Manager Cox resumed the argument
of the cause for the State.
Mr Cos said that he had too high an
opinion of the intelligence of the court to
make a repetition of the argument.

the defendant is guilty let him suffer,
and if he is innooent there is enough in
telligence in this Senate to find him in
nocent
Mr. Cox then proceeded to ergao tbo

of a thing forbidden by the statute, ol
though without corrupt motives, is still
indictable. Bussell on Crimes; volume 1,
page 86.
Toe neglect of duty is also an indicta
ble offense at common law. When

He then read a long list of authorities
controverting the proposition that ignor

The first thing wa see is that this offi
cer was a trustee of the people, a propose
tlon as old as the law. Too people are
the masters: the officer is the servant. A
trustee must not use trust funds for his
own use. He begged the pardon of the
oourt for having to answer fine speeches
on the fundamental principles of the law.

Mr. Cox then proceeded to discuss the

the amount of $217, as illegal and ex
tortionary of the money of the citizen.

a profound knowledge of tbe law and

one of the grandest efforts ever made in

The oommittee appointed to investi
gate the Tuggle fee matter will report
to-morrow. They condemn tbe Govern
or’s oourse in tbe matter, and reinstate
Colonel Green as attorney and agent cf
the S;ate in the State claims against the

entiary convicts. Tbe substitute offered
by the committee was read and taken np
by sections ror amendment.
Mr. Miller of Houston, offered an
amendment to the first section, so as to
make the Secretary of State a member of
tto Board of Managers instead of the
J’rinaipal Keeper of the Penitentiary
Agresd to.
Mr. Luffman moved to strike oat the
fourth section, which providea for the
appointment of tnree wardens, one to re-
«ide at each penitentiary.
Mr. Hall offered an amendment to the
sixth section, relative to lee-eea making
reports aa to locality of camps, number
«! convicts, etc.
Section erventh was read.
Mr. Northern offered an amendment
insert “retained,” in a clause providing
for the content of the wardens to em
ployment of guards. Agreed to.
Section eighth was read.
Mr. Shannon offered an amendment
providing that no pnnishment of con
victs shall amount to crnelty. Agreed
to.
Mr. Miller offered anmendment to sec
tion 5, whicn provided that tbe wardens
be paid out of tbe State Treasnry in
stead of the penitentiary lease money.
Agreed to.
The reading of the uubstitute was
completed.
Tbe eabstiinte wai adopted in lien of
the original. On the passage of tbe bill
the yeas and nays were neoesaary as it
contemplated the appropriation of money.
Mr. Harris offered an amendment that
the convicts, as far es practicable, bo
classed according to the moral turpitude
of their offences. Agreed to.
On tho passage of the bill tbe yeas were
69 and the nays 67. So the bill failed of
a constitutional majority and was there
fore lost.

CaxTENSX, October 2.—Lient. Price,
who is at Fortification Creek, twenty-five
miles back of Thornburgh's command,
reports that he has thirty men, and has
received orders to entrench and forti'y
well.
General Merritt left here on a special
train yesterday afternoon.
Assistant Postmaster General Tyner
and Governor Hoyt, of Wyoming, with
their military escort of eight men, it «
believed are now with Thornborgh'd
command. It is reported that Agent
Meeker and family aro murdered and
the ageney buildings destroyed.
Military Reorganization.
St. Louis, October 2.—The Military
Convention met again yesterday, Gen •
eral Beauregard, First Vice-President, in
the obair. A bill framed to meet the re
quirements of the militia service was
taken up and discussed, the bill now be
ing betore the Home Committee on
Army Affaite. The sense of tho Conven
tion was that it should not be materially
changed. The bill submitted to the
commiteofor a revision of organization,
under the Constitution, was adopted yes
terday. It is called tne.National Guard
Association of the United States, and the
objeot is to secure military efficiency and
a united representation before Congress.

London, October 2.—James Barber,
Son & Co., bankers and merchants of
Londoo, have failed. Their liabilities
aroX'JO.OOO. The failure wax owing to
lossea in the East and West India trade.
A Lisbon dispatch reports that the
health commissioner has declared the At
lantic ports of the United stales free
Horn fever, bnt that New Orleans and
Memphis are still infected.

State, opened the Imperial Supreme
Court, and admimatei ed the oaths to Dr.
Simpson, President, and other officers.

Herr Sohneegene, formerly Alsatian
deputy in tne Reichstag, has been ap

Alsace-Lorraine. Field Marshal Mantenf-

Berlin, October 2.—Tho election ra-
larns from the country districts come lu
slowly. So far as received they indicate
the success of the Conservatives. Her von
Lasker and Richter, two of Prince Bis
marck’s chief opponents, are probably
defeated.
London, Oct. 2.—The Cleveland iron
miners hare decided to ask an advance
in wages owing to the prospeots of trade
being innoh brighter. Air. Dale, tbe ar
bitrator in the great dispute in the North
ern iron trade, has oonsented to uooept
seven per ceaL off the standard rate of
rednotion in wages of the Jarrow iron
workers,who resumed work under protest
against the original award of twelve
per cent. reduoiion. It is believed that
tnis Will end tne dispute.

Memphis, Noon, October 2.—Not a sin
gle new c&se reported and only one death
since last night—Mrs. Maggie Stewart,
at old Barney Granain’s plaoo just be
yond the city limits. Weather oppres
sively warm and sultry.

Nsw York. October 2.—At the annual
meeting of tha trustees of tho Peabody
EincatioaFund, Dr. Sears, tha general
agent, read his report. It states that tbe
necessity for the general government
granting some aid to Southern States in
their efforts to edneate the ignorant
classes is greater now than ever before,
as the evils that grow out of popular ig
norance spread a blight over the whole
conotry. With two million ohildren still
without instrnotion the danger of the
aitnstion is apparent.

New York, October 2.—A Greenville,
Miss., dispatch says: “Tha fever at Con-
oordia has taken a fresh start, and in ail
probability will continue to spread until
all the available material is exhausted.
Four new oases are repotted to-day:
Mrs. Herndon,and three oolored persons.
Sheriff Wilson’s condition has not im
proved.”

ry of tin toys, and was wall filled with
stock. It was owned and partly occupied

;ae stock is $15,000. The damage to the
bnildmg is fuily insured. The origin of
tha fire is unknown.
New York, October 2.—The steam
ship France brought $600,000 in twenty
franc pieces.
Washington, D. C., Oct. 2.—Among
the arrears of pension claims paid to
date, were 1.479 settled throngn the
Knotvilie Agency, and aggregating
$928,863. It is estimated there are 6,000
or 7,000 pensioners entitled to arrears who
have not yet been paid, but the twenty-
five millions appropriated will cover them
alL

Chetenni, W. T., October 2.—Two
freighters, recently engaged in hauling
Captain Dodge’s company’s baggage to
Steamboat Springs, from Middle Fork,
arrived here from North Pork list even
ing. They report eeeiog fresh sighs of
Indians through the Park, oCmeeting a
young Arrapahoe who told them that tne
Arrapahoea had joined the Utesforthe
purpose of driving the colored soldiers
(Capt. Dodge’s company) out of the
park. They think the Indians were
about to procceed to 8teamboat Springs
matter General Tyner and party, whose
presence near tbe scene of the Thornburg
massacre, caused much anxiety for their
safety and ehoits that they are thought
to be one hundred and fifty miles east of
Milk River, and therefore not endanger
ed, unless the outbreak extends very
widely.

London, Oct 2.—A dispatch to the
Standard from Vienna says: The dis
tnrbance in East Roumelia is becoming a
guerrilla war. Tnere is a gang of COO
well armed discharged soldiers in the
mountainous district of the West.
Constantinople, Oct. 2.—The Interna
tional Commission will hold a meeting
before tbe end of the week, to prepare a
plan of reforms for the provinces of Eu
ropean Turkey.
Simla, Oct. 2.—The cavalry brigade of
Sir Frederick Roberts advance guard
reached Yabid Abad to-day. The whole
expeditionary force Is expected to
concentrated for the attack on Cabut
Sunday next. Tne Barnokzai Chiefs are
on friendly relations with the British,

Cincinnati, October 2.—The striking
oabinet makers held a meeting this
morning. A oommittee was appointed

New Obleans, October 2.—Wo. Bay,
commander, says: “Tne statement tele
graphed from Washington, inveighing
against Federal officiate here, ana com'
plaining of ncn-emplojent of ex-Federal
soldiers, attributed to the Grand Army of
the Repnblio, is entirely unauthortzaa^by
this post.”
New York, October 2.—Tompkins
Co., 45 Peail street, have made an as
signment. Tneir liabilities are not
known. The claims of preferred oreditors
amount to $22,500.
St. Louis, October 2.—The Militia
Convention met again this morning, with
General Beauregard in tne chair. Gen.
Hnnc, chairman oi the committee to
whom wag yesterday referred the bill now
before Congress for the organization of
a national gnard, reported mat tbe com
mittee was unable to agree, and that the
majority and minority reports had been
prepared.
Both reports ask for an appropriation
from Congress of two millions of dollars
annually tor the benefit of the national
guards, and the difference between tbs
reports is that the majority report says
the appropriation shall he apportioned ac
cording to the enrollment of militia
the several Stated, while the minority re
port provides for the division of tho
money according to the population.
Considerable debate followed the read
ing of the reports. Strong speeches were
made on boin sides. Finally the vote
waa taken and the minority report was
adopted—the vots being taken by States
The convention then adjourned, iu meet
at the call of tne Executive Committee.

New York, OeL 2.—For the past few
days there has been arriving in this oity
from different parts of the State, repre
sentative Democrats, who Were summon
ed hither to take part in a conference
co-day, at beadqnarters of the Democrat
ic State Committee, in the St. James
Hotel. Different elements in the party
are represented by visiting politicians,
and it is expeoted that the conference to
day will be productive of harmonizing
results. The visiiors will be met by the
local Democratic] leaders and a mutual
exchange of views will take place. Prom
inent Democrats from all parts of the
State were invited, and this morning the
rooms of the State committee were*
thronged to tneir utmost capacity. All
of the State oommittee will be representeu
either personally or by proxy. A plan
was adopted dividing the State into nine
districts, whioh are to be visited by a
oommittee of six members.
