AN ACT TO ESTABLISH A UNIFORM SYSTEM
OF BANKRUPTCY THROUGHOUT THE
UNITED STATES.
Fe it enacted by the Senate and House ef Represcn.

trie bled. That there be, and hereby is, established through
out the l. nited States a uniform system of bankruptcy, as
follows : All persons whatsoever, residing in any State, Dis
trict. or Territory of the United States, owing debts, which
shall not hav£ been created in cousequence of a defalcation
as a public officer, or as an executor, administrator, guar-
dian, or trustee, or while acting in any other fiduciary capr-
city, who shall, by petition, setting forth, to the best of his
knowledge and belief, a list of his nr their creditors, their
respective places of residence, and th# amount due to ojeb,
together with an accurate inventory of his or their property.
I rights, ami credits, of every name, kind, ami description, 3t
| the location and situation of each and every parcel and por-
L tion thereof, verified by oath, or, if conscientiously scrupu
lous of taking an oath, by solemn athruistion, apply to the
proper court, as hereinafter mentioned, for the benefit of
this act, and therein declare themselves to be unable to meet
their debts and engagements, shall be deemed bankrupt*
within the purvievt of this act, aud may bo so declared ac-
cordingly by a decree of such court. Ail persons being
merchants, or using the trade of merchandise, all retailers
°t mercliandise, and all bankers, factors, brokers, underwri
ters, or marine insurers, owing debts to the amount of not
less than two thousand dollars, shall be liable to heroine
bankrupts within the true intent ami meaning of this aft, A
may, upon the petition «t one or more of their creditors, to
whom they owe debts amounting in the whole to not less
than five hun iteJ dollars, to the appropri itecourt.be so de
clared accordingly, in the following cases, to wit: whenever
such person, being a merchant, or actually using the trade
of merchandise, or being a retailer of merchandise, or Icing

Provided, That all dealing and transactions by and with

court in every district shall have jurisdiction in all matter*
and proceedings iu bankruptcy arising under this act and
any other act which may hereafter be passed on the sub
ject of bankruptcy, tbe said jurisdiction to be exercised
summarily, in tke nature of summary proceedings in equit\;
and for this purpose tha said district court shall be deemed
always open. .Aud the district Judge may adjourn any
point or question arising in any case in baakruplcv into the
circuit court for the district, in his discretion, to be thfcr*
beard and determined, and for this purpose the circuit court
of such district shall ba deemed always open. And the
jurisdiction hereby conferred oh the district court shall tt*
tend to all cases and controversies in bankruptcies, arising
between the bankrupt and any creditor or creditors who
shall claim any debt or demand under tbe bankruptcy, to
all cases and controversies between such creditor or credl
tors and the assigns* of the estate, whether in office or re
moved; to all casus and controversies between such assigned
distribution and settlement of the estate of the bankrupt,
and the close of the proceedings in bankiuptcy. And Uta
•aid courts shall have foil authority and jurisdiction to com
pel obedience to all orders and decrees passod by thapi in
bankruptcy, by process of cjotempt aud other remedial pro
cess, tn tke same, extent thu circuit courts may now do in

the duty of the said courts to make them as simple and
brief as practicable to tbe end to avoid all unnecessary ex-
