AN ACT to alter and amend the First Section of the Thud
Ankle ol the * institution ol ibis State.
Be it. enacted Ly the General Assembly of the State of Gear
r,ria, Thai so soon a>* the loilowiug fceeiio.i shall have passed
the • General Assembly agreeable to the requirements ol the
Constitution, it shad be held and taken as the first Section ol
the third article of the Constitution, in lieu of the present
tiro, section ot said third article:
gee. Ist. The Judicial powers of this State shall be vested
in a Supreme Court, Superior Courts, County Cour's, and
.losti es’ Courts, and in such otben ourts as the Legislature
sha-l from time to time organize and establish.
The 8 ipreme Court shall consist of three Judges, who shall
be elected by lbe people of the State qualified to votefoi
members of i;e General Assembly, t hey shall hold their of
fice for such term of years as may be prescribed by law, and
ahali continue in office until their successors are elected and
qualified: removeable by the Governor on the address of two
thirds of both branches of the General Assembly ‘or t hat
purpose, or by impeachment and conviction thereon.
Said shall have no original jurisdiction, and its juris
die ion shall extend ->nly to the t ial, hearing and correc
tion of e-rors in alleases in law and equity that may bebrough!
before it from the Superior ourls, or irom any other Courts
having final jurisdiction of the cau-etobe carried up, and
the mode and manner Os bringing sue;* cases before the Su
preme Court.and *f proceeding in said Court, shul! be pre
scribed by law, and the place or places, and the times of
hoiding said Cou*t. shall be fixed and determined bylaw, ami

cases respecting the titles to real estate which eha:l be tried

have jurisdiction over all other civil cases iu law, when the
amount in controversy exceeds the sum of thirty dollars
and exclusive jurisdiction in equity cases, < eich shall be tried
in the county where the defendant relid* g, or where there
are more defendants iban one, in a comity where someone- ot
the defendants resides, under such rules and regulations ar
may be prescribed by law Baid Superior Courts shall also

It shall be awfu! for the Legislature to organize Criminal
Courts in any of the count.es or cities in this Btate. and to vest
the whole or any pari of the criminal jurisdi lion of the coun
ties in which such Courts may be established, in such Courts,
under such rules and regulations as the Legislature may pre
scribe.
The Justices Courts shall have jurisdiction in their respec
tive Districts in ad matters of debt and account, when the
amount in controversy and esnot exceed the sum oi thirty dol
lars.
The Legislature may at auy time provide for a County At
torney many county, to be elected l*y the citizens of the ;
county, qualified to vote for membersof the General .tfssem- |
bly, amt wh - shail hold his office for the term of touryears ;
and until his successor is elected and qualified, and whose j
duty it shall be to prosecute all offenders in the county |

AN ACTtoal.er and amend the twelfth section of the First {
Article of the Constitution of this state.
Section Ist. Be it enacted by the Senate and House of hep
resentatives of Ike State of Georgia in General asentbly met ,
and it is hereby enacted by the authority of tfie same , That so
soon as this bill shall be passed by the General Assembly
agreeable to the requirements of the Constitution, the tollo v.
ing sec-ion shall be adopted in lieu oi the tweltth section of
the first article of the Constitutions
The meeting of the General Assembly shall be annual: and
on the first Wednesday in November until &ueh day of meet
ing shall be altered oy law. A majority of each branch shall be
authorized to proceed to business; but a smaller number may
adjourn from day to day, and compel the attendance of their
members m such manner as each House shall preset ibe: but
no session otthe General Assembly shall continue more than
forty days, unless the same shall be done by a vote of tv/o
thirds of both branches of the General Assembly—the vote to
be taken jy yeas and nays. The compensation of ti e mem
bers and officers ot the General Assembly shall be fixed by

j of order, and any negro of ordinary capacity is competent
to use it. One harvester with proper care will last a series
of years.
