Col. Barr called attention to the fact
that he desired to introduce as a witness
Col. George L. Gillespie, corps of en
gineers, who was here, hut without a uni
form. The court consented to have Col.
Gillespie go on the stand without his uni
form.
Col. Barr said this brought up the ques
tion of certain papers belonging to the
accused which would be used in the trial
cf the case. The boxes containing the pa
pers had been turned over to him by the
war department, he said, and opened on
Jan. 17 last in the presence of the accused
and his counsel after certain prelimina
ries.
These preliminaries consisted In' the pro
test made by Capt. Carter against the ex
amination of his private papers. The first
of these was in the shape of a letter to Col.
Burr signed by Capt. Carter, in which he
slated that the papers in question were
his private memoranda to which neither
the government nor any one else had the
right of access except on his permission.

knowledge or consent they were shipped
to Washington and put in charge of ihe
war department. He protested against the
examination as a violation of his constitu

At that examination on Jan. 17 Mr.
Blair stated in behalf of Capt. Carter
that he protested against the presence at
the examination of Maj. H. M. Adams
on the ground that it was a violation of
the instructions from the Secretary of
War with referenea to the examination
of the papers by the Judge Advocate in
the presence of Capt, Carter and his
counsel, and in the presence of no other
persons.
Col. Barr said he stated at that time
that he had received no such Instructions
u ware mentioned by counsel, and that
.Maj. Adams was here at his own request,
to assist him in the work of prosecuting
tie case. Maj. Adams was familiar with
the contents of those private papers, he
said, and he considered he had the right
to summon here any officer who was fa
miliar with any of the details of the
case. His understanding of the order was
that no unauthorized person should be
present at. the examination.
Col. George L. Gillespie, who was chair,
man of the board of inquiry, was then

ed a Cathedral building fund last night,

nians. The plan formulated It is expected,

Statement From I.nulsa Porter Home
Ladies.
Editor Morning News: The board of
managers of the Louisa Porter
Home held their usual monthly
meeting Monday, Feb. 14. The
artiale in the Morning News of the 13th,
in regard to a woman being refused ad
mittance to the home was acted upon and
investigated, and a committee was ap
pointed to correct the misleading state
ments made.
The woman was not refused admittance,
but was given a paper with Miss Marga
ret Reid's address, accompanied by the
statement that she would admit her. The
woman did not go to Miss Reid, but went
elsewhere. Ail such institutions must
have some constituted authority to admit
applicants, and frequent troublesome ex
periences have obliged the managers of
the home to allow the matron to exercise
this authority only after 9 o’clock at night.
This instance occurred about 7 o'clock in
the evening.
Mr. Egan, after hearing the statement
of two members of this committee, has or
dered the placards, which were removed
without proper authority, to be replaced in
the waiting room. Respectfully, Mrs. J.

In the Superior Court yesterday an
order of incorporation was granted to the
Abercorn Grocery Company. The Incor
porators are Messrs. R. Van Wagenen,
J. R. Morton, J. M. Lawton, W. E. Har
per and others, and the amount of the
capital stock to be paid in Is $5,000.
Judge Falligant also granted an order
of incorporation to the Mercer Furni
ture Company. The incorporators are T.
S Mercer and B. B. Mercer.
In the certiorari case of Canuet & Cos.,
against James W. Heidt, an order was
granted remanding the case to the justice
court for a rehearing. The cost* were
assessed against the defendant in cer
tiorari.

The Georgia ar.d Alabama Railroad Is
giving a good deal of attention at present
to the various colonies along its lines. Both
Mr. Gabbett and Col. Pope are working
assiduously and offering "every possible en
couragement to those contemplating locat
ing. Five colonies are now well under
way, with excellent chances of profitable
development. The “Norwegian Editors"
colony embraces some 10,On) acres at
Floyd's, a portion of which has been pur
chased and the balance held under option.
It is in charge of Editor Brandt, who was
recently in Savannah. The "Forest Glen,”
another prosperous colony, is between
Fitzgerald and Abbeville, and is in charge
of Mr. R. W. Randal of Chicago. The
“Old Soldiers" colony is at Fitzgerald and
is in charge of Mr. P. H. Fitzgerald of
Indianapolis. The “Southland" colony i3
on the west side of the Chattahoochee
river, five miles from Albany. It is in
charge of Mr. H. P. Rucker of Chicago,
who will steer an excursion from the
North Wednesday. The "Putney Coiony
Company,” managed by Mr. J. C. H.
Vance of Chicago, is another prosperous
settlement near Albany.
Mr. H. C. McFadden, assistant general
passenger agent of the Plant System, and
Mr. J. C. Haile, general passenger agent
of the Central Railroad, are in Washington
attending the monthly meeting of the
Southeastern Passenger Association. Col.
Beverly W. Wrenn passed through the
city yesterday en route to Washington.
Mr. James Menzies, assistant general
freight agent of the Plant System, is re
ported quite ill and has been confined near
ly ten days. His friends are solicitous
and hope his illness will be of short dura
tion.
Capt. R. M. Burroughs, general road
master of the Florida, Central and Pen
insular Railroad, passed through Savan
nah yesterday from Jacksonville.
Mr. C. L. Brunner, train master of the
Central road, is absent from the city on
railroad business.
Officials, representing the freight traffic
departments of lines south of the Ohio
river, are now in conference with the Cen
tral Traffic Association in New York.
The object of the meeting is to discuss
freight rates. Among the Savannahlans
in attendance is Mr. E. H. Hinton, traffic
manager of the Central , Railroad; Mr.
William A. Winburn, general freight
agent of the Central road, and Col. A.
Poie. general freight and passenger agent
of the Georgia and Alabama, and Mr. D.
F. Jack, freight traffic manager of the
Plant System.

Mr. W. L. Parker, formerly of Atlanta,
is in the city for the purpose of establish
ing an agency of the Prudential Life In
surance Company.
Two East Indians, Abdul Baree and
Allen Alley, were arrested by City Mar
shal Kelly yesterday for peddling small
goods without a license from the city.
M. C. Stevens, colored, was arrested last
night by Policeman Connally of the
Ocean Steamship Company, charged with
carrying concealed weapons. He was
lpcked in the barracks for a hearing.
What promises to be an interesting game
of indoor base ball will be played at the
Young Men’s Christian Association gym
nasium Thuredey night, between the Y.
M. H. A. and the C. L. A. teams. At
present there is a tie between all the teams
of the Indoor Base Ball League and the
winner will be accorded considerable cred
it in getting the game for that reason. The
games are growing more popular with the
ladies and the young men expect to sef> a
large number of them present.
The sixth of the series of games of the
Military Indoor Base Ball League will be
played at the Savannah Volunteer Guards’
hall, to-morrow night, the contestants be
ing the Guards and Chathams teams.
These two teams have each won two
games each. To-morrow's contest will de
cide which is to lead the league for ihe
first half of the series, there being twelve
games to be played. Both teams have
been doing some hard work practicing and
both are in fine trim. The friends of the
two teams are much interested and a large
attendance is expected.
A family living in the southern part of the
city had an experience recently which may
be of benefit to other families under sim
ilar circumstances. The colored nurse
who was engaged to look after an Infant
boy allowed the little fellow to injure him
self severely and promptly left without
waiting to give notice. A valuable gar
ment was missed after her departure. The
head of the family gave notice to some
of the girl’s relatives that unless the gar
ment was returned at once there would
be trouble for the girl. The next morning
a bundle was found upon the doorsteps
containing, not only the missing garment,
but several others whose disappearance
had not been noted. Thq warning had had
a very satisfactory effect.

Ten Day* Before They Will Know
About Extra Appropriation.
The absence of Alderman Guckenheimer,
chairman of the finance committee of
Council, who has gone for a ten days trip
to New York, will keep the Police Com-*
mission waiting that long at least, before
It Is known whether the petition for an ad
ditional $5,000 for the police department, Is
to be allowed.
In the meantime the police are wonder
ing what is to happen In case Council,
through the recommendation of the finance
committee, refuses to allow additional
funds. Some believe the mounted squad
will be abandoned and a number of the
cavalry's feet are shaking in the stirrups.
While John Kelly, driver of the patrol
wagon, did not receive any valentines, he
feels confident none will come in the shape
of a release. Kelly Is the man who yells
so loudly, and rings the gong so rapidly,
when hauling a squad of police to a fire.
The department, and especially Chief Mc-
Dermott, could not dispense with John.
