GEORGIA. 1 By his Excellency ] A M E S JACKSON, Governor and Commander in Chief of the Army and Naw of this State, and of the Militia thereof. A PROCLAMATION. WHRPEAS in and by an aft of this Rate, entitled, an a£l to oblige vcffels, and perfons coming fiom places in fefted with epidemic didempers, to perform quarantine, und to prevent the bringing into and Spreading malignant and conta gious’ diforders in this Rate,” paffed December the 13th, 1793, it is enafted, %t that the quaran tine of any perfon, or vcffel, which is required, in and by the (aid aft coming from places in fe6icd v/ith the plague, or other malignant dilorder, fhall be of fuch duration, and in fuch pla ces, and under fuch regulations, as (hall be devifed and held ex pedient, fo far as refpefts the arrival of velfels ; or peifons in Tybce, and Wafl'aw inlets, and divers thereof, under the infpec tion of the corporation of Savan nah, and fo far as refpefts other inlets, and rivers, in this Rate, under (he infpeftion of the juf ticcs of the county, or commif fioners of the town adjacent to luch inlet, or river, or commif boners of pilotage of fuch port, as the cafe may happen, and fuch corporation juftices or commif boneiSj are hereby fully author ised to fix fuch centinels and guard boats, and to ufe all and every means in their power, to enforce this law, for the purpo ses intended.” And it is farther enabled in and by the faid law', that the pilot, or pilots belong ing to the feveral ports of this Rate, do, before his, or their entering on board any ftup or Veilel dcllined for this Rate, make Riift enquiry of every mailer or commander of the fame, whether the plague, fmall pox, malignant fever, or other contagious diforder, be in fuch fliips or vcffels. And in cafe fuch pilot, or pilots, fhall, upon enquiry, find that the plague, fmall pox malignant fever, or other contagious diforder, be in fuch fh'p or velfel, fuch pilot dr pilots, are forbidden from crater ing therein, on any pretence whatsoever. And it is alfo enabled , To be the duty of the corporation, jußiccs, or others therein em powered, after notifying to the people of the diflrift they live in, of the nece(Tity of ordering quarantine to be performed, forthwith to tranfmit by exprefs, or poll an exaft account, and Rafemcnf thereof to the Gover nor and Commander in Chief for the time being, who is di refted to publifh the lame by proclamation, enjoining and re quiring a due obedience to the regulations for preventing con tag’ us d’Renipe»s being fpread in this Rate, And whereas , information has reached the •' xecufive Depart ment, that ne epidemic and contagious dilorder, the fmall pox has introduced by Wi-ter int< the city of Savannah, in emion of the (aid law, and where, from inoculation, it h faid to have become general. and from thence to have spread over, 01 to have been earned into the adjacent country, of the counties of C hatham and Bryan; which if true, had the corpora tion and pilots of Savannah done their duty, the diforder, would not at firft have been in troduced,or permitted to fpread; or on notification to the Gover nor, which he has never yet officially received from the cor poration, would have been con fined (after being introduced) to the city alone. And whereaSy I am informed that the laid difoider Rill con tinues to Iprcad, and increafe, and is likely to become general throughout the Rate, at a mo ment, when the fun is almoß vertical, and the hooping cough and fevers prevail, whereby ma ny lives will be endangered, and fromthe numbers of perfons in the weßern parts of the Rate, as well free as flaves, who have never bad the fmall pox. the crops may be at great hazard and lifk, by the lols of their la bor, which will become a public as well as private calamity. And whereas , It is in and by the a6t afore-recited further de claicd, that, whenever the gover nor and commander in chief for the time being, fhall find it nc ceffaiy to give any orders or di redlionsfor preventing any con tagious diftemper from being brought into this Rare, or from any part of the Rate infefted therewith, into any uninfefted part of this Rate, by perfons tra veiling by land or water, it fhall, and may be lawful for the faid governor or commander in chief, by proclamation for that purpofc to he iffued, to prohibit all, and every perfon, and perfons, com ing from fuch inleftcd place, or places, to enter into, or come within luch bounds, limits or lines, as fhall be in fuch procla mation. deferibed, for and dur ing fuch time, as fhall be there in mentioned, and to appoint boats, and centinels, to put the fame in due execution, and the perfons appointed, and every of them, ilrall have the fame power to compel anv perfon, attempting to pafs through, or within fuch bounds, limits, or lines, to return as by the laid aft, is given to the perfons, 10 be appointed to fee the quaran tine, duly performed, and fhall be liable to the fame penalties J for fuffering perfons to pafs within or through the fame. And all and eveiy perfon or perfons, willfully pafhng thro' or within the laid bounds, limits or lines, Ihdll be liable to the fine, or impufonment, in the laid aft pointed out, in cafe of peifons quitting any fhip, veflel or boat, performing quarantine, which is a fine of fifty pounds, on conviftion, before any one jußice of the peace, living near the place where the offence fhall be committed, and thice free holders fworn to try the ti uth pf the charge ; and in default of payment of fuch fine, to be im priloned in one of the public jails of this Rate, for any time not exceeding twelve, nor Ids than fix months. 1 have therefore , c(modera tion of the afi T : r circum fiances, and in purfua.ice oi ihe authority and power in me by the laid a6l veiled, thought fit to iHue this rny proclamation, pro hibiting and interdi&ing, all, and every perfon and perfons, (poll riders and public expreffes only excepted) from coming without the boundary lines of the counties of Chatham, and Bryan, info any other county or counties of this (late, or coming in boats further up Savannah River, than where Knox’s Creek empties into the fame ; the faid Creek being near the boundary line between Chatham and Effingham counties; or further up the Ogechee River than where the faid boundaiy line between Effingham and Chat ham (ball flrike the fame. And For the due ohlervanct of, and obedience to this prohi bition and interdiction, 1 do hereby nominate and appoint, thejuliices of the inferior courts of the counties of Eflingham, Bullock and Liberty, in con junction with the refpeClive commanding officers of the mi litia of the faid counties for the time being, to be the perfons appointed, hereby requiring and commanding them lo cany this pioclamation into execution, as they will be liable to the penal ties provided by the faid ail, in cafe of negledl or rcfufal, and for that purpofc do give them full power and authority, to hire or employ fuch boats as guard boats, and to call out fuch num ber of militia to man them as well as to a6l as ccnrincls, as to them may appear neccflary — Provided , that in Effingham they fhall not exceed two boats—one for Savannah and one for Cgechec rivers ; and one fubal tern, one ferjeanf, two corporals, and twenty privates—for the county of Bullock, one lerjieant, one corporal, and twelve pri vates —and for Liberty, two boats, one hibaltern,one ferjeant two corporals, and twenty pii vates, the expences of which, as well as the pay and fubiiftcncc of the men, fhall be defrayed, as by law exprefied out of the con tingent fund. —Arid I do'herehy notify to all perfons concerned , 1 hat the faid prohibition and interdic tion, fhall be and continue in full force, until further orders and directions to the contrary fhall be ifTucd by me ; of which due notice will be given. And I do hereby further dir eft and order , That the pofl riders and public expreffes do fhift their doathes at lome conve nient place, near and as clofe lo the limits and bounds herein prelcribed as pottible, both in going to and returning from the faid counties of Chatham and Bryan. And I do hereby for bid their bringing any parcels, boxes, phials, or packages of any kind or nature whatloever, (the public mail or exprefs only excepted) from without the limits of Chatham and Bry an counties into any other coun ty. And I do recommend to the different pofl matters within this bate, to fumigate with brimttone the letters, papers and packages, the refpe£live mails anay contain immediately after the mails are opened.
