SPRINGFIELD. 111.. Oct. 3.-In decid
ing today on the demurrer of the llli
nols Centra! Railroad company to the
•u'.t of the state of Illinois, to collect
bark taxes from the railroad, the su
preme court ruled In favor of the state
on all but one point.
The court holds that the charter agree
ment of 1851. under which the railroad
wa< to pay the state 5 per cent of its
gross earnings, is a contract, and that
the five per cent Is not a tax In the le
gal sense. The court holds that all In
terstate cemmcr'-e h"slnes< of the road,
as well as income from eating houses,
express business, of charter lines as well
as of trunk lines, form the principal on
which the 5 per cent shall be paid to the
state
In the matter of back taxes the court
holds against the state, which sought to
recover Its percentage since 1871. On this
point the court says that governors pre
vious to Deneen accepted the accounts
of the rial roods and the payments made
bv the road without question, and that,
therefore, accounts prior to W 6 are out
lawed. Under this ruling the SIS.«XM),O»J
which the state sought from the Illinois
Central dwindles, roughly estimated, to
about r.ivo.ooe
From 19*6 the court lays down the rule
for accounting by which the state, it is
estimated, will receive revenue
annually from the road, instead of 11.-
900.00, or less as at present.
It is the contention of Governor Deneen
that for 33 years the railroad has been
’'milking' the state through its svstem.

general early in 19W7. following a message
of Governor Deneen to the legislature In

ON VALDOSTA TRACKS
VALDOSTA. Ga.. Oct. 2k—Some tim*
ago the Georgia ai.d Florida railroad,
which company has b' v en using the track
of the Atlantic Coast Line since the new
road has been in operation, decided to
build its own tracks through the city. ■
To this end a few days ago the Georgia .
and Florida road begun work on its track
and when thia work neared the right of !
way of the Atlanfc Coast Line, at a
point where the new road would cross, it |
is reported that a guard, properly armed
was placed there to prevent any work
going on across the Coast Line road and
right of way. AH during yesterday X
seemed as if a ciash between the two
roads was imminent, and much specu
lation was indulged in as to the final
outcome, however today an agreement
was reached by the offic’ala o flhe roads,
and all friction has subsided.
The Georgia and Florida will push to a
speedy completion the necessary amount
of trackage, which will enable them to
operate their trains over their own
tracks. It is understood that the Georgia
sad Florida have secured the land and
will erect Its own passenger and freight
depots at an early date, which will not
only gtw it teeter facilities for handling
Its business, but it win add much to
the Improvement of Valdosta.
SCHOOLS FOR PANAMAIANS
ARE TO BE ESTABLISHED
WASHINGTON. Oct 3*.-The govern
ment of Panama has secured permission
from the United States to establish at
afferent places tn the canal xone. which
may be agreeable to tills country, schools
for both sexes of I’ar.amaians to be
taugn; by natives, the expenses to be
paid from the Panama national treas
ury.

BOSTON. Oct. 28.—Preparatory to the
reorganiation of the Boston herald com
pany the receivers of the company have
isked the United States circuit court for
permission to sell the assets of their
company. It is stated that 99 1-2 per cent
of the unsecured indebtedness have as
sented to the proposed sale.
It is proposed to bold a private sale at
a price that will net 40 cents on the dol
lar to the unsecured creditors who have
had their claims allowed. The property
will be sold subject to any outstanding
mortgage Hen. and prox talon is made for
the protection of such parties not before
the court as may have their right deter
mined by the court within four months.
In the reorganisation of the Herald
company the property -will be taken up
largely by the existing bondholders who
hold the H,«9A.«» bonds outstanding.

THE SOUTH CAROLINA
NORFOLK. Va., Oct. 2S.—Elaborate
ceremonies attended today the presenta
tion to the battle ship South Carolina of
the naval trophy won by that ship in at
taining highest percentages In the spring
and enmnjer target and maneuver prac
tices of the Atlantic bat*'e ship fleet off
the Virginia anti Massachusetts coasts.
The presentation occurred aboard the
South Carolina at the Norfolk navy yard,
and was witnessed by the commandant
of this naval stat ioh as well as by the
officers of all vessels now here. Cap
tain Fletcher, commanding the South
Carolina, read letters from high naval
t officials commendatory of the achieve
ments of tee South Carolina's crew. who.
in full drees uniforms, participated in the
ceremonies.
PRESIDENT TAFT WILL

from the election of next Tuesday week

sentatives of the Frisco system announce
that a full train load of liquor had been
made up to be shipped out of the state
over their line. The scramble of local
dealers to get rid of stocks on hand is
the result of the sensational campaign
now under way here to secure enforce
ment ot the prohibition laws.
The destination of the train which
left here tonight is said to be Mem- j

Explosive Was a Relic of the
I Civil War and Regarded
Harmless

• DALTON, Ga. Oct. 28. —A bombshell
' which had lain half buried in the yard
iof a negro, George Towns, within a
i f«»w yards of breastworks used here
, during the civil war. exploded when
struck by a piece of iron in the hands
of a grandson of Towns here today
and the child's mother was struck by
a piece of shell and badly bruised.
' Fire under a washpot nearby was scat
tered in all directions by the force of
the explosion, and two negro boys
playing nearby had their clothes to
catch fire; but the flames were
smothered out before they were burned
to any extent.
The explosion was peculiar In view
of the fact that the old shell, which
was a relic of the civil war, had been
in the yard for years, in fact as far
buck as the family could remember.
That the explosive with which the
shell was loaded should have with
stood time and the severe weather to
which the shell was exposed is little
short of wonderful.
The explosion occurred at the foot
‘of Fort Hill on which is located the
! main building of tne public school
j system, and the school children were
thrown Into excitement when they went
to investigate the cause of the loud
noise which accompanied the blowing
up of the shell.'
NEW ORLEANS SCORED
BY PURITY LEADERS
NEW ORLEANS. Oct 28—" The sys
tem of protecting vice in New Orleans
is such that the hand of God Almighty
could not make this a decent community
inside of 25 years.”
This declaration by Rev. James F.
Chase, of Boston, featured the many
knocks administered to this city yester
day by those who came here to conduct
a meeting of the American Purity con
gress.
Mr. Chase said legislation provided for
the protection of vice here, and that It
ought to be done away with.
John B. Hammond, of Des Moines,
lowa, said the attitude of the local po
lice toward vice was disgrace and many
of the officers he had seen here should
have their uniforms torn off before night.
B. S. Steadwell, president of the con
gress, did not think New Orleans so bad,
and expressed the belief that vice could
be eradicated here within one year.
Owen O. Wlard, of Springboro. Pa.,
discussed law enforcement. He said that
we are only convicting a little more than
1 per cent of the murderers In the Unit
ed States. The congress closed yesterday
afternoon.

SUNDAY-SCHOOL MEET
ANNISTON. Ala., Oct. 28.-S. A. Rus
sell of this city has been made a mem
her of the program committee for tiie
Alabama State Sunday Schoo! conven
tion, which will be held in this city next
year, according to an agreement reached
by the executive committee at the meet
ing in Montgomery last Wednesday, and
he will at once begin working with the
other members of the committee for the
preparation of the work for the next
annual session.
This is the largest delegated body in
Alabama, having about 2,000 or 1,500 del
egates present at every meeting. It baa
never met before outside of Birmingham,
Montgomery or Mobile, and ti is consid
ered a creditable recognition that the
convention should come to this city.

TOWNS SHOW INCREASE
WASHINGTON. Oct. 28.—Population
statistics enumerated in the 13th census
were announced today for the following
cities:
Chester, Pa.. 38,537, an Increase of 1,549.
or 13.4 per cent over 33,988 in 190 b.
Hazelton, Pa., 25.452, an increase of
11,222. or 78.9 per cent over 14.230 In 1900.
SHAMROCKS MUST PAY
DUTY OF 60 PER CENT
NEW YORK, Oct. 3.—The status of the
shamrock from the standpoint of the
United States government has been defi
nitely settled by the board of United
States general appraisers here. Acting on
a protest filed by New York importers,
the board has decided that the shamrock
must pay duty under the tariff act of ISO 9
at the rate of 60 per cent under the pro
vision specifying "flowers not especially
provided for.”

the best of times and It lands a fellow
behind the bars in the long run,” is the
counsel given by Henry Anthony, who
Is awaiting trial at Passaic, N. J- Ac
cording to the police. Anthony has con
fessed to 25 burglaries in the fashion
able section of Passaic. His operations
were so profitable, the police say, that
he owned an automobile and was able
to indulge his whim for high stake gam
bling and other expensive pastimes.

NAVY AND ARMY CLASH
IN PENSACOLA WARFARE
PENSACOLA, Fla.. Oct. 3.—Mimic
warfare In which nine army and navy
steamers, representing an invading fleet,
and seven companies of artillery, de
fending forts Pickens. Mcßae and Bar
rancas, were engaged, closed last night
with a victory for the land force, which
had for 24 hours successfully withstood
the assaults of the fleet. Including sev
eral attacks during Wednesday night.
The maneuvers were upon a more ex
tended scale than any ever conducted
on the gulf coast and were witnessed
by General Mills, commanding the de
partment of the gulf, and a number of
officers stationed at the forts.
SCREAMS OF CHILDIAVE
HER BROTHER’S LIFE
MARSHFIELD. Wis., Oct. 28.-The
screams of 5-year-old daughter of Her
man Bilgrlen, who lives two miles from
this city, saved the life of the farmer’t
2-year-old son, who waa being carried
away by a huge tlmtier wolf yesterday.
The wolf entered the farm yard where
the children were playing, seized the boy
and started for 'the woods.
The girl, however, ran after her broth
er screaming until the wolf was so
frightened that he dropped the boy prac
tically unhurt.
KIDNEY BEANS WILL
FLOOD NEW ORLEANS
NEW ORLEANS, Oct. 28.—New Orleans
will be full of beans before the week
end. When the season's initial shipment
of kidney beans. 80,000 pounds, arrived
Wednesday, they were sold at the rate of
two pounds to the second, and many
bean hungry went without. Nobody kick
ed on the price—B 1-2 cents a pound
either. People wanted beans at any
price. Today several cargoes, including
1 of 40 tons, will arrive, and of course,
that will be enough to go around.
SIZE OF BANK NOTES
IS CAUSING CONFUSION
WASHINGTON, Oct. 28.—Secretary
MacVeagh’s proposal to reduce the size
of paper money has progressed to a point
where the problem of working out a plan
for a uniform national bank note is a se
rious one. A committee is soon to make
a report with recommendation.
It is said to be impracticable to reduce
the size without reducing national bank
notes to the same size. If that be pos
sible. it is declared the 7,000 national
banks of the United States could save
$200,000 a year in addition to the $900,000
the government expects to save.
It will require an act of congress to
change the wording now upon national
bank notes and that is necessary before
the size can be reduced.

Bland, has leased a 14-room apartment
on Park avenue here, and it Is declared
that, following his retirement from the

BIRMINGHAM. Ala., Oct. 28.—Follow
ing a sensational attack mafl<* by Arlie
, Barber, a well known druggist and seed
dealer, on the blind tigers of Birming
ham In police court yesterday, a gang
•of keepers of these places set upon him
'in his store last night and beat him
j unmercifully. He is believed to be seri
ously injured.
Two separate attacks were made upon
him. The first party consisted of three
men, who assaulted him and left, and
a little later a party of eight, headed
by Dick Wray, a well known character,
entered the store and beat Mr. Barber
until he was left almost unconscious. It
is stated that several of the men car
ried revolvers.
The assault was the culmination of a
speech made before Judge Feagin s di
vision of the police court yesterday
morning in which Mr. Barber demanded
protection from the blind tiger keeper*
