We cannot with safety to life, liberty
•and happiness, dispense with cither ;
and hence the great importance that
each should be kept moving in their
appointed spheres, that there shall I e
uo friction—no infiingcment by the

should both discharge the sacred

These remarks have been suggested
by die fact that tbero have Loon two re
cent inMarces in this State, of Judges
who iniimudvcited with ecvereity upon
the verdict of a jury in their C. urt as
nt semis to us in violation of the tights
ol' those bodies.
The first instance was in the trial of
a civil case, where the Judge c n his
own motion set aside the verdict of the
juty and giantcd, without hearing by
couiircI, a new trial—at the same or¬
dering the jury discharged for there-*
rn iinderof Ids judicial tenn. The oth¬
er was in the case of Cossart, tiio-1 a
few days since in At'anta, wherein the
Judge'handled the jury without gloves’
for acquitting th t accused, remarking
that the ‘verdict unexplained would be
a license io crime, and that in his opin¬
ion it was unwarranted by any princi¬
ple of law or any fact known to hiui.'
The question raised by those instan¬
ces is this, bow fat are the learned gen.
•demon who occupy the bench author¬
ized to go in criticising the verdicts ol
juries in their Courts? Is such criti
ctftn wise or proper, or consistent with
that weight of authority which should
unifot mly ut'ne'i to the conclusions of
twelve impartial men who are put tin¬
der the sanction of an oath, and against
whom is neither proof nor suspicion ol
corruption ? Is not ;Ueh criticism cal¬
culated to impair the entire jury system
and to nullify its power for gool by
subotdiuatiiig all verdicts after all to
the judgment of tbo beneb ?
We have always felt that while the
Judgo was entitled to respect as the
authorize I expounder of law, so ate the
jury, and to an equal extent in theii
finding* of facts. Each Leing human,
are liable to mi-fakes, but neither
show'll be discaidcd because thev some

because their verdict is not always in
accord with the opinion of the Judge,
flic attainment of truth, with a view
to doing impartial justice is tbe ol jeci
of all legal inquiry, and the wisdom

conclusion, that these objects are more
nearly attainable in a Court composed
of a Judgo to prouounce the law, and
an impartial jury to find the facts.—
