were broken by the late min,
and we are informed that the pile which
has given offense to quite a number cf
citizens, will bo carted off at the very
earliest opportunity. Work wSa com
menced yesterday afternoon. One cart
only was used, however. The smaller
pile and such portions of the larger as
are offensive, should bo hauled off at
once. It is of tho first importance for
(he health of every business man in that
portion of the city that this should be
done, and done without delay and we
earnestly urge tho Street Committee atd
he llth officer to attend to this matter at
once. It is of more importance than all the
broken placos in the sewers. These may
be fane. <1 in and only an occasional pe
destrian would be trapped, but in the
other case the Well-being of a thickly
tenanted section of the city ia endanger,
ed. In this time of fever epidemics too
much attention cannot be paid to tho
sanitary conditian of the city.

Fanny DaTonport was married on July
31st to Edwin F. Price, a member of her
company.
Miss Marie Booth, daughter of J. B.
Booth, will star next season.
Beecher says a good man cannot be
hart by visiting theatres, especially if he
is provided with season passes.
Dave Wambold, the sweet singer of
the San Francisco Minstrels, is seriously
ill at Saratoga.

publication in this morning's papsr of a
note from Mr. G. B. K-b-rt* a knowl-
edging receipt from Mr. Willingham of
the first payment to him yesterday has
created the impmesioa with many that
this was the fir-t paid of the losses by the
late fire. A3 th? credit of first payment,
if any be due, belongs to my office I de
sire to oorrect toe erroneous impression
mentioned.
I had in this fire fifteen policies in the
several companies in my office, all of
which were satisfactorily adjusted
fourdijs, and seme of my policies were
paid as early os J uly 25th and 26th.
I claim no special credit for first pay'
ci n’, as it is simply a qnes:ion of tbe
proximity of the paying office of the com
pany, and all first-class companies are
usually equally prompt in paying a loss
after it has been adjusted and proper
proofs forwarded.

The Bill Will Pass.

pointed to go to Atlanta in tho interes
of tbs opposition to the bill before the
L gislature and lo endeavor to have cer
tain amendments incorporated in the
bill, returned yesterday afternoon.
The committee met in Atlanta on
Monday and had a long conferences of
abont five hours with Represen
tatives Bacon and Nisbet
room in the Kimball House. The
principal point which was urged by the
Committee was the exclusion of the May-
or and Chairman of the Finance Com
mittee from the Commission to manage
the new bonds. The matter was argued
between those assembled, and no definite
agreement reached, and several of the
points of difference between the Com
mittee and tne Representatives seemed
irreconcilable. Finally Colcnel Baton
offered as a compromise, measure that
foar other citizens be selected and ad.

agreed to by the oommittee, and matter.?

0. Plant, Henry L. Jewett, J. F. Hansen
and W. H. Ro b were chosen, and their
