Bichsiosd, Octo 1.—In the Senate, to-day, 4fr.
Semince, from the Judiciary Committee, to whom-was
referred the resolutions relative to Lincoln’s emancipa
tion proclamation, reported a bill to repress atrocities
by the enemy by retaiiiation, Ac. Other bills and re
solutions on thp same subject were presented and all
made the special order of the day for to-morrow, one
o’clock. - Tho remainder of tho session was occupied
in tho dissuesioo of rosolu.ionfl relative to martial law
and Provost Marshals. The fo’lowing resolution was
finally adopted, by a vole <31 yeas 21; nays 1—Mr
Wig fall:
Eeaolccd, That the military lnw of the Confederate
gtatea is, by tho constitution and the enactments of
Congress, limited to the land and naval forces, to the
militia when in actual service, and to such other per
sons as are within the line3 of any army, army corps,
division or brigade of the army of the Confederate
States, nnd that no officer of the government of the
Confederate States has the constitutional or other
legal authority to declare, organize, or enforce martial
law over any portion of the territory or citizens of the
Confederate Slates.
In the House, Mr. Lyons, or Va., submitted a pre
amble denouncing Lincoln’s emancipation proclama
tion, and resolutions prescribing the mode o f retalia
tion against-the enemy. Mr. Chilton, of Ala.,
submitted similar resolutions, and all were referred to
the Committee on Foreign Affairs.
Mr. Foote submitted a resolution recognizing the
practical neutrality of California and Oregon and the
territories of Washington and Nevada, and proposing
on the assertion of their independence of the United
States, the formation of a league between said States
and territories and the Confederate States.
The exemption bill was farther amended and then
passed.

ville.
Fredeuickseuhg, Oct. 1.—The Baltimore Sun of the
29th, quotes gold in New York, on Saturday, at 121 a
121 Sterling Exchange, 182a 133>£.
The Sun also says Buell is in Lou'sville fortifyieg
the city, and that Brcgg’s pickets are twelve miles off.
Buell at Louisville.—The Baltimore San,
one.of the most reliable journals at the North,
confirms the report of Bueli’s having reached
Louisville. There i3 no longer a doubt then that
Bragg has been outgeneraled, and by his alow
movements baa sacrificed all the advantages we
had gained by the occupation of Kentucky when
there was hardly a brigade i of Federal troops in
he.- borders. If Buell’s soldiers are in Louis
ville, the city cannot be taken, except at an im
mense loss of life.
A Suggestion.—The visit paid u:l by the
Fedcrals yesterday teaches a lesson which we
hope will be laid to heart by our military au
thorities, viz: That every battery on our river
and main should be garrisoned with its full
complement of men, and that without a day’s
delay. No serious consequences are to be ap
prehended now from sickness, and were it
otherwise something must be risked for the
safety of the city. Our Uoating battery, too,
should be p’aced in position immediately, and
every preparation made for a successful repul
sion of the enemy, should he venture an attack.
The movements yesterday were not without
their meaning, and we should take care lest wc
be caught napping.
They Deny the Impeachment.—Yesterday’s
Xews contains a card from Messrs. Ross, Brad
ford and Clifford, the individuals whose arrest
was noted in our local column some days ago.
They say the two first named are not deserters,
but on a sick furlough, and were returning to
their regimenjts under Jackson, in Virginia,
when arrested, and that the third is now a
civilian, having received an honorable dis
charge frem the service. They also deny all
connection with the buainess of counterfeiting.
We know nothing of the men, and only in
serted facts that were reported to us on what
was considered reliable "Authority. We give
them the benefit of their statement, and would
republish their card could we extend the cour
tesy consistently with self-respect. In oar
former article we simply stated the allegations
against them, and which caused their arrest,
not that they were guilty. That is an issue to
be tried by another tribunal.

Many Voters. .
'Further from Wilmington.—The progress
of yellow fever in our sister city of Wilmirgton
has become alarmiug. The number of cases
reported is fearful for the population, and but
few seem to recover. • The Journal of Monday
evening says :
The following is the number of new cases of
the prevailing fever occuring since our last is
sue, and reported to the Mayor up to 10 o’clock
to-aay:

At 11 o’clock on yesterday 13 deaths were as
certained to have taken place on the night pre
ceding and up to that hour. It is also asserted
on good authority, that the number of intern
ments yesterday was IS to 20.
No person who has not visited our town since
the outbreak of the epidemic, can form any ea*.
timate of the suffering the people who are
compelled to remain here are undergoing. Yes
terday was an awful day. One of ihe editors
of this paper has had the misfortune of going
through a similar visitation in his native town
(Washington, N. C.,) some years ago. It was
bad enough there, but netbing to compare with
be obtained, and when they .can be had, the
comforts of life can only be got in rare cases,
while delicacies for the sick cannot in many
instances be obtained at all .
Among those whose deaths we have to record,
are some who died elsewhere, but unmistakea-
bly of the disease contracted here. One of
these we may mention now—Wm; C. Betten
court, Esq , one of our oldest and most estima
ble citizens, who died of yellow fever, on
Thursday last, in Clinton. Div James H. Dick-,
son, a phyBician of the highest character ahd
standing, died here on Sunday morning of the
same disease. Dr. Dickson’s death is a great
loss to the profession and to the community.
We have just heard of the death, at the
Sound, oi Stephen Jewett, Esq , Cashier of the
Bank of Wilmington, of the prevailing fever,
contracted here.
The Journal complains of the lack of nurses
and almost every delicacy appropriate to the
sick. Can we -not help them, in Savannah?
Delicacies are probably out of the question,
bat surely we can supply them with a corpB of.
nurses.
Kossuth has published a letter denouncing
the call of Garibald or Hungary to rise, and re
pudiating the use ot his name in connection
with the calL

TIac Failure of tlie North in this War,
from 1131 Sugllsh Point or View,
Europe is growing tired of the promises of
the North of “ putting down the rebellion.
The London Times, in a late number, is quite
despondent of the success of the North, and
frankly admits that the efforts of the North in
this war have accomplished nothing but a waste
of blood and treasure. The Times speaks with
great nerve, and says:
How are the mighty fallen ! A year ago
the North went forth to conquer, confident ia
its numbers,, its vast flotilla, in its crushing ar
tillery, and in its possession of capital, for the
moment, at least, entirely without limit. It
went forth to fight for empire, and, as men do
who seek, to conquer and oppress their fellow-
men; it trusted mainly in overbearing might,
ami rested the merits of its cause on the sharp
ness of its sword. It invaded on every side a
territory scantily peopled, supplied with like
wealth, without manufactures, without large
cities, cut off from the rest of the world by the
vast naval superiority of its antagonist, with
nothing to rely on but dauntless courage and
resolute endurance. The Southerner was ill
armed, ill-clothed, ill-fed, poorly lodged, and
he was encumbered with the most formidable
of all hindrances—a slave population of several
millions, to whose mercies he had to leave his
wife and his child, his homestead and his plan
tation, when he went forth to fight his battle
of independence.
Wherever they could swim the Northern
gunboats penetrated, and, so long as they were
accompanied by this flying artillery, which also
afforded an easy means of transport for all the
wants of an army, the Federals proved irresisti
ble. The time came at last, however, when it
was necessary to advance beyond the reach of
gunboats, and then, as we in England always
predicted, the Federal difficulties began. After
pouring forth blood like water, and fertilizing
the fields of Virginia with thousands of corpses,
the North finds itself obliged to begin all over
again, with predit destroyed, a ruined revenue,
a depreciated currency, and an enormous debt.
Nay, as if these were not sufficient, a Republic,
based avowedly on the inalienable right of man
to personal liberty, to life, and to the pursuit
of happiness, and on the principle that govern
ments are formed for the purpose of establish
ing these rights, begins to talk of levying three
hundred thousand men by conscription. _ .
Will nothing arrest this frantic and suicidal
rage ? Is there no one from whom the Ameri
can people will listen to the words of truth and
soberness ? We know that counsels of modera
tion, ever distasteful in themselves, are doubly
distasteful when coming from us; but we can
scarcely believe that the infatuated multitude
will remain as blind to the teachings of facts a6
they have hitherto been deaf to the voice of
well-meant expostulation. What proof do they
yet require that they are embarked ou a fatal
and ruinous cause? Their wealth is turned
into poverty^ their peace into discord, their
prosperity Into wretchedness; the: power in Killingsworth, Thos. M
