TO FIGHT THE RECEIVERSHIP.
Judge Falligant’s Order in the Not
tingham Case to Be Appealed From.
An order was granted in the superior
court by Judge Falligant yesterday, on a
showing made by Solomons & Cos. and
others, appointing J. E. Harty, who is
with that firm, permanent receiver of the
stock and assets of K. V. Nottingham &
Co's, store, under a bond for $4,000, and a
restraining order was granted, placing all
t lie property and assets of the firm in the
hands of Receiver Harty.
The store was closed under an execu
tion issued in favor of W. J. Dodd to
satisfy a judgment for SI,OOO on a note
taken m the city court, and Sheriff of City
Court W. F. Blois, was appointed tempor
ary receiver and the property taken in
charge by him. He lias now been or
dered to turn it all over to the receiver
appointed yesterday, under the bill
brought by Solomons & Cos. The stock is
valued in the bill at $2,000.
This receivership will be vigorously
protested by W. J. Dodd, ex-Reeeiver
Blois and others, ns there is a mortgage
cn the stock which is a prior lien to the
judgment held by Mr. Dodd. He has em
ployed Messrs. MeAlpin and Laßoche to
take the case to the supreme court as he
wishes to ward off the expenses of a re
ceivership. The expenses of the receiv
ership and the prior lien of
the mortgage would leave lit
tle to satisfy the judgment held
by Mr. Dodd as Mr. Nottingham has also
applied for a homestead from the prop
erty. Mr. Laßoche has drawn a bill of
exceptions to Judge Falligant's decision,
and will take the case to the supreme
court at onco.
An order was granted by Judge Falii
rant yesterday, making the Boyd-White
Furniture Company, of Philadelphia. H.
B. Clafiin & Cos., of New York, the Hall
Furniture Company, of Janesville, Wis.,
and other parties complainant to the hill
of the Lawpeneeburg Manufacturing
Company vs. the A. J. Miller Furniture
Company.
CITY BREVITIES.
Golden Rulo Dodge No. 12, I. O. O. F.,
meets to-night.
The Postal Telegraph Company has
opened an office in the cotton exchange,
an object which Manager Milton Orr has
been working to attain for many months.
The trolley pole of a car on the
Broughton and Habersham street line
slipped from the' u wire, last night about
midnight, at Hubersham and South
Bre.nl streets, and caught a telephone
w ire bringing it down upon the guard
w ires The current was partially diverted
and the car stopued. The accident inter
fered with the telephone service on one
circuit and in some way caused the lire
alarm bell to give a couple of strokes.
A runaway liorse on Drayton street
yesterday afternoon came near seriously
injuring Mrs. M. 1,. Boyd. The horse
came tearing down Drayton street from
the park with the front axles and
wheel' of a buggy clinging to him.
Mrs. Boyd was crossing Jones street.
As the runaway animal turned into
Jones the axle struck her, knocking her
down. She was picked up and walked
into a house near by, and was then taken
to her home on Liberty street. Her
injuries are not at all serious. The run
away after turning into Jones street
turned back into Drayton and run as far
as the Do Soto, where ho broke loose
from the buggy and was captured. The
buggy was a complete wreck. Mrs. Boyd
had a fortunate escape from a serious in
jury.

the dangers, and unpleasant surround
ings for ladies, during ‘ barrel fire time.”
Have the ladies no rights on Bull street,
south of Liberty, or do the two squares
belong to the boys alone? The little fire
cracker (or popper, i was bad enough, but
many ladies now, do not walk on Bull
street, as a cannon cracker exploded near
ones feet, is both unpleasant) and danger
ous; also, driving on Bull street
is next to impossible, and the danger
to young children is very great, in both
squares on Bull, south of Liberty—sleep
is impossible, until long after midnight,
night after night, and. as there are liable,
to be iuvalids at the Do Soto, nnd as the
rooms on Harris and Bull streets arc
much sotight by them, their rest, during
barrel fire time” must be anything but

IVEATHEK SYNOPSIS.
Tlte storm noted in Monday night's syn
opsis as central off tlte North Florida
coast, moved northward, and was central
this (Tucsfiay) morning off Hatteras.
After passing Hatteras, its course was
more to the northeastward, and at 8
o’clock to-night it was central some dis
tance off the'New England effast. Cloudi
ness continues along the North Caroline
coast, with snow falling along the imme
diate New England and Middle Atlantic
coast. Hatteras reports a maximum wind
velocity of 5(5 miles per hour, Norfolk 42,
and Wilmington 34 miles. The current
wind velocity at Boston to-night was 26
miles per hour.
The storm central in Minnesota Mon
day night has moved northeastward to
Ontario.
The chart to-night (Tuesday) indicates
a slight disturbance ‘developing itt tho
southwest.
The cold wave lias moved northwest
ward front the Western Gulf aud now cen
ters in Northern Georgia with slightly
diminished intensity. It is sligthly colder
in the vicinity of Augusta, in Middle and
Eastern North Carolina, along tlte South
Carolina coast, and along the immediate
New England and Middle Atlantic coasts.
An area of high pressure, central in the
extreme northwest, has caused the tem
perature to fall 14° to lli° in the upper
Mississippi valley. 6"' to ‘2o° in Nebraska,
10 J in Kansas, and 14° in North Dakota.
The temperature lias risen throughout
tlte lower lake region, in the Ohio valley
and Tennessee, and throughout the Gulf
states.
Generally clear weather prevails
throughout the. Mississippi valley, in Illi
nois, Indiana, Tennessee, throughout tlte

POLITICO IN WAYCEOSS
The Decrease in the Number of
Criminals Attracts Attention.
Wayoross, Ga., Dec 5.—A citizens’
mass meeting will be held in a few days
for the purpose of nominating city officers.
Municipal politics is the subject of much
discussion on the streets. The present
mayor and council will probably have
some opposition. The friends of Dr.
Frank C. Folks are in hopes that he will
be in the race. Mayor Knight will proba
bly consent to be a candidate for re-elec
tion. He lias filled the office for several
years and has worked for the advance
ment of the city.
DECiiEASE IN CRIME.
Tlte Ware county jail is empty. The
decrease in crime in the county is re
markable. The court records show but
one murder that was committed in the
county since Culpepper was murdered by
Elijah Cheavers in 1890. One lynching,
that of Chambers, which was done by a
mob front Wayne county in August, is the
oniy case of that kind known here in
several years

CAMP HAINES.
Camp Haines since the quarantine was
raised presents a deserted appearance.
Tlte tents and furniture are stowed away
itt the bulldittes. A carpenter is in
charge of the premises.
The terminus of the Way-cross Air Line
is at Sessons, Ga. The right-of-way has
been graded as far as Douglas.
The cotton crop of Ware county has
been harvested. The yield was not as
large as was expected.
C. B. Golding, an engineer, returned
last week from the Okefinokeo swamp,
where he killed ‘2l ducks, 1 turkey and 1
otter. He said that wild ducks were
plentiful. The water was rising in the
swamp.
Mr. John Million has two orange trees
in his yard which have yielded a quan
tity of large, delicious oranges. The
trees are of the Indian river variety, and
many ripe oranges are on them now.
DR. BRUNNER AT ATLANTA.
He is There to Oppose Representative
Mershon’s Board of Health Bill.
j Atlanta, Ga., Dec. s.—Health Officer
Brunner, of Savannah, reached Atlanta
to-day, and as a consequence of his
presence in this < ity there is lively
talk of trouble between him
and Representative Mershon, of
Glynn county. A week ago Judge
Mershon criticised Dr. Brunner
very severely in tho House in discussing
his state board of health bill. He charged
that Dr Brunner, instead of attending to
his own business, took it upop himself to
report to tlte marine hospital that there
as yellow fever at Brunswick, when
in fact, Brunswick had a, clean bill of
health. Judge Mershon further claimed
that in answer to this complaint Surgeon
Branham was sent to Brunswick and
brought with hint the fever. The effect
was to hold Dr. Brunner responsible for
the Brunswick epidemic.
It has been expected here that Dr.
Brunner would resent these relieetions,
and when he arrived to-day there was
much speculation over developments.
Judge Mershon has been in Brunswick
since last Friday. He will return to the
house to-morrow or next day, when mat
ters will be brought to a focus.
Dr. Brunner sny3 he is here to see
Judge Mershon and to oppose his board of
health bill, but has nothing to say about
impending trouble. He does not believe
Judge Mershon s bill ought to become a
law for many reasons and will use his ef
forts to either defeat it or have it changed
so as to meet what he thinks the situa
tion demands.

An Accused Person Discharged for
Want of Evidence.
Thoinasville, Ga., Dec. s.—Joel Smith,
the white man from Mitchell county, re
cently arrested for horse stealing, was
discharged yesterday us tlte evidence was
not sufficient to hold him.
Mrs. E. Chase, of this city, died last
night.
J. Stanley Brown, who was private sec
retary lo President Garfield, and who af
terwards married one of President Gar
field's daughters, is in the city.

a corporation duly chartered by the laws of
the state of Ceorgia. and having Its principal
place of business in the city of Savannah, in
the county and state aforesaid, respectfully
shows: That it desires to have its charter
amended in the following particulars: that ig
to say, by adding the following words to seo*

“Provided. That the said exchange shall
hold a lien on the share, or shares, of any
stockholder who may be indebted to it. anil
such shurtH shall not be assigned or trans
ferred by the holders thereof until such in
debtedness shall he discharged: and. provided
further, that the board of directors shall have
power to enforce said lien in the following
manner:

the minutes of the exchange against the de
linquent member and shall cause said stock
to he sold at public outcry on the first Tues*
day of th< month, between the legal hours of
sale, i efore the court house door, notice
thereof being advertised In one of the public
gazettes oace a week for four weeks prior to
such sale, and shall apply the proceeds aris
ing from such sale, first, to the costs and ex*
perises of such sale: second, to the discharge
of the indebtedness of the delinquent mem
ber: and third, paying the surplus, if any, to
the owner of said stock. And. provided
further, that the exchange shall have the
right to hid at such sale and to buy in suck
stock.”

charter may be amended in the manner as
above set forth,in accordance with the statute
