safe as the other from fire, and thiv regret that in their cir
cular they designated Hamilton & ’Reynold's Ware-House
as the one to be occupied by them, but trust this notice will
reach their friends in time to prevent mistakes in die deli
very of Cotton. They feel it their duly to state the follow
ing circumstances: in July last they leased of the proprie
tors tile first named property—took possession, aud expect
ed to occupy it throughout the season. Early in August an
execution against the owners was levied on it, and on Tues
day last it was sold bv the sheriff, and notwithstanding the
subscribers bid liberally for it, they were out bid by a com
pany—who is now in possession.

from aha immediately after this act shall have passed in
conformity with the Constitution of this State, it shall and
may be lawful for all Major Generals, and Brigadiei Gene
rals, to be elected by the people o.‘ tbe respective Division
nr Brigades, and oil persons subject to do militia duty, *ha .

Bec. 2. And be it further enacted by the authority
aforesaid, That all laws and parts of laws, militating a

aidihff in different counties, the suit may bo brought in
either county, and a copy of the petition and process, ser»
ved on the party residing out of the county, in which tho
suit may be commenced, shall be deemed sufficientservic*
under such rules and regulations as tho Legislature have
or may direct:
And Where is, by tho existing laws of this State, the ma*
kcr end indorsers of promissory notes, residing in thtf*
same county,may be sued together in the same action,
but when they re ide in dif.ercn: counties, it has been ru»
led by the courts, that they cannot bo joined upon the
ground that they are not joint obligors, nor joint premia*
eors, in the sense and meaning of the above recited clause
of the Constitution, nnd therefore ia such cases, parties
or'* compelled to bring separate actions at a great increase
•f costs and expos' >e c . both to the plaintiff and defendants:
