MONTGOMERY, Ala.. ;5.—Charg ing that Sheriff William Martin, of Hale county, is guilty of wilful neglect of duty* because he allowed Will Thom as. a prisoner, to obtain a bottle of car bolic acid and commit suicide, Attorney- General Robert C. Brickell filed im peachment. proceedings against him in the supreme court Tuesday. Information to the court set out that Thomas, under death sentence for mur der, applied to the jailer for a bottle of carbolic acid December 31, that the poison was purchased and given to Thomas in the presence of Martin with out an investigation to determine the contents of the bottle. A second charge alleged incompetency because the bottle was given to the prisoner without an examination of contents. In the first count Attorney General Brickell charged that Martin is guilty “of wilful neglect of duty' in allowing or permitting a prisoner in his charge, as such sheriff, and under the sentence of death, to obtain carbolic acid or other poison for the purpose of self-destruc tion and in thereby causing his death; that the said William Martin, as sheriff of Hale county r , was guilty of wilful neglect of duty in negligently giving to a prisoner any package without first ascertaining the contents of such pack age, thereby permitting such prisoner to commit suicide; that the said William Martin was guilty of wilful neglect of duty in knowingly giving a prisoner in his custody a bottle containing poison, thereby enabling such prisoner to'com mit suicide and avoid the penalty of the law.” I The supreme court was asked to noti fy Sheriff Martin to appear and answer the charges. TWO MEET DEATH IN EXPLOSION OF MILLS (By Associated Press.) HAZARDVILLE, Conn., Jan. 14.—Two persons w*ere killed, seven seriously in jured and almost every building in the town damaged by an explosion at the Hazard Powder Works this afternoon. NEGRO TELLS HOW OIL- LETTERS WERE STOLEN Taken From Desk of John D, Archbold and Printed in New York American ' (By Associated Press.) WASHINGTON, Jan. 14.——The negro waiter,‘William W. Winkfield, of Chica- co, formerly employed by the Standard Oil company as a messenger, today told the senate campaign fund investigating committee how he and another employe named Stump, took from the desk of John D. Archbold, of the Standard Oil company, two letters and disposed of gaelF. ■■He also told selling a copy of a telegram for $1,000 and lending two copy books of letters for which $500 was' paid. Of the amounts received Winkfield eaid he re ceived one-third. Winkfield could not recall the contents of the two letters or the telegrams, to whom they were addressed, or the signatures attached. He said that the letters wer© taken in the fall of 1904 and published in the New York American. Winkfield testified in 1904 he was em ployed by the Standard Oil company in New York as a messenger, and Stump, he said, was employed as a file clerk. Winkfield said that in the autumn of 1904, after reading in the New York American regarding certain telegrams sent to some one In Washing ton, he spoke to Stump and another office boy named Frank Morrill, employ ed in Mr. Archbold’s office. Sunday Drunks $23.50 ANNISTON, Ala., Jan. *14.—Recorder Green's graduated scale of fines for Sunday drunks reached $21 Monday morning, when this extreme penalty was enforced against two white men, who were fined $23.59, including costs for their arrest. JUDGE MADDOX TABOOS Decided Sensation Is Caused by Certain Passage in Charge Floyd Jurist (Special Dispatch to The Journal.) ROME, Ga., Jan. 14.—A decided sen sation was caused by certain passages in the charge of Judge John W. Mad dox to the grand jury of Floyd county this morning, which those familiar with local conditions understod as bearing directly upon the conduct of the Floyd city court It has been the custom of Judge Mad- ©£-JjIex to send._aU parties convicted of violations of the prohibition law to the chaingang. There are now six white men and a number of negroes serving sentences. On the contrary, the Floyd city court, of which John H. Reece is judge and Claude H. Porter is solicitor, has made it a practice to impose light fines upon convicted violators of the prohibition law. A few days ago the attorney for an alleged blind tiger operator, whose case was pending in the superior court, swore out' an accusation and carried the defendant before the Floyd city court. A light fine was imposed, which other officers of the court, according to custom. In the course of his remarks, Judge Madox said: “Violators of the law 'in this county seem to think that they have discovered a way whereby they can evade the superior court. Ji^st \n the last few days there has been some skuldruggery prac tised that I think will prove abortive. "We will see what the law has to say about that kind of thing. If de sirable, a good thing to do would be to wipe out that sort of court by leg islative enactment. In i<s last analysis, however, the burden rests upon the people, and when the proper times comes we will see what they think of a judge that acts like that.” ATHENS PATS TRIBUTE TB MRS. WHITE'S MEMORY City Offices and Business Houses'Close Wednesday During Funeral ♦ Special Dispatch to The Journal.) ATHENS. Ga., Jan. 15.—The funeral of Mrs. H. C. White, president of the Geor gia Federation of Women’s clubs,, was held this afternoon from Emanuel church and was conducted by Bisohp C. K. Nelson, assisted by Rev. Troy Beatty, pastor of the deceased. The active pallbearers were students of the University of Georgia and the honorary pallbearers consisted of the following; The chancellor of the uni versity, president of the State Agricul tural college, the dean of the university, the members of the faculty and promi nent citizens of Athens, Atlanta, Sa vannah and Augusta. The honorary escort consisted of members of the Athens Woman's club, the Civic club, the Daughters of the American Revolution, the Young Wom an’s Christian asociation and the guild of the Emanuel church. As a tribute to the memory of Mrs. White the exercises of the State uni versity were suspended during the day, while the city offices and business hous es closed during the hour of the £uner°,l. PHILADELPHIA FIRE HORSES GET VACATION . (By Associated Press.) PHILADELPSlA, Jan. 15.—A two weeks'’ vacation for ever one of the 8,000 horses in the employ of the city police, fire and street departments are to be granted next summer. An infirm ary for dumb animals has raised $15,000 to meet the cost, and a committee is at work figuring out how the horses can be spared from their work. When Married Man Draws a Knife as He Is Accused by Mother, She Shoots Him Down and Calls Sheriff ♦Special Dispatch to The Journal.* * BROOKI1AVEN, Miss.. June 14.—To purge her sixteen-year-old daughter's name from sl;ame and to protect herself from injury, Mrs. Mattie Clements, a pretty widow, shot and instantly killed John Mullen, a married man, here yes terday in her own home. She declares that her daughter was betrayed by Mul len. Although four shots were fired into Mullen s body any one of them would have caused death. What might have happened had the widow's nnger failed on the trigger is told by the knife in the grasp ox the dead nmil’s hand when the sheriff arrived. Another widow was made by the,trag edy and live little children were ieit latheness, but tne mother of the Clem ents girl has slain tne rrn^n whom sh4 cnarges had been on intimate terms wui4 ner daughter. Wile Mullen’s body was removed tc his home and the little personal effects turned over to his wife, found among them was a photograph of the little sixteen-year-old girl whose mother had slain him. According to Mrs. Clements, Mullen came to her home yesterday to see her daughter, and the mother charged him with betraying the girl. As the widowed mother stood with her hand in a dress er drawer, ready to pick up her revol ver, she lectured the married man. She told him of the blighted life of her only daughter, and grew frantic as she reminded him of his live chil dren at home, one a daughter of about the same age of the girl he had been intimate with. When she spoke of his neglect for his wife, Mullen drew his knife, but the widow’s finger was quick, her aim perfect, and he fell dead at her feet. i Mrs. Clements went to the telephone and called the sheriff. She narrated the story of her daughters blighted life before she told that sheVhad slain the man accused of it. When she sheriff arrived Mullen’s body was in the position in which it had fallen, and clinched in his right hand was the knife which might have written a different story in blood had the finger of the widow been but a second slower. Popular sympathy is with Mrs. Clem ents and she has been released on a bail of $5,000, returnable to the con vening of the grand jury January 27, at which time she will face the charge of having slain Mullen. The Mullens and Clements nad been neighbors for several years, but since the intimacy between the Clements girl and Mullen the latter has been living apart from his wife and children, de clares Mrs. Clients. Asks "Decent People of South Carolina to Judge for Themselves" The Detectives Plan to Make Wholesale Arrests in the Underworld (By Associated Press.) CHICAGO, Jan. 15.—Officials at de tective headquarters are planning a cru sade against “crooks” with a known po lice record, which is expected to result in 10,000 arrests on vagrancy war rants. Detectives were ordered to prepare to day lists of all thieves known to them from the “high class” bank sneak to the ordinary door mat thief. Not only the names but the general habits and “hangouts” of Jhe thieves are to be included in the lists. An idea of how many names may be handed is indicated by the fact that one pair of detectives last night prepared a list of 680 thieves known to them. Al lowing for duplicates it is expected that the 100 detectives at the bureau will furnish at least 100 names each. Warrants wilj be placed in the hands of the detectives with instructions to have the crooks locked up within forty- eight hours if possible. The move was decided on because of the crime .rave which has swept over the city during the last few weeks. E THE U. S. SUPREME COURT] Wilson May Have Chance to Name Two New Justices First Ballots Will Show No Real Strength-Many Favorite Sons (Special Dispatch to The Journal.) WASHINGTON, Jan. 14.—President Wilson may have the appointments of two justices of the supreme court. Sen- was divided between the solicitor &nd,,ator Goree, who enjoys the confidence of Mr. Wilson, today introduced a bill to increase the membership of the court from nine to eleven. He hopes to se cure favorable consideration of the measure at this session of congress. It is not known wnether Senator Gore offered his bill at the suggestion of Mr. Wilson, but the relations of the two, considered in connection with Wil son’s desire to organize the government along progressive lines leads to the be lief that he may approve the Gore prop osition. SAVANNAH, Ga., Jap. 15.—Captain R. J. Davant, anti-administration candidate, was elected mayor of Savan nah Tuesday, his majority over Cap tain George P. Walker being 304. The aldermanic ticket is badly split up. The election was closely contested, the tptal vote cast being 5,500, which is close to the full registration. Of his aldermanic candidates, Captain Davant lost R. D. Charlton, Robert Fechner, Jacob Gazan and Joseph A. Logan. From' the Walker ticket, George H. Elton, H. B. Grimshaw, H. L. Kay ton and W. W. WilMamson were elected. T DEMOCRATS TD SENATE Gov, Shafroth and Former Governor Thomas Will Go To Senate (By Associated Press.) DENVER, Colo., Jan.—The democrats won two more seats in the United States senate today when the Colorado legislature elected former Governor Charles S. Thomas and Governor John F. Shafroth to succeed Simon Guggen heim and an existing vacanicy. The senate and house voted separately today and the election will be ratified at the joint session tomorrow. Twelve republicans in th e house and three in the senate voted for the democrats. (Special Dispatch to The Journal.) COLUMBIA, S. C., Jan. 15.—Declaring that he cares nothing for the criticisms of certain classes, but wishing that th e “decent element of South Carolina” to know what he said and pass judgment rn it for themselves, Governor Cole L. Blease, has sent a special message to the state legislature a stenographic re port of his speeches at the conference of governors in Richmond. Va., last De cember. His letter, transmitting the re port, follows: “To the Honorable the Alembers of the General Assembly of the State of South Carolina. “Gentlemen: I herewith transmit to you the official stenographic report of my speeches«before the conference of governors, held in Richmond, Va., De cember 3 to December 6, 1912. This re port is furnished me by Mr. L. D. Booth, the official stenographer of the conference of governors, who is stenog rapher for the J^tate corporation Com mission of the commonwealth of Vir ginia, with headquarters at Richmond. “So much has been said and so much has been written about the speeches which were delivered by me before the governors’ conferehce, and such cow ardly, infamous and l'oul editorials have been heralded throughout this country by various newspapers, that I desire to submit to you and to my constitu ents in South Carolina exactly what I said in the three speeches, to-wit, the address on penology, the address on di vorce, and the address on the resolution which is quoted below in connection with the three addresses; in order that you and the people of South Carolina may see that there was absolutely nothing said by me on that occasion in reference to lynch law, except what I have said all over South Carolina time and tim e again. And I have never yet said It In South Carolina that it did not meet with round after round of applause from the best people of my state. BAD. NASHVILLE, Tenn., Jan. 14.—Voting on a senator to serve from March 4 for the ensuing six years began today at noon in the Tennessee legislature, the two houses voting separately. Prior to the voting, it was generally predicted that there would bo rto election on the fi st blood. It was predicted this morning that the more active candidates, B. A. Enloe, John K. Shields, K. D. McKellar and L. D. Tyson, would get the bulk of the votes today, the remainder being distri buted among “favorite sons.” It was not expected that the ballot would develop the real strength of any candidate. He Declines to Comment on Efforts to get Him to Ap pear Before Committee PALM BEACH, Fla., Jan. 14.—William Rockefeller, accompanied by his wife and son, William G. Rockefeller, are spending a few days here before re turning to the north. The party arrived last night. Mr. Rockefeller declined to comment on the effort of the Pujo committee to compel him to testify before that body, but said he intended remaining here three or four days. TAFT’S CIVIL SERVICE ORDER WINS IN HOUSE Congressmen Refuse to Pass Bill Annulling Executive Orders (By Associated Press-) WASHINGTON, Jan. 14.—The Cullop amendment to the postoffice appropria tion bill annulling executive orders which placed assistant postmasters and clerks of first and second class offices and postmasters of the fourth class un^ der civil service, was rejected by the house today, 141 to 106. An amend ment to withhold per diem pay to postoffice Inspectors investigating can didates for fourth class offices was adopted. H. D., alias “Diggs.'VNolan was sen tenced last Saturday to five years in the federal penitentiary at Fort Leaven worth, according to word received by the local agency of the Pinkerton’s national detective agency, and as a result the Pinkertons are going to rest easy for the next five yeajs, or at least until they heard of his escape. Nolan, who has a history with as many thrills in it as a dime novel, was arrested on November 15 at Savannah, but was tried and convicted of misusing the mails at Omaha. When he finishes this term, local Pinkerton operatives declare that there are many other in dictments against him, which will be presented at the prison. Nolan Is said to be the head of a gang of forgers, who for a number of years have been working through the southwest, and this “mob,” alleged to have been conspiring with Ernest No lan, a city detective of Memphis, and brother of “Diggs,” planned to take Nolan from the United States marshal on December 9. The Pinkertons got a “tip” that the rescue was planned and the marshal took a circuitous route to Omaha, and did not pass through Memphis. However, the “mob,” headed by Frank Halloway, bank robber, was “flushed” by the Memphis police, and a gun battle in which ‘"Kenney’ Bergen, one of the gang, was killed, ensued. After his arrest, Halloway, who was himself wanted on several charges, ad mitted the plan to rescue Nolan, and implicated the convict’s brother, wh« has subsequently been discharged from the Memphis force. / Nolan, while waiting In the Savannah jail for the arrival of the federal offi. cers, nearly effected his escape, but was halted by a watchful turnkey. It was found that he had ir. his cell a re volver and a saw. It is alleged'that his wife, who was then in Savannah, passed the weapons into his cell.
