Atlanta. Jan. 30.—The corporations of
Georgia that are In arrears for back taxes
mu.-t'pay up, says the Supreme Court.
This l ris ion will bring into the treas
ury of Fulton county SBO,OOO of back taxes
ami about $20,000 j< r annum in the future
from companies that have heretofore
shirked this responsibility.
The decision is far-reaching in its ef
fects. as it is said it will affect other cor
porations in the state thNi are in arrears.
The case decided by the Supreme Court
■was carried up from the Superior Court
of Fulton county and is one of unusual
Interest. Last year Tax Collector A. I*.
Stewart issued executions against the At
lantic Notional Building and I/>an Asso
ciation. the Southern Home Building and
Loan Association, the Southern Express
Company and the Southern Bell Telephone
and Telegraph Company for the collection
Of back taxes.
Each of these four corporations filed its
petition an the Superior Court of Fulton
county, alleging that the tax collector
was attempting to enforce the collection
of taxes which they were respectively not
required by law to pay. and praying that
he be enjoined ftfom doing so. Judge J.
H. Lumpkin refused the injunction in each
case, and the plaintiffs excepted to his
rulings and carried the cases to the Su
preme Court, which sustain*d th* lower
court. The Supreme Court in making its
decision paid Judge ljumpkin a distinguish
ed compliment by adopting his opinion as
the opinion of the higher body. The Su
preme Court says: *
“With the order refusing to grant the
injunction, the Judge filed a written opin
ion which is in the record. We have ar
rived at the same conclusion that the
learned and able judge of the Atlanta cir
cuit reached in regard to the law of these
cases, and as his opinion is so complete
and satisfactory in every material branch
of the case, we adopt the same as the
opinion of the court, and do not deem it
necessary to add anything to what he has
said.”
Theft followed the opinion of Judge
Lumpkin, the salient features of which
ere, that the constitution of 1877, pro
vides that “All taxation shall be uniform
upon the same class of subjects, and ad
valorem on all property subject to be
taxed within the territorial limits of the
authority levying the tax, and shall be
levied and collected under genera! laws.”
Under this constitution, the general as
sembly cannot lawfully either expressely
exempt from taxation, or accomplish this
result by a failure to tax any property
except that which, in the constitution it
celf, the general assembly is expressly au
thorized to exempt. |
The dollar tax on telephone boxe^R nd
stations and the 2% per centum tax on the
gross receipts of express companies are
declared occupation or business taxes, re
garding which, the decision says: “The
general assembly ipas no power to declare
that an occupation or business tax shall
be levied upon certain classes of corpora
tions, which, when collected, shall be re
ceived in lieu of all the taxes upon the
property of such corporations.
ALLEGED GREEK GOODS GAME.
Young Atlanta Lawyer Held for
< heating; and Swindling.
Atlanta, Jan. 30.—There was on tri.ll to
day before Justice S. H. Landrum one of
the first cases of un alleginl attempt to
work the green, goods racket which has
developed here In several years.
I?. C. Birkhardt and J. W. Hamilton,both
young attorneys, were arraigned as com
mon cheats and swindlers, being charged
with obtaining money from a negro, George
Davis, under false pretenses. It was
brought out that on June 21. 1899, Hirk
hardt approached Davis, employed at the
time in a local barber shop, and made him
a glittering proposition by which he could
treble or even quadruple the money in
vested. After smoothly “baiting” his -vic
tim, Birkhardt secured from him, so Da
vis alleges, $135, which Birkhardt claimed
bad to go to the head of the firm in
Chattanooga to complete the deal. In a
few days Birkhardt handed the credulous
negro $240 genuine money, which was al
leged to be another link in the baiting pro
cess.
By this time Davis was so thoroughly

check for $l,lOO, it is alleged, forged with
the signature of A. Nash, the dupe’s broth
er-in-law. Davis asserts that the Chatta

fice, and that he saw Hamilton post a
letter containing the remittance. Up to
this time he has failed to hear from his
Investment, although the Nash check was
returned to Atlanta for collection ami pro
nounced by Nash as forgery. The facts
in tlie case have been gradually brought
to the surface.
Birkhardt this morning was placed un
der $250 bond to appear before the City
Criminal Court, and lack of evidence re
sulted in Hamilton’s dismissal.

be sold at public outcry on March 3, to
wind up the partnership business of the

Lieut. Blanton Winship was promoted to
the captaincy of the company In the Twen
ty-ninth Infantry made vacant by the
promotion of Capt. Owen Keenan to he
major of the battalion. They are both
from Macon, and went to the Philippines
together.

president of the Federation of Labor, has
been Invited to Atlanta for a conference
with Chief Powell of the Order of Rail
way Telegraphers.

Charge In Atlanta.
Atlanta. Jan. 30.—The Board of Control
of the Union depot to-day appointed Lew
is H. Hill, ticket to succeed Albert
Howell, Sr. At the time of the removal
of Mr. Howell, >lr. Hill was placed in
charge. He was for five years an assist
ant in the office.
Mr. Hill at the time of his appointment
as acting ticket agent was the traveling
passenger agent of the Central Railroad.
He was formerly ticket agent of the
road, having been relieved by Mr. W. H.
Fogg, who left the place of traveling pas
senger agent at St. Louis. It is not known
who will succeed Mr. Hill as traveling
passenger agent, hut Mr. Fogg has been
spoken of for the place. Vice President
Egan of the Central was present at the
meeting.

purchased 90 feet front of the burned
square on Broad street for- $57,720, from
the Montgomery estates. This* gives him
200 feet front by 264 feet deep, and he
to-day instructed Bruce & Morgan, arch
itects, to submit him plans for a build
ing to cover the entire lot. His wholesale
and retail department store will occupy
the ground floor, except a hotel lobby in
the center, and a modern hotel will rise
six stories above.

Columbus, Jan. 30.—A hot aldermanic
contest closed to-night by a compromise
by which the two candidates. E. Philips
and L H. Kaufman, retired from the field
and Mr. W. B. Beach was selected as a
compromise candidate. He will bo elected
without opposition to-morrow. Everybody
is pleased with the result as it ended a
disagreeable factional fight.

house of Mrs. J. B. Newsome, about two
miles from this place; occupied by Thom
as Cox, was destroyed by fire last night.
As it caught very early in the night, it
