Mr. Cook moved the previous question, on which

The previous question was seconded by a vote of S3

Mr. Brundigo called for the yeas and nays, saying
he wanted to see who was in faror of destroying the
National Banks.

published advertisement of the sale of a negro at An
napolis, hid., on the 8th of December, convicted by

rested in Norfolk, supposed to be James
Stephens, the Chief of the Fenians, but the
cstablisbmeut of his identity is as yet consid
ered dubious.
Florence, Sunday.—The new Envoy of
the Clatcn Government to Rome, Signor
Tonnelli, who was appointed in place of Ra-
gezzi, whet: tho latter resigned that position,
few been received at Rome by the Pope.
Theltaiian newspapers say in addition that
strong hopes are entertained that the impor
tant mission of Signor Tonnelli having begun
so auspiciously, will bave a favorable result.
The King of Italy opened the Italian Par
liament on Thursday. In his opening speech
he wished Italy joy of the freedom she had
regained, and said that France, faithful to
her promise?, had withdrawn from Rome,
and that the best understanding was believed
to exist between Italy and Napoleon. He
declared that he would respect the Territory,
of Papal States. He hoped that the modem
tion of the Italian Pope and the wisdom of
the people, and a spirit of conciliation of
both sides would remove all differences, and
said'it was his wish that the Pope should re
main independent in Rome. He concluded
by referring to the great and glorious future
Italy bad before her, and declared site must
by every means, develop her resources to
achieve her position as a great nation. The
speech of tho King was well received by ntem,
bers of the Parliament.

Baltimore, Dee. 15.—In the ease of Wm.
W. Glenn, vs. the National Express Compa
ny, Judge Alexander passed an order and de
cree appointing Titos. Eliott os Receiver for
the Company, authorizing him to collect, sue
for and motive all its property and assets and
alimonies due to .or recoverable by the same;
whether iu the hands of or due by any Officer
or share holder of the Company or any other
person of persons, and ree-.ipt for and release
the sain? J. B. Uogo, C. O. O'Donnell and
J. T. Keller are directed and required to
bring intoMaryland all the property moneys
and ollur us-acta aud descriptions of movable
property belonging to the National Express
Company on the 20th of Soptemlu-r last, in
their potwtasion and under their control
respectively, and'to deliver the same to the
Receiver, who is required to give notice to
the creditors of the Company to present their
claims and vouchers thereof with the clerk of

Nrw York, Dec. 16.—The Mayor's nbmi-
liable to be misunderstood. The wholesale
discontinuance of offices now in operation is
contemplated, but the action of the Post-of
fice Department refers only to the many offi
cc8 iu the South which were suspended at
the commencement ot the war, and which
have not since been formally reopened, al
though in tact discontinued. The accounts
of such offices cannot be closed, and balances
due the Government collected by the Au
ditor for ibis Department under existing laws
and regulations, without a formal order of
discontinuance by Postmaster General.-
Where open, the bonds must, be surrendered
to the Auditor anil he can proceed against
the late Postmaster?. The Auditor of the
Postoffice Department to the Postmaster
General that the postal revenue in the late
insurgent States have exceeded by nearly
two hundred and ninety-two thousand dollars
the actual expenditures, and it appears, in
cluding all liabilities to June 13th last, the
revenue in that section would only be deficient
$25,000.

resolution passed as amended,
Mr. Ashley, of Ohio, introduced a resolution author
izing the appointment of a committee of seven to-in
quire whether any officers of tho Government had
oommittod any aet which, nnder the Constitution,
would bo a high crime and misdemeanor, and wheth
er such acts wero committed for the overthrow or cor
ruption of the United States Government.
Objection was made, and the House refused to sus
pend the rales to have it considered.
Mr. McKee, of Kentucky, introduced a resolution
for the better protection of loyal persons in the late
rebel States, ineluding Maryland and Kontucky. Re
ferred to Committee on Reconstruction.

A cominanicatioa was received from the Secretary
of War, iu response to a resolution asking if the com
miesionera provided for by an Aet of 18A4 for the pay
ment of loyal owners of enlisted slaves, have been
appointed, Ac. The communication was accompanied
by a report, which was referred to the Committee on
Military Affaire. ,
Mr. Sumner presented the proceedings of a recent
meeting of loyal citizen*, without 'respect to color,
held at Norfolk, Virginia, asking for the reorganize
tion of the Government of Virginia, Ac.
Mr. .Salisbury objected that, under the rules of the
Senate, tho proceedings of a puMio meeting could not

under false pretences. Mr. Sumner said there were
person* hore from foreign countries endeavoring to

The bill to repeal tho President's amnesty power
was then taken np. ,.
On the bill to repeal tho 13th section of the Aet to
suppress insurrection, Mr. Trumbull said:
’The peal ohioea of this bill is only to take from the
President the power to issue a general proclamation
of amnesty. Under tbps clause, 400,000 acres of land
had already been restored to the rebels: and many of
them, instoad of appreciating this clemency, were
more defiant and disloyn! than ever. It was not sup
posed that any necessity wonid arise in the future for
a general ammsty. and it was therefore proper to lire
elude the President from issuing one.”

MILITARY COMMISSIONS BEFORE
THE SUPREME COURT.
Washington, Dec. 17.—To-dsy in the Supreme
Court associate Justice Davis read an elaborate
opinion in the case of Uarndcn and Milligan, who
was convicted in Indiana by a Military Commis
sion, on a charge of conspiracy aud sentenced to
death. He was, however, released on a writ of ha
beas corpus. The Court at its former sessions gave
a decision ot the unconslltntlonality of the trial by
aMilliury Commission. Congress having passed
a law providing for trials in such cases by the cItU
tribunals, the Judge spoke ot the importance of
adbering to the Constitutional guarantees of pro
tection to life and property. Although tho prlvi-
Jedgeef the writ of habeas corpus was suspended
this did not deprive the accused of an appeal to
tc the Civil Courts, for be had never been engag
ed in the naval military service; he'was simply a
citizen of Indiana. There was no necessity to try
him before a military Court for the Civil Court
was open and process unobstructed ; besides, the
trial hy a Military Commission was obviated by an
express law of Congress passed in March, 1863.—
The chief-Jastice, for himscil and associates
Swuyae, Wavne, and Miller, read a dissenting
opinion as to tbe power to establish Military Courts
by Congress, but agreed in the general views of the
majority. In other words the full court agreed
that, the trial by Military Commission was illegal.—
This decision affects the coses ot Bowles and Hor
sey, tried for similar alleged offences.
A petition was presented in tbe nouse to day,
signed by a person from Athens, La., asking for
tbe impeachment of the President
Th* Secretary of War sent to the Senate to
day, an answer to a call for information in re
gard to the appointment of Commissioners to
award compensation to loyal persons to whom
colored volunteers or drafted men may have
owed service at tbe time of their enlistment or
draft into military service of the United States.
The reply states that Commissioners have been
appointed for Maryland, Missouri, Kentucky,
Tennessee, West Virginia and Delaware.

Barnsley, Sunday, Dec. 16.—Several ex
plosion# took place «t the Colliery yesterday
and to-dffy, which shows that the fire is still
raging in the pit, but there has been no fur
ther loss of Ufa The most touching scenes of
woe and despair are hourly witnessed, both
in the vicinity ot the Colliery and in town.—
Over eighty funerals have taken place; one
hundred and sixty women have been left
widows and three hundred and thirty chil
dren made orphans by the terrible calamity,
and many of these are mourning in the streets
from morning to night.
Hani.et Staffordshire, Dec. 16.—Eighty
of those who went into the mine at Falks’
Hill the morning of the explosion are known
to be dead, and there are more remaining in
the pit, of whose safety all hopes are lost. All
the dead that have been recovered wero
buried to-day at Falks’ Hill. The ceremcnics
were impressive.

of citizens of the United States in tbe matter of
public loans of the Republic of Mexico, and the

structing the Committee on Navai Af
fairs to inquire into, and report on all the
facta connected with the destruction by fire of the
Iron-clad war steamer, New Ironsid-8, on tho
night of the 15th of December, together with such
recommendations as the facts may demand, with
power to send for persons and papers, and to re
port at any time. Mr. Washburn, of Illinois, ia-
vored the resolution, but said be would like for tbe
gentleman front Connecticut to state the facts
connected with the destruction of the magnificent
iron-clad. Mr. Brunadge declined to make any
statement at present It was a subject oi
importance and one bn which ibe House
and country should be informed. It wonid be in

excitement here this morning, an alarm having
been given that the Fenians were coming to the
rescue of tbe prisoners. Volunteers were Imme
diately got under arms and the whole force went
out, but subsequently ascertained that the rumor
was falsa ,

the President father weakens the strength of tbe
Alabama claims by tbs manner in which he
treats the Fenian question, but that portion of

highly spoken of.

say was: if the Canadas were to be given up by Great
Britain, it was better that they should fall into' the
hands of the United Stales than into those of the Fe
nians. With this explanation, the Minister of the
United States was entirely satisfied.
