had a conversation with Renfroe about
getting a situation for a friend in tho
Atlanta department of the Georgia Road
that the friend would be satisfied with
any position however humble. But he
did oot wish to make a bargain with the
road, but that if he eoald get tho posi
tion for his friend he woald make the
bask tho depository of the State funds.
The name of the friend was Pritchett.
The bank was already the depository of

Tee Chief Justice read the role of the
Senate on tie subject.
JiiLagei Cox tuen argued the objec
tion ttut c .j evidence sought to be in
troduced were declarations by the defen
dant a month after the com mission of
(he efisnse is his own favor, and this
declaration is that he did not know the
law. The code declares that ignorance
of law is not excuse for the act. The
supreme court has ruled that ignotance
of law will not excuse a sheriff in the
exercises of his official dnty ; that the
cases era identical.
Counselor Jackson, Jr., rose and ar
gued the other aide. That the defen
dant has been elected three times to the
.office of Treasurer; that this court is not
governed by the ordinary laws of evi
dence. He is yoar servant; now will yon
ri.:nyyoar servant to tell you he wap ig
norant of some rules of law.
(Japt. Jack-ion then read the section of
the code which admits os evidence, let
ter--, replies, and conversations as going
to explain motives; also a case from N
J., in which it was ruled in the. case of
indictment against a Justice of
the Peace for receiving illegal fees
in which case it was ruled toat the
ignorance of the law and an absence of
criminal intent will excase the defend
ant. To refuse to let the defendant
show bis motives, wonld be a proposition
unheard of, even in a court of the emall-
eat dignity, much more before this High
Coart of Impeachment.
Manager Cox spoke again, and claimed
that the authority relied on was founded
on a mistake in the officer, not on igno-
ranoe.
The Chief Jnstioe—The general rnle
is that all cocemporaneoua saying and
doing are competent and admissible to
explain motives, bat the chair is not aware
of any law permitting a conversation
long after the offense, in his own benefit^
to be introdneed. And, therefore, the
evidence is inadmissible and should be
ruled out, but the chair would submit the
qnesiion the Senate.
Senator Camming opposed the rejec
tion of the testimony.
Senator Cabaniss also spoke on the
question.
Pending a vote on the qaestion, Sena
tor Bower moved to adjourn till ten on
Monday morning. Agreed to, and the
Coart adjourned accordingly.

THE HOUSE.
The Honse met at 9 o’olook and was
called to order by tho speaker. Prayer
by Rev. Mr. Taliaferro of tho House.
The jonrnal was read and approved.
By consent Greene of Baldwin intro
duced e bill to increase the salary of the
Treasarar of Baldwin connty to $500.
Referred to Finanoe Committee.
The unfinished bueineae was the con
sideration of a bill to appropriate money
to pay tho contingent expenses of the
preset adjourned session of tha Legis
lature.
The House went into committee of the
whole to consider this bill, with Mr.
Laffman in the chair. The amend
ment offered by Mr. Harris to pay the
clerk of the House and tho ascretBry of
the Senate $100 each for indexing the
journals was lost.
Tho committee of the whole on motion
of Mr. Miller reported the bill back
with a recommendation that it do pass.
Tho report was adopted. On the passage
of tho bill the yeas and nays were nec
essary, aa it appropriated money. Tho
yeas were 102, nays 6. So tha bill
passed.

Mr. Awtry, the author of tho bill, read
to tho House an able and elegant argu
ment in its favor.
On motion of Mr. Phillips of Cobb the
bill was made the special order for Mon
day, immediately after the reading of
the jonrnaL
Mr. Duval offered a bill to fit np new
apartments for the State Library. Re*

On motion of Ur. Mjnatt a resolution
relative to the pay of mileage for the ad
journed session was read the second
time. The House in committee of the
whole, with Mr. Hulsey m the chair, re
ported in favor of tho passage of a bid to
pay expenses of the committee whioh in
vestigated the office of State Treasurer.
On motion of Mr. Canoon the Honso
adjourned to Monday morning at nine.

London, September 27.—The short
tine movement in the Oldham cotton
trade is advancing. Fonr-fifths of the
trade are'curtailing prodnetion. The
Preston District Association has issued a
circular ootnplaining that spinners’ wa
ges are twenty-five per oent. less than
in 1S66, and stating that great distress
prevails among workingmen. The mas
ter iron ship ouilders in the Lee district
have asked their employes to submit to
five to fifteen per cent, redaction, ac
cording to the class of work, the redac
tion to go into effect October 18.
London, September 27.—The Vicar-
Patriarchal of Constantinople, having ar
ranged the difference with the Porte,
will shortly arrive in Rome to oonclude a
favorable convention for the regulation
of the Roman Catholio Church in Turkey.
The Tramps.
New Yoar, Sept. 27.—Ferdermeyer
has withdrawn. When Rowell neared his
five hundredth mile the vast audience
began to cheer, and when oompleted, the
oheera and yells shook the building.
The receipts so far are $61,4S5 dollars.
It is thought the total receipts will be
$30,000.
At one p. m., the aoconnt stood : Wes
ton 434 miles and 2 laps; Rowell 499 and
6 laps; Guyon 452 and 1 lap; Merritt

The Memphis Situation.
Mskthis, September 27. —One
new case has been reported. Allen
Brown. Three deaths have occurred,
Carl H. Shnrmyer, Chas. Hallman and
Harriett Arohey. The last named color
ed.
Charles Hallman died 5 miles from the
city on the Poplar street Boulevard. A
yonog daughter of B*v. W, T. Dolzell
was stricken with fever last evening at
Fred Warins. She hod the blick vomit
last night; Mrs. Preatidge remains very
low.
Domestic News Items
Richmond, Ya., September 27.—Al
bert Mitchell, colored, was yesterday
oonneted of murder in the first degree,
killing Chas. K. Walton at Yanoey-
ville, some months ago.
In tne eaae of Wm. Groome, white,
charged with the murder of Ellen Cole
man, colored, the jury has not yet
agreed.

preme Court appointed Robert Thomp
son trustee of Mrs. Sprague’s property.
Liras Rock,September 27.—The local
Board of Health, yesterday, passed an
order establishing the quarantine limits
at fire miles from the city against every
thing coming from Memphis.
New Yoke, September 27.—In the
snit against Samuel J. Tilden to reoover
money alleged to be due from him for
income taxes the defendant’s counsel, a
tej days ago, made a motion for a bill
of particulars, judge Choate this morn
ing, in an elaborate decision, denied the
motion, upon the well settled redes of
practice relating to the matter of bills of
particulars.
Washington, D. C., September 27.—
The Secretary of the National Boird of
Health to-day sent a letter to President
Plankett, of the Tennessee State Boatd
ot Health, stating that the exeentive
Committee endorsed all hia actions in re*
lation to rule six, and saying that the
matter will receive the early considera
tion of the National Board ot Health at
its meeting in October.
St. Louis, September 27.—A private
circular has been, issued here by the
trade assembly, and sent to all the as
semblies in the United States and Brit
ish North America, Betting forth the
project for a general strike in all trades
The time will be determined by the trade
assemblies.
Gloucxstxb, Mass., Sept. 27.—A fire
broke oat in Carter's oil clothing manu
factory on Rogers street this morning
and extended to the Eureka bouse on
Duncan street, the Gloucester National
Bank and other buildings. The loss is
estimated at $75,000.

Nxw Yosk, September 27.—About
8:25 Rowell, Merritt and Hszael oime
along the track hand in hand, with Mer
ritt in the middle. Tne nprcsr was tre
mendous and the building shook with the
applause. They stopped opposite the
timekeepers’ stand, and Rowell acting as
spokesman said: ‘‘Gentlemen, I thank
yon, I am through.” Tne three then re
tired, the score being Rowell 630, Merritt
515, and Hszael 500 miles and one lap..
They then went to their tents, and soon
left tho building.
Rowell, Hszael and Hart‘started to ran
aboatsix o’olook. Hart dropped oat af

Halifax, Sept. 27.—His grace, arch
bishop McKinnon, of Amigoniahe,
Nova Scotia, died of paralysis at Aatig-
ouishe last evening, aged 67.
London, Sept. 27.—l'no Liverpool Post
says in consequence of the prevalence
of the foot and month disease among 1,300
head of sheep, which have recently arri
ved there, the privy council is about to
issue an order piaoing American sheep
the same category with cattle.

NxwYohk, Sept. 27.—The most exci
ting spurt occurred about 7 o’clock,
when Rowell oompleted ins 525th mile
in a run. He was joined by Hart, who
challenged the place and the moment
they started they were joined by Hszael
and Merritt, and the most exciting race
ensued. Side by side went Rowell and
the negro at a ton mile gait, which at
every moment was increased, and imme
diately behind them, trying to catob,
were Hszael and Merritt also. Sido by
side they went around for several laps,
and one continuous yell rent the air. The
paoe proved too hot for Hart, and he
soon euooumbed, soon followed by Mer
ritt, who also found the pace too quick
for him. It waB continued by Rowell
and Haziel for a few laps, when they
too gave it np.
At 8:25 the great raoe is drawing to a
close, and it has been a greater financial
■access than even the most sanguine an
ticipated. It is already a foregone con
clusion that the belt goes back to Eng
land. Merritt’s friends and backers are
confident ot the boy’s staying powers, and
are making arrangements to challenge
the winner. At 8 the score stood: Wes
ton, 455; Rowall, 528 and 1 lap; Hszael,
499 and 6 lap*; OnyoL, 451 and 3 Lps;
Earns, 444 miles; Merritt, 514 miles and
2 laps; Hart, 477 and 5 laps; Kbrone,
442 and 7 Ups; Taylor, 244 and 4-laps.
Weston seems perfectly happy in hav
ing made 455 miles. Under tus articles
of agreement when more .than six men
oomplete 450 miles, tbe winner is to re-
oeive half of the gate money, and the
balanoo is to be distributed among the
other competitors in proportion to the
number of miles completed, as may be
directed by Sir John Antler, the giver of
the belt. Weston retired from the track
shortly after six o’clock, with the under
standing that be would not return until
Ennis pnshed him out of his position as
sixth man. A ripple of enthusiasm was
oansed when Roweliwalked aronnd car
rying the Ameiioan fisg and Merritt ran
aronnd waving the Union Jack, the band
alternetely playing Yankee Doodle, and
God Save tbe Queen. The denss crowd
cheered, whistled and clapped their
bands with might and main. The en-

Ennis finished his 450th mil: at 9:25
oa a run, and was greeted with storms of
applause. Taylor finished hi* S50th mile
about the same time. Guycn lef: the
track at 9:15 with 471 miles to his credit.

Bart went off at 9:50 with 4S2 miles and

hood have also been exposed to the de-
sease from visiting the patients before
