from the house lately occupied by Hamilton & Reynolds,
1'ithe tVarr-llonw adjoining, lately occupied by Winn
& Rogers, where they are prepared to receive Cotton aud
Merchandize. This house is put in good repair, and is os
safe as the other from fire, and they regret that in their cir
cular they designated Hamilton Sc Reynold's Ware-House
ns the ope to be occupied by them,, btlt trust this notice will
reach their friends in time to prevent mistakes in the deli
very of Cotton. They feel it their duty to state the follow
ing circumstances: in July last they leased of the proprie
tors the first named property—took possession, and expect
ed to occupy it throughout the season. Early in August an
execution against the owners wai levied on it, and on Tues
day last it was sold by the sheriff, and notwithstanding the
subscribers bid liberally lor it, they weje outbid by a com
pany—who is now in possession.

Whereas, the third section of the fii^t art cie of die Con
stitution of this State declares that the Senate shall be e-
lected bienn ally, on the first Monday in November, un
til such day of election be altered by law; and 6hall be
composed of one member from each county., to be chosen
by the electors thereof:
And Whereas, the seventh section of the first article of
the Constitution of this Sta e declares, that the House of
Representatives shall be composed of members from all
the counties which new are or hereafter may be inclu
ded within this State, according to their respective num
ber of free white persons, at l including three-fi«ths of the
people ofcolor; the actual enumeration shall be made
within two years, ami w ithin every subsequent term of
seven years thereafter, at such time anti in such manner
as this convention may direct. Each county containing
three thousand persons, agreeably to the foregoing plan
of enumeration, shall be entitled to tu o members; seven
thousand, to three members' •md twelve thousand to four
members; but et.ch county shall lievfc a: least one. and
not more than four members; the representatives shall be
chosen annua'lv on the tirn Monday in November, until
such day of election he altered by law. L’ntil the afore
said enumeration shall be made, the several counties
shall be entitled to the following number of representa
tives, respectfully :—Camden, 2; Glynn, 2; Liberty, 3;
MeIitosh. 2; Bryan, 1; Chatham 4; Effingham, 2; Stri
ven.2; Montgomery, 2; Burke,3; B llloch, 1; Jefferson,
3; Lincoln, 2; Elbert, 3; Jackson, 2; Richmond, 3s
Wilkes, 4; Columbia. 0; Warren, 3; Washington, 3;

—to the end, therefore, that said sections may be altered:
Section 1. Be it enacted by the Senate and House
of Representatives of the State of Georgia, in General
Assembly met, and it is hereby enacted 6y the authority
of the same. That as soon as this bill shall be passed, agree
ably to the requirements of Constitution, the following shall
be adopted in lieu of the sections above recited to wit: in
lieu of the third section of the first article of the Constitu
tion aforesaid, the Senate shall be elected biennially on th«
first Monday in October, and shall consist of forty-seven
members, and sli^i^be composed of one member from each
senatorial district*which district shall be composed of two
contignous counties, not including the county w ith the lar
gest reptesentative population, which shall constitute a se
parate district; which district shall be arranged and organi
zed by the General Assembly, at the session when this shall
be adopted, and if any new county ehall be hereafter for
ined, it shall be annexed to one of the districts from which
it was taken; and that in lieu of the seventh section of the
first article of the Constitution, the following shall be otiop
ted: the House ofirepresentatives shall be composed of one
hundred and thirty members; enuh county shall have one
Representative, and no county shall have more than two-
Representative, thirty seven counties having the grentest
population , counting all free white persons, and three-fifths
of the people of color, shall have tw'<r-Kepresentatives; the
said apportionment shall be made by the General Assembly
•t the session at which this section shall be adopted as nn
alteration of the Constitution, by an act to be introduced af- »
ter the adoption thereof, and anew appointment shall fco
made at the session next after each future enumeration of
the inhabitants of tliis State, made under the Constitution
and laws thereof, but at no other time.

the Constitution of this State, so far es to authorize the
people to elect the General Militia officers of this State.
Section 1. Be it enacted by the Senate and House of
Representatives of the State of Georgia, in General
Assembly met, and it is hereby enacted hy the same, That
from and immediately after this act shall have parsed in
conformity with thtf Constitution of this State, it shall anti
may be lawful for all Major Generals, and Brigadier Gene
rals, to be elected by t he people ol the respective Division
Brigades, and all persons subject to do militia duty, 6ha .
be entitled to vote for the same only.
Sec. 2. And be it further enacted by the authority
aforesaid, That all laws and parts of laws, militating a
ainst this act, be and the same are hereby repealed.

Whereas, the above section amongst other things, provi
des that in case ofjoint obligors, or joint proimsso. s, re
siding in different counties the suit may be brought in
either county, and a eopy of the petition and process, ser
ved on the party residing out of the county, in which the
suit may be commenced, shall be deemed sufficientservice
under such rules and regulations as the Legislature hayo
or may direct:
And Whereas, by the existing laws of this State, the ma
ker and indorsers of promissory notes, residing in the
same county, may be sued together in the same action,
but when they reside in different counties, it has beer ru
led by the courts, that they cannot be joined upon the
ground that they are not joint obi igors, nor joint premia*
6ors, in the sense and meaning of the above recited clause
of the Constitution, and therefore in such cases, nanies
are compelled to bring separate actions at a great increase
•f costs and expea ’es, both to the plaintiff' and defendants:
And Whereas, the said first section of the third a’-ticl*
requires amendment:
Be it enacted by the Senate and House of Representa
tives of the State of Georgia, in General Assembly met,
and it is hereby enacted by the authot ity of the same,
That so soon as this act shall have passed agreeably fo the
requisitions of the Constitution, the following shall form a
part of the said first section, of the third article nf the Con
stitution of this State, an 1 to be inserted therein immediate
ly after the clause above recited,to wit And in case of a
maker and indorser, or indorsers of promisory notes resi
ding in different counties in this State, the «?ame may be
sued in the county where the maker resides and a copy of.
the petition and process served on the indorser.or indor
sers, residing out of the county, in which the suit may be
commenced, shall be deemed suffi dent service under the
