At the Circuit Court of the United
States now sitting here, Mr. Justice
Livingston has decided an important
queston relative to the power ol the
.Secretary of the Treasury to remit
forfeitures and penalties under the
revenue laws. The suit was brought
by the Custom House officers of Yurt
land, in the Distnct of Maine, against
the Marshal ol the Southern District,
of New-York, to try the question
whether the Secretary has authority
to remit, in a seizure under the re
venue laws, or other laws of trade, a
final sentence of condemnation, so a;
to affect the moiety of the forfeiture
to which the Custom House officers,
&c. are entit'ed in such case*. The
cause was argued by Ilojfman and
Wheaton lor the plaintiff?, and uv Em
mett at.d Wells for the defendant.—
The Court determined that the Secre
tary had a right to grant a remissi >11,
*0 hh toilivest the shaic of the Cus
10m House officers, before or after con
demnation, and gave judgment for
•he defendant. We understand that
Judge Story has delivered a contraty
opinion in his circuit, and that the case
just decided by Judge Livingston wilt
be carried to the Siqflenie Court Ibr-
tinal determination.

very moment when the highly respect

May not their sudden departure
be attributed to the tact of their hav
ing been sent out on a political er
rand, to ascertain the state of tiling*
in Cuba, and the chances of that is
land becoming revolutionary? May
not the short answer of the Admiralty
to the communication from Lloyd’s
p' acecd from an unwillingness to be
interrogated, when they did not choose
to communicate ?
It is rumoured and believed, that a
strong desire, exists in Cuba to declare
itsell independent, under the auspices
of Ihe United States. It is turthei
said, that overtures to this effect will
n all probability be soon submitted

Jit tempt at Suicide—A stranger
whose name is ascertained'to be Hunt,
came to this place front New York,
one day last week, and put up at the
house of a distant relative about two
miles from the village. On the fol
lowing day he came to the village and
procured a razor. On his return to
ward* evening he stopped at the house
of a Mr. Lockwood, about one mile
from the village, and enquired the way
to the house of his relation A lad wa»
sent to conduct him thither. Alter
accompanying him a good part of the
way, the lad returned home; and in a
time the Stranger returned nl?o.

L. where, as it had become late in the
evening, and the night being da k, he

family went to call him. lie replied
that he would get up directly. In a
short time a noise was heard in the
room where he had lodged, on enter
ing which he was found bleeding pro
fusely, having cot his throat almost
from ear to car. He asked lor paper,
with which he was furnished, and upon
which, (while Mr. L. was procuimg
Ihe attendance of a Surgeon,) he wrote
with a pencil as follows*—
•'I am as sens'ble as ever I was—f
have been a little iusaue ever stuce I
lost ir.y dear wife. .
“I am sorry that it happened in
your house, but 1 was warned of it
along time ago that l most kill myself

the razor; the ignus fatuus, or false
light, led me to your house last night

Two Surgeons soon after attended,
who found that his horrid purpose had
not been fullr accomplished; the
wind pipe not having been cut quite
through. His wound was dressed, and
although a bad one, there is a slender
probability that he may recover.
Highland Fidelity.—The generous
self-devotion ol Roderick Mackenzie
lias been often recited. This Young
man, who had sought concealment a-
mong the fountains of Rosshire, after
tha bat'.le if Cclladen, was surprized
by a psrtylofsoldiers sent in pursuit

gure, his air, deceived the military so
completely, that they were going to
secure him, in the belief that they had
got hold of the prince. Mackenzie
perepived their mistake, and wilt, great
lortitude and presence of mind, in
stantly resolved to render it u-eful to
his master. He drew Ins aw.ud; and
the courage, with which he defended
tumselt, satisfied these soldiers that
he could lie no athcr than the preten
der. One of them fired at him ; Mu-
krn/ie fell, and with his last breath
exclaimed, •* You have killed your
prince !*’ This generous sacrifice
suspended for tke time all pursuit, and
afl'iided an opportunity to the unfor
tunate Charleij to escape from th.
hand* of his enemies. It is wet
known, that Kennedy, who frequent
ly exposed his life to save that of the
prince just named, and who, though
mean and.poor, despised the reward
of $80,000 which was offered lor the
person, dead or alive, ol the royal fu
gitive, was af erwards hanged at. In
verness for stealing a cow. A little
before his execution, he pulled off bit
bonnet, and rendered hearty thank!
to God for that " he had never prated
