CLEVELAND'S MESSAGE.

companies which have received land
jrrants. and the guaranty of the public in aid of
lie construction of their roads should receive
early attention. The report of a majority of
the commissioners appointed to examine the
affairs and indebtedness of these roads, in
which they favor an extention of the time for
the payment of such indebtedness in at least
one case where the corporation ap
pears to he able to comply
with the well-guarded and exact terms
of such extension, and the indorsement of
their opinion by gentlemen of undoubted busi
ness judgment and experience, appointed to
protect the interests of the government as
directors of said corporation, may well lead to
the l>clief that such an extension would be to
the advantage of the government. The subject
should be treated as a business proposition with
a view to a final realization of its indebtedness
by the government, rather than as a question
to be decided upon prejudice or by way of pun
ishment for previous wrong doing.
District of Columbia.
The report of the commissioners of the Dis
trict of Columbia—with its accompanying doc
uments—gives in detail the operations of the
several departments of the district government
and furnishes evidence that the financial affairs
of the district are at present in such a satisfac
tory condition as to justify the comm s doners
in submitting to the congress estimates for de
sirable and needed improvements. The commis
sioners recommend certain legislation which,
,n their opinion, is necessary to
advance the interests . of the district.
I invite your special attention to their request
ior such legislation as will enable the commis
sioners without delay to collect, digest and
properly arrange the laws by which the district
s governed, and which arc now embraced in
several collections, making them available only
with great difficulty and labor. The sugge
tions they make touching desirable amendments
to the laws relating to licenses granted for car
rying on tfco retail traffic* in spirituous liquors,
to the observance of Sunday, to the proper as
sessment and collection of taxes, to the speedy
punishment of minor offenders, and to the man
agement and control of the reforma
tory and charitable institutions supported
by congressional appropriations, ore com
mended to careful consideration, I
again call attention to the present inconven
ience and th“ danger of life and property.attend
mg to the operation of steam rai roads through
and across the public streets and roads of the
district. The propriety of such legislation as
’ ill properly guard the use of these rail
mads, and bettor secure the convenience
sod safety ot citizens, is manifest.
Closing Words.
The consciousness that I have presented but
an imperfect statement of the condition of our
country and its wants occasions no fear that
anything omitted is not known and appreciated
by*the congress, upon whom rests the responsi
bility of iii elligeat legislation in b a baff of a
fcreat nation and a confiding people. As public
servants we shall do our duty well if we con
stantly guard the rectitude of our intention,
maintain unsullied our love of country and with
unselfish purpose strive for the public good.

ON'H THOUSAND DEFENDANTS.
A Curious Suit Involving: the Bight
to a Part of Kansas City.
Kansas City, Mo., Dec. 2.— Mrs. Millie
N. Alien, an aged lady, fell down a flight
of stairs at her home m Lebanon, Ky.,
Nov. 14, and received injuries
which resulted in her death. Mrs. Allen
was at one tirao a resideut of Kansas City,
and her death recalls and bears strongly
upon one of the most important and com
plicated law-suits ever tiled in the federal
court of this district.
In 1857 William B. Aden, husband of the
dead woman, and William P. McElroy, two
young Kentuckians, bought of James .John
son a tract of land, afterward known as Mc-
Elroy’s subdivision, and now in the heart
of the city. For it ihev paid SIO,OOO. of
which $3,000 was in cash, and $7,00J iu
joint notes o i 'ss,suo each, secured by mort
gages. In due course oi time Allen paid oft’
his note, but McElroy never paid bis. A
fevvs years later Allen purchased of McEl
roy his undivided half and received from
the latter a warranty deed. In 1867 John
son attempted to foreclose the mortgage
held against McElroy. and the property
was bought under the foreclosure by Mc-
Elroy.
Thus matters stood until after Allen’s
death, but in 1884 G. F. Baliiigal. J. S.
Bo sford and M. T. C. Williams, attorneys,
brought suit in the federal conn for Mrs.
Allen to redeem the property and to secure
her dower interest. Their legal claims were
first, that the waiTeiity deed given Allen
by McElroy at the ti ne of the form r\s
purchase guaranteed him from lo'-a by a
mortgag ; for which McElroy was respon
sible. ami, second, that the procedure in the
matter of the foreclosure was irregular, and
again that the origin* 1 mortgages given
Johnson veto defective iu that they did not
hoar Mrs. Allen's signature. The suit was
brodfcht against I)an oak er, Wilson, Brigham
and others, 500 persons iu all, thou being m
possession of the property in litigation. It
required fully throe years to ge f service on
t -*-great, number of defendants, and the
case v. as sot for a hearing at the coming
March term of the fedora 1 court.
In the mean time a cloud hid been ca>t
upon the title of the property in question,
end Mr. VV. S. Wilson of this city, a grand
so.i oi Mr. Allen, with the power of attor
ney from the heirs, has sold quit-claim
deeds, by which clear titles were secured to
about half the property, at from $3 to $lO
I*r front foot. The question now arises as
to the effect Mrs. Allen’s death will have
upon the suit.
The property i6 now worth more than
$2,000,000, and* is owned by perhaps 1,000
persons.
