OAKLAND, Cal., Feb. IS.—Joaquin
Miller (Cincinnatus Heinie), “the poet
of the Sierras,’’ died Monday afternoon
in his one-room cabin, which he built
in the Piedmont hills many years ago.
The end' came at 3 o’clock in the after
noon with warm sunshine flooding the
room where lay the author of “Songs of
the Sunland.”
Death came slowly upon* the vener
able poet. He became unconscious
Thursday after a lingering illness,
which began when he was struck by
paralysis two years ago. His wife and
daughter, Juanita, were summoned at
that time from the east, and have been
with him since. The weakness of age
had come upon him and he rarely ven
tured from the Heights, as he called
his mountain re.treat.
WAS A ‘GREAT HOST.
For many years the Heights has been
the mecca for lovers of Joaquin Miller’s
poetry. He always received his visi
tors graciously and loved to tell in a
vein of quaint humor of the old, ad
venturous days which he memorialized
in his verses.
His faculties were undimmed until
almost the end, and he labored at in
tervals upon a poem which he said was
to be the mo^t momehtous work of his
life. He guarded the poem with N the
utmost secrecy and not even his wife
and daughter knew his subject. He
was about seventy years old.
From childhood his was a stirring,
eventful life. He was born in Indiana,
November 10, 1841, and was christened
Cincinnatus Heine. His father was of
Quaker stock. At the age of 11 young
Miller accompanied his parents across
the plains to the Pacific coast. The
family took up a government claim in
Oregon. Craving for adventure and
stimulated by stories of the gold
strikes in California, he ran away at
15 to seek his fortune. Already he had
participated in an Indian war, receiv
ing an arrow wound in the neck.
MARRIED CHIEF’S DAUGHTER.
In Siskoyou county, California, he
was adopted by a tribe of Indians and
married the daughter of the chief.
Shortly afterward the woman was killed
by settlers in a punitive expedition
against raiding redskins, and Miller re
turned to Oregon, where he studied law.
At this time he had begun to write
verse, contributing to various maga
zines, and he met and married Miss
Minnie Myrtle, a young Oregon poetess.
Three children were born to the couple
—a daughter, Maud, and two sons. The
latter ran away early in life and their
names were erased from the family
records.
Miller in 1866 went to Mexico, where
he joined Walker’s filibusterers and was
arrested. He obtained a pardon and re
turned to Oregon. In 1869 he published
his first volume of poems.
THIRD MARRIAGE.
Soon afterwards he was"- divorced
from his wife and went to Europe.
There he became popular. He always
dressed in a flannel shirt and knee-high
boots, a costume that the English of
that day are said to have expected of
Americans.
The poet returned to California in
1887, purchasing near Oakland the
tract he called the Heights.
Miller was also a playwright. The
most successful of his dramatic works
was the “Danites.”

NEW YORK, Feb. 18.—TUie eastern
railroads agreed today to arbitrate the
demands of the Brotherhood of Loco
motive Firemen and Enginemen undgr
the Erdmin act. This breaks the dead
lock.
/The decision of the roads was an
nounced shortly before 10 o’clock this
morning in an official statement isSued
by Elisha Lee, as chairman of the con
ference committee of managers.
PLANNED PRISON TRAIN
BEFORE JURY HAD CASE?

WASHINGTON, Feb. 19.—Central La-
tor Union of St. Louis has petitioned
congregs to order an investigation into
the charge that the railroads had in
formation several weeks in advance of
the conviction of the dynamites tried
at Indianapolis, even before the case
went to the Jury, and had already
planned to carry a definite number of
prisoners to Leavenworth from Indian
apolis.
The St. Louis memorial was based on
a letter alleged to have passed between
certain transportation officers of pail-
roads making arrangements for the
transportation of the prisoners even be
fore their cases were determined.
Senator Kern, leading counsel for the
defendants,' when seen today, said the
correspondence was in the hands of
Congressman Berger and he regarded it
as significant. Mr. Berger said he had
letters that tended to show the rail
road managers expected conviction, but
that the letters were worded in a way
that shielded the railroad managers
from the charge that they had definite
knowledge.
It was evident that Mr. Berger
thought an investigation would be fruit
less. The resolution for the investiga
tion is in the hands of Representative
Buchanan, of Illinois.
It may he introduced this week.

WASHINGTON, Feb. 19.—A report
charging the office of the first assistant
Postmaster General, Dr. Charles H.
Grandfield, first assistant postmaster un
der Postmaster General Frank C. Hitch
cock, with “gross favoritism” in the
av/arding of cancelling machine con
tracts to B. F. Cummins, brother of the
senior .senator from Iowa, is now being
prepared by representative McCoy, of
New Jersey, chairman of the sub-com
mittee of the committee on expendi
tures in the postoffice department which
has been conducting an investigation in
to that office.
• The McCoy report will not be made
until February 19, when the department
is scheduled to announce awards of con
tracts for cancelling machines -to be
leased by the department for the next
four years. The bids were opened Feb
ruary 3. It is the third time bids have
been received for the same work.
According to the report on each of
the two previous occasions when bids
were opened and rejected, arid new bids
advertised, the irregular proceeding wag
in order to favor the Cummins com
pany.
BAD BUSINESS METHODS.
The report will state in effect that
the business methods in the department
are so bad that no private concern do
ing business along the same lines would
be able to induce others to do business
with it. The report ’will make no
charge that officials of the department
were actuated by any illegal financial
consideration in favoring Cummins, but
it will declare that the testimony taken
by the sub-committee clearly shows that
these officials knew they were favoring
Cummins and discriminating unfairly
against other bidders, and against the
government.
By way of specifying the favoritism
charged, the report will declare that
when the department was contemplating
advertising for the leasing of the new
machines, B. F. Cummins suggested that
the cancelling machine committee of
department investigate the subject of
new machines before having the specifi
cations drawn.

BROOKS WILL GIVE
VETERANS EARLY PAY
QUITMAN, Ga., Feb. *19.—brooks
county is one of the counties in which
the veterans will be paid first this
year. Ordinary May is daily expecting
the check for $7,995 and is daily being
asked if it has come. There are 131 vet
erans and widows who receive a pen*
sion; 33 indigent veterans, 17 indigent
widows, 7 disabled soldiers, who get a
service pension, 31 widows under act of
1910 and 8 other widows.
Eighth veterans died last year and
four have died since January 1 this
year. However the pension check has
almost doubled in the last four years.
At that time there were only sixty-five
veterans and widows and the check was
for $4,000, while this year it lacks only
a hundred dollars of being $8,000.

WILMINGTON, Del., Feb. 19.—Bright
and early this morning the followers
of “General” Rosalie Jones, on the
march to Washington, were up and do
ing. While there was to be no continu
ation of the “hike,” there was plenty
of work on hand.
The suffrage demonstrators are pay
ing their way by selling buttons and
postcards, and Miss Freeman’s little
wagon, covered with streamers and
“votes for women” placards, was in
evidence throughout the business sec
tions of the city.
The day in Wilmington was devoted
to demonstrations in the interest of
the cause. There were meetings in all
directions -with speeches by the women
orators. The march will be resumed
tomorrow.
ROME ENTRIES CLOSE
FOR CITY PRIMARY
ROME, Ga., Feb. 18.—Entries have
closed for the municipal primary of
February 25. Seven aldermen are to
be elected, and there are twelve candi
dates in the held. Dr. L. F. McKoy,
from the Third ward, and J. W. Keon,
from the Fourth ward, are unopposed.
In the First ward, T. B. Broach is
opposed by John C. Printup.
In the Second ward the candidates
are Luke McDonald and P. J. Mullen.
In the Fifth ward, P. H. Vandiver, the
present incumbent, is opposed by E. L.
Pearce. In the Sixth ward Alderman F.
W. Copeland ha£ as his opponent R. M.
Johnston, and in the Seventh ward TV.
H- Collins and W. L. Daniel are oppo
nents. The campaign is proving a very
quiet one, and it is not expected that
more than 1,000 votes will be polled.

MACON, Ga., Fsb. 18.—W. F. Holmes,
one of the best known men of Bibb
county and for the past three years
city marshal of Macon, is alleged to
have been found short $7,300 in his ac
counts.
The reported shortage became known
to Mayor John Moore last Friday and
he Immediately asked for the resigna
tion of Holmes, which was given. Last
night city council held executive ses
sion when the alleged shortage was
made known to the aldermen by the
puted shortage with Holmes, last Fri-
mayor.
The first news of the reported short
age became known when citizens com
plained of being dunned by the city for
taxes when they held receipts for
money that had never been entered on
the city’s books. In discussing the re
day, he admitted to the mayor that his
accounts were short.
Holmes was born and reared here
and was known throughout middle
Georgia. Some time ago he offered
himself as a candidate for the office of
United States marshal here. Sympa
thy was expressed for Holmes by city
council at the meeting last night. The
office paid $1,600 annually. He has not
been in Macon since Sunday, having
left here for Atlanta, it is said. At one
time he was a partner with the mayor
in a warehouse company.

I have seen a great many letters from
women who manage their households

ROADS FINED FOR LACK

roads entered pleas of guilty in the
United States court yesterday to the
charge of failing to have safety ap
pliances on their cars. Penalties of $109
each were imposed by Judge Emory
Speer. The railroads were the Seaboard
Air Line and the Southern.
