SAVANNAH , August 14, 1806- — 4b -5* <::*— On Tuesday a Diftritl Court was held in this city by the honorable William Ste phens, Diftrtcl Judge. A motion was made to qualh an information qui lam filed by Nicholas Newell, com mander of the Revenue Cut ter, against three of the Pilots, for refilling the said comman der in the execution of his du ly. Various grounds were urged by the Coup lei for the dejndants in the fuppott cf the motion, one of which was, that information, as a mode of profecuuon was contrary to th® conftmnion of the Uni ted States, as well as the geni us and I pint of our govern ment. — It was urged by the attorney for Mr, Newell, that a motion to q taffi an infonna tio i was irregular and that the defendants, according to the practice of the Courts, ought to plead or demur. The Court decided that the motion wasir. regular, and directed (he de fendants counsel to pie id or demur; the demurrer was filed inltantly, and iu(tamed by the Court ; the judge observing that the mode of prosecuting by information favoured too much of the tyranny of the Star chamber, to be compati ble with the principles of our government or the Conftitua non. —-1 he attorney for Mr. Newel! was directed however, to amend his writ, and the ck fendants to plead —so that this ce!e will be brought on again at the next Term of the DT ti ict Court.
