The case of J. H. Meadows against the
Western Union Telegraph Company was non
suited by Judge Westmoreland In the city
court of Atlanta Monday, and the decision in
volved an Important principle in penalty liti
gation. In < ctober, 1892, the mother of plain
tiff died, and he was telegraphed for at
Flowery Branch. The telegram was. for some
cause, delayed a whole day, and he arrived
home too late to attend the funeral. The
blank on which the message was sent con j
tained the tisnal stipulation requiring written
notice of claims for damages or for statutory
penalties to he filed with the company within
sixty days and the plaintiff failed to file his
claim within that time The validity of this
stipulation, as applied to statutory penalties,
has never been passed upon by tlie supreme
court of this state, and the decision of Judge
Westmoreland was. therefore, of much inter
est. The effect of the decision was to dismiss
the case at the plaintiff s cost.
Friday night at the home of John Johnson,
about four mile-- from Lawrencevllle,
while the family were at sup

ning struck tha house and killed two of its
Inmates Mr. Johnson's wife and his 6 year
old son, and knocking Mr. Johnson senseless
for more than an hour. Mrs. Johnson and
her little toy wore killed instantly. At the
time the llgntiuug struck Mrs. .loans m she
had a small baby in her arms. The lightning
knocked the baby out of her arms, but did it
no serious ‘njury except from the fall to the
floor. The little boy was standing in the cen
ter of the room, and when the lightning
struck him it sent him reeling into the tiro
and ho was burned about the head and shoul
ders. The lightning burs ted his skull. Mr.
Johnson was sitting in the front door when
the lightning' struck the house. It tore his
shoes off. leaving nothing but his shoes
on his feet, and split his toe wide open.
How he escaped after such a shock is miracu
lous.
Mayor Alexander, of Augusta, has been re
quested by Croft A Tillman, of Aiken, attor
neys for Ur. H. H. Tow nes and Willis Tow nes
of Edgefield S. C\. to reunite the canal dam
at the head of the locks. This piece of ma
sonery is an important factor lu Augustas
industrial advancement, and any attack upon
it will be a signal for warfare of the most
earnest kind. When the dam was was built
three and one third acres were secured
from Henry Townes, on whose place the
Carolina end of the dam rests. It turns out
that the land was entailed during Mrs.
Townes'life time and at her death reverted
to her two sons. Mr. Townes only
acted as trustee for her and could only
have negotiated for such interests as his wife
held. Two sous hate become of age ami they
now claim the property. This is the initial
step in a long legal contest that will follow.
The claimants consider the land to lie worth
(100.000. The city admits no irregularities in
the transfer of the property and will contest
the claim.

The Augusta Chronicle has editorially sug
gested Col. D. B. Dyer for mayor. Col. Dye**
is president of the Augusta Street Railway
Company and is the representative of the
Jarvis-Conklin ( oiripany. which has invested
nearly a million dollars here in the past four
years. He would make a live and progressive
mayor and would doubtless benefit Augusta.
Col. Dyer was the first mayor of Oklahoma,
so he has had experience In the business. The
Chronicle, in mentioning Col. Dyer for mayor,
calls the attention of the New York Trioune,
Chicago Inter Ocean. Philadelphia Press,New
York Advertiser and New York Mail and Ex
press to the fat t that Col. Dyer is an ex-union
soldier and a republican, who has \ een elected
colonel of the Sixth re.iment of Georgia In
fantry. and that he is suggested for mayor.
The Chronicle does this to prove to the north
ern and western republican and anti southern
papers that the south Is not hostile to ex
union soldiers and members of the Republi
can party, and to refute the charges that a
northern man who is a republican cannot
live in the south, or be respected if he re
mains true to his party. This incident, the
paper says, is sufficient assurance that the
war is over and southern people have forever
put aside its establishments and enmities.
A. W. Bellew, of Rome, is to be tried in the
federal court at Atlanta on a charge of fraud
in connection with a United States pension
case. He lie w Is a lawyer well known in
Rome and throughout North Georgia. For a
number of years he has acted as pension
agent. In that capacity he has done a good
business and seemingly prospered Some
time last year he was engaged to secure a
pension of il.fiUo for an old negro woman.
After a lot of correspondence, as
the prosecuting attorneys will show.
Bellew secured the. pension. The
ola woman was especially anx
ious to get a little money and came to the
agent to borrow sls. Her knowledge of read
Ing and writing extended no farther than the
signing of her name. Bellew agreed to let
the negress have #ls. telling her that she
would have to sign her name to a piece of
paper. This she did. in blissful ignorance of
the fact that she was signing away the full
amount of her pension, and it was really the
receipt of the pension he made her sign. A
few days afterwards 1 ellew informed her
that he had been unable to procure the pi n
sion, and advised her to let the matter drop.
This is the evidence the counsel for the pros
ecut lon intend to introduce. On the
other hand the defense will show •thn?
the woman was heavily In debt to Be
-and he kept the amount of the pen
sion to wipe out the debt. Another case sim
ilar in character and of equal importance
