The Hon. Hiram Warner, Chief Jus-
tice then took the oath required by lav,
wdteh wan administered by Hon. James
Jackson, one of the associate justices cf
the Supreme Bench.
The Cnief Justice then administered
tbe following oath to the Senators in
batches of three:
“You and each of yon do solemnly
■wear that in all things appertaining to
tbe trial of John W. Kenfroe, now pend
ing, you will do impartial justice accord
ing to tbe Conatitotion and lawa of this
State, BO help you God.”
Tbe swearing being completed, the
clerk read the oopy of service of the arti
cles of impeachment on tbe defendant.
Tr.e Chief Justice then ordered the
meaaenger to bring tbe defendant into
court. The defendant was brought in.
Chief Justice—Are t he managers ready
to proceed with tbe trial ?
Manager Oux stated that a number of
witneues bad betn subpoenaed for the
State and that tbe managers were nnable
to state whether they were in attendance
on tbe oonrt, and would waive the right
of announcing ready.
Tbe defendant waived the reading of
the articles of impeachment in writing
by hia counsel, Henry Jacason, Jr.
The Chief Justice then oalled on the
defendant to know it be had any plea or
answer.
Counselor Jackson, Jr., then rose and
tttd a plea and answer in behalf of the
defendant.
Tha substance of tbe said plea is an ad
mission of the facts charged in the arti
cles of impe iobuient, but denies that the
acts charged ccnstitute a violation of the
several acts on tbe eubjdct of receiving
money on deposit of Stale funds. Setting
up that the defendant was ignorant of
the provisions of the Constitution of
1B78.
Tne defendant admits that ho baa re
ceived tbe sums mentioned in the articles
and from tbe persona also mentioned
therein, as set forth m said articles, bat
denies that he did so with any unlawful
intent.
The defendant also admits that he re
ceived $247 from A. K. Childs, Presi
dent of the Northeastern Railroad, for
signing tbe bonds and coupons of said
road, but pleads that as tbe bonds were
not State bonds, that the labor was most
ly dene out of office hours, and that the
example of bia predecessors gave him a
precedent 'or so doing, and pleads not
gailiy to this obaige.
The defendant ul o admits that he did
endeavor to get a position for one T. J.
Priicnett, from the Georgia Baiirood, and
offer to allow the tax collector of Bich-
mond connty to deposit the State funds
in the Bank of Georgia Bailroad Company
and read a letter from General Alexander
Presidtnt of said company in exonera
tion ot his notion in Ibis matter.
Tbo defendant denies fully and com
pletely that be is guilty of any violation
of the laws of the State whatever.
The plea was eworn to by tbe defend
ant. Counselor Jackson farther stated
that the dt fenlai t would admit, as true
any further facts tnat the managers de-
aited to intrednie, which are true.

Tbe managers then asked for time to
consult on the defense of the defend
ant.
Thu Oonrt then adjourned, on motion
of Senator Holcombe, till ten a m.

to report the proceedings of the Kenfroe
trial. The resolution was adopted.
To allow Colonel Peterson Thweatt to
sue the State for the recovery of his
claim against the State in the Superior
Court of Fulton county. Judiciary Com
mittee.
Some other minor business of a similar
matter was disposed of.

substitute for the bill, whieh provides for
tbe appointment of jury commissioners

■XSCUTITB SESSION.
The Senate then went into executive
session to oonsider tbe sealed message of
the Governor received yesterday.
The message was read. It annonnoed
he appointment of Colonel J. T. Hen
derson, of Newton oonnty, as the snocea-
nor of Or. Thomas Janes, as Commis
sioner of Agriealtnre, of the State of
Georgia, and asked tbe confirmation of
the Senate on raid appointment.

ot the Governor.

Tbe Honae met nt nine o’clock and was
cilled to order by the Speaker. Prayer

relative to road working.

On motion of Mr. Aw try, the Hoose

to allow road commissioners to resign af

to make tbe lessees of the Macon and
Brans wick Kailtoad agents of the State
for tne collection of certain claims. Re
ferred to the Committee on ibe Macon
and Brunswick Railroad.
Also a bill to declare tbe meaning of
the first and thirteenth sections of tbe
bill to anchorixe the lease of the Macon
and Brunswick Railroad. Referred to
tbe Committee on the said Bead.
THE SPECIAL OBDEB
was tbe consideration of a bill to amend
the act establishing a State Board of
Health. On motion of Mr. Adams, the
House laid the bill temporarily on the
table.

To amend tbe school law so as to secure
a greater proficiency of teachers.
On the passage of the bill the yeas and
nays were oalled. Tne yeai were 68; the
nays 44. The bill having failed to re-
ceive a constitutional majority was de
clared lost.
A bill to amend the act to prevent tbe
burning of gin houses. Passed; yeas 107
and nays C.
Mr. King offered a resolntton to inves
tigate tbe treatment of iuastios at tbe
Asylum, so as to remove tbe charges of
maltreatment.
Tne resolution was referred to the
Oommittee on tbe Lunstio Asylum.
Mr. Adams introduced a bill to amend
an act to perpetuate fish in Georgia. Ju
diciary Committee.
A bill to provide for the establishment
of a State Normal Sobool was next read.

Tbe bill appropriates $2,000 a year for
the years 1878 and 1879.
Mr. Hul-iey offered aa additional seo

nooesssry traveling expenses of the phy
sician, tbe money to come oat of tne hire
of the convicts.
Mr. Miller moved that the oommittee
reeommend that tbe bill be referred to
tbe committee on finance. Agreed to.
Mr. Pike made tbe report and it was
adopted.
A bill to establish a county coart in
eaon of all the counties of this State was,
on motiuu of Mr. Strother, made the
special order for Tuesday next.

New York, Sept. 25.—In the Long
rauge louruameot at Crcedmore, yester
day, tbe eight highest scores made a to
tal of 1,673, wbicb 18 larger tbao any to
tal ever mode by a team of eight men m
a match and exceeds by a number of
points tbe total made by tbe American’s
Olab in the last motitn. Jackson won
the first prize with a score of 214. He
also won the first prize for the highest
total score in the first class for three day’s
shooting.
Tbe champion marksman badge of
1879, was won by W. J. Underwood, of
tne seventb regiment, witb a soore of 41
out of a possible fifty, at a distance of
two handled sad five yards.
Squeezing Louisiana.
New Yobs, September 25.—At a meet
ing yesterday at the Bank of New York,
of holders of Louisiana State bonds, a
committee was seleoted to devise a plan
for the enforcement of their rights
against that State.
A large amount of bonds was present
ed, and members of committees whose
names have been published, are said to
be large holders of bonds belonging to
tbe class of consolidated 7 per cents, of
whicb the total issue amounts to J 1,777,-
100 dollars.
Affairs in Memphis.
Memphis, September 24.—Ono new
oass reported tbis morning, A. C. Fergu
son at the City Hospital, and one death,
Oaris Miller. Tbe weather is clear and
coal.
Tbe Waiklsis.
New Yoke, September 25.—Pauohot
and Jackson have withdrawn from tbe
walking match. Weston and Hazael had
quite an exciting ran side by side tbis
morning for nesrly a mile, bnt Hazael
Droved too much for Weston. It wss one
of the beat sports yet. Rowell finished
350 miles a few minutes before noon.
Hazael passed Merritt at 12:06, gaining
the second place.
Between six this morning and noon
Hazael covered thirty one miles with
three laps. Howell did not relish the
looks of things this morning, and now
moves at a rapid gait. He has assumed
a dog trot and perspires freely.
At one o’clock Weston had made 287
miles and 3 laps; Rowell, 355 miles snd 5
Up? ; Hszsel, 326 miles and 6 lap?; Gay
on 310 miles and 5 laps; Ennis, 265 miles
snd 7 laps; Merritt, 327 miles; Hart, 301
miles and 1 lap; Taylor, 166 miles: Fed-
ermayer, 251 miles and 3 laps.

official North German Gazette says impor
tance ot the political relations between
Germany and Austria continued to in
crease during tbe last few years, there

impression on him,e.nd inquiring into the

Jacksonville, Fla., September 25.—
The Florida Central and Jacksonville,
Pensacola and Mobile Railroads, were
sold to-day under a decree of the United
States Circuit Coart, and were bid eff by
C. i). Millard, attorney for Adolph Euy-
ler, trustee. The Jacksonville, Pensa
cola and Mobile Road was sold to-day
for fifty thousand dollars, subject to a
prior lien of about $800,000. The Flori
da Central Railroad was sold for $305,000.
Both roads were purchased for the bond
holders, and it is understood that a new
company will be organized to operate the
roads.

London, September 25.—The New
Market October handicap was won by
Fortunatua, Lord Clive 2nd, Thnrio 3d.
Advices tiom the west coast of Africa
report that Stanley had arrived at sierra
Leone,from Bansor,iajthe steamer Alban.
They evidently intend to complete the
exploration of the Congo river. It is
reported that the steamer, launches and
machinery for banting boats up tbe rap-
ids have been prepared at Banana creek
on the Congo. Stanley gave bis name as
Swinbnrne, and invested the expedition
witb so much mystery that at 8 etra
Leone he was in danger of being stopped
by tho authorities, and Stanley bad to
deolare himself and bis purpose.
Bold Attempt at Abdnction.
Buffalo, Sept. 25.—The details of a
bold attempt at abdootion have just come
to ligbt. A young man named Cbas.
E. Souuzler, a telegraph operator, oalled
on the sixteen year old daughter of one
of oar prominent citizens on Tuesday,
while she was attending schuol, repre
senting that he was employed in her fa
ther’s office; that her father bad been
injnred by a fall of a building, and be
was sect by him to bring her to bim. She
accompanied Sohnzler to the place where
it was represented that her father was
lying. On entering the room Schuzlsr
looked the door, seizing the yonng lady,
telling her of his purpose to keep her a
prisoner nntil a certain sum of money
had been paid. He forced her to oopy
the following part of a letter to her father
which be had written :
“ Deab Papa :—1 ask yon to give this
man five hnndred dollars, for nnltss he
raises that sum within a week, he is
mined. He pledges you his word ::nd
honor that it shall be returned within
sixty days. For tbis loan he has no se
curity to offer you except myself, whom
he has in keeping. He mast have tbis
sum immediately—within a week. So
bog as he thinks jou intend to pay this
sum, just so long shali I be kindly dealt
with, but at the first indication”
At this point she stopped writing, and
begged to be released, promising to raise
tbe reqnired sum and bring it to him.
On her swearing to never disclose what
had happened, she was released yesterday.

had taken place. Scbuzler is now under
arrest, and confesses bis crime. Oa his
Derson was found a letter to th9 father
of the yonng lady, saying in substance
that be had his son, Willie, aged six
years, in custody and ha would release
him on the payment of $5,000. If the
sum was not forthcoming the child would
ba drowned. Schuyler was held to bail in
$5,000 for trial. Tne names of a number
of ohildren of wealthy residents, with
their homes, was also found on his per
son.
Tbe Steppers.
New Yobk, September 25.—Earns,
who is a great favorite with the specta
tors, made his 300.h mile in 7 minutes
and 53 seconds. Merritt is making a
tine struggle to get ahead of Hazeal and
take the second place. He seemed to be
getting used np, the tremendous work
telling on bim.
Rowell manages to keep bis lead of 30
miles and more over Hazael. He seems
fresh, but tbe paee Hazeal f oroed him to
take is evidently not agreeable. He re
taliates by sticking to Hszeal’s heels with
wonderful pertinacity. He dogs him
aronnd mile after mile, and some of the
crowd shoaled at him, “Come off,
doggy.”
To-night fully 7,000 people were in the
garden snd several thousand in the streets
outside. Guyon is not going very fast,
and he 6eems to be losing some of tbe
spirit be displayed daring tbe first few
days.
At ton o’clock, which was the end of
the 931 hour of the week, Rowell had
made 363 miles. This pats him eight
miles ahead of Weston’s London record
for the same time. It also made him 42
mile9 and 1 lap ahead of bis own record in
March.
Merritt is improving in his style and is
going at a rapid pace.
At 11 p. m. tbe soore was: Weston
317, Rowell 397, Hazeal 360, Gayon 343,
Eanis 305, Merritt 358, Hart 331, Khrone
301, Taylor 108.
