CONSTITUTION.
4 N ACT to alter and change the third and seventh sec*
£\. tions of the first article ot the Constitution.
WHEREAS, the third section ot'tlie first article of the Con
stitution of this State declares, that the Senate shall be e-
leeted biennially, on the first Monday in November, un
til such day of election be altered by law; nnd shall le
composed of one member from each county, to be chosen
by the electors thereof:
And Where vs, the seventh section of the first article of
the Constitution ef’this State declares, that the House of
^Representatives shall be composed of members from a it
the counties which now are. or hereafter may be inclu
ded within tin’s State, according to their respective num
ber of free white persons, and including: three-fifths oi th«
people of color; the actual enumeration shall be made
vrithin two years, and within every subsequent term of
seven years thereafter, at such time and in such manner
as this convention may direct. Each county containing
three thousand persons, agreeably to tlie foregoing* plan
of enumeration, shall be entitled to two members; sev^ti
( thousand, to three members: und twelve thousand to Jour
| members; hutench county shall have at least one, and.

the Constitution of this State, so far ns to authorize the
people to elect tlie General Militia officers of this State.

Representatives of the Stale of Georgia, in General
Assembly met, and it is hereby enacted by the same, That
from and immediately after this act shall have passed in
conformity with the Constitution of this State, it shall and
may be lawful for nil Major Generals, and Brigadier Gene
rals, to be elected by »lie people ol tlie respective Divisions
or Brigades, and all persons subject to do militia duty, shall
be entitled to vote for the same only.
Sec. 2. Amllc it further enacted by the authority
aforesaid. That all laws and parts of laws, militating a-
gainst this act, be ami the same are herebv repealed.

AN AC T to be entitled an act to amend the first section #f
the third Article of the Constitution of this State.
Whereas, the above section amongst other things, provi
des that in case ofjoint obligors, or joint promissors, re
siding in different counties tbe suit may be brought in
either county, and a copy of the petition and proi-e^s, ser
ved on the party residing out of the county, in which the
suit may be commenced, shall be deemed sufficient service
under such rules and regulations as the Legislature have
or may direct:
AND Whereas, by the existing laws of this State, the ma
ker and indorsers of promissory notes, residing in the
same county, may be sued together in the same action,
but when they reside in different counties, it has been ru
led by the courts, that they cannot be joined upon tlie
ground that they are not joint obligors, nor joint nromis-
sors, in the sense and meaning of the above recited clause
of the Constitution, and therefore in such cases, parties
are compelled to bring separate actions at a greaiincrease
cf costs and expenses, both to the plaintiff and defendants:
And Whereas, the said first Section of the third article
requires amendment:
