Caldwell, riq. attorney for the heirs and rcprcfcntativcs of Robert Cooper, de ceafed, tor the eftablinuncnt ot the fol lowing papers, which were loft in the time of the late war, to wit ; one paper bond, commonly called a penal bond, made payable to Robert Cooper, de ceafed, and figned by Robert Hamilton, for the fum of fiiiy pounds ftcrliog money of the then province, now ftatc of Georgia, dated 11 b of December 1772, and due the ift September 1773. A fo < nr- other paper commonly called a promiifory note, figned by Robert Hamilton, and made payable to Robert Cooper, or his heirs tor the fum of ten pounds ftcrliog money of the then p 0- vincc now ftate of Georgia, for vaiue received da cd 11 rh December, 1772, and due 21 >h December, 1773. And it appearing to the court by fuf ficient affidavits, that the original papers were loft in the time of the late war, and that copies or as near as may be of the originals fo loft or deftroyed as aforefsid are filed id the clerk’s office. It is therefore ordered that the lame be publilhcd fix months in one of the gaz* cues of this Hate, together with ibis order, and that unlrls good canfe be ffiewn to the contrary within the faid fix muni l a, the aforefsid copies of the aforefaid original papers, loft as aforc faid, (hall be thereafter deemed and confidercd as the originals, and to have the fame lorcc and died both in law and equity, aa the original papers or obligations could have had—-provided they ffiould not have been loft or deftroy ed as aforefaid.
