Tho si-vruth annual report of the Su
perintendent of tho public schools of Bibb
oonnty has been laid bsforo us and
mikes a good showing for the county.
The average attendance, which is 1,747
daily in the county of white and colored,
is a little in advanoe of that of last year
and the year before. A larger number
of teachers too have been employed to
meet the increased attendance. There is
a deficit in the appropriation, however,
of *r»07.03. Tho cause of this deficit is
fully explained in a short card by the
President of the Board of E location of
the county, Mr. Joseph Ciisby, and arises
from the non collection of the poll tax of
tb» couiiry and not from auy extra?*-
giuce or mi.-i.n.iu igeuient on the part of
the Board.

Yesterday morning there was quite a
crowd in the County Court to sec what
disposition would be made of the cis?. of
the State vs. William Linds berg, charged
with an assault on Mr. M. Greenberg, on
Second street, on last Saturday. Th-
case was continued from tue day prevlour,
and when called yesterday the the de
fendant demanded & jury. The ca-e ac
cordingly again went over, and waa set
for Saturday, the 30th instant.
Yesterday before Judge Holt of the
court, an intereeting habeas corpus ca--*
citne up Tae darKey’s name waa Hy
man and he waa charged with the theft
of a mul?. Tae process resorted to was
an aotion of trover and the darkey, 02
the affidavit of the prosecutor, Mr. J. J.
Clay, was arrested without bail. Yester
day a writ of habeas corpus wa3 taken
ont.
When it came np. the point was urged
by tho defense that the affidavit made
by the defendant was insufficient to hold
the prisoner, and that it only stated
that the property alleged to have
been converted was recently in posses
sion of the defendant, when th*
statute require* that the af-
filavit must state that the
property is in his actual custody and
control. The defendant was, on this
showing, discharged from custody.
Yesterday William Bell, a small dar
key about nine years of age, was brought
before Jndge Holt, on a charge <rf aasaul
and battery. It soenu ha and a small
white girl had a little difficulty.
Toe prosecution was brougat by the
friends of tho little girl. The youthful
prisoner was brought into Court, and he
gazed unconcernedly about, as if he waa
not the principal object of interest before
the tribunal.
Judge HjL, on uccmt of his extreme
>oaib, raided the question as to whether
nj was oapible of falfilliag the require
moots of crime, the ect coupled with the

His decision was withheld until to-day

Section 9. That tho Treasurer cf the city
of M icon shall, npon the ofiicial books of
the city, open an account with said commis
sioners and shall, so soon as received, pass
to their credit all of the money collected un

Section 10 Said bonds, when executed, as
herein provided, shall be delivered by the
Mayor of the city of Macon to the f aid board

make to the Mayor and Council of the city
of Macon a report in writing of their actings _
