ALBANY, N. Y., Sept. 25.—H. Cady
Herrick, counsel for Governor Sulzer,
announced at the outset of today’s ses
sion of the high court of impeachment
that the governor would cease hence
forth to exercise the functions of the
executive office until the termination of
his trial.
Further attempts were made today by
counsel for Mr. Sulzer to prevent the
story of the governor’s alleged misuse
or campaign contributions from being
told on the witness stnad.
Defeated yesterday by a vote of 51 to
1 on their motion for dismissal of the
Impeachment on the ground of its un
constitutionality. the governor’s coun
sel today offered a motion to strike out
the three articles of the impeachment
charging him with filing a false state
ment of campaign contributions and with
the use of funds for speculation in
Wall street.
The motion was prepared by D. Cady
Herrick, who argued that the alleged
offenses were not impeachable on the
ground that they were committed before
governor was sworn into office. Former
Senator Edgar T. Brackett was appoint
ed to reply in behalf of the assembly-
men.
His brief held In substance that the
acts of a candidate for political office
during the campaign and after he has
become an officer-elect are so intimately
connected to the actual holding of the
office as to be inseparable.
It'was believed today that the decision
of *the court on this question, whether
affirmative or negative, would make
possible the beginning of the actual
trial of the case tomorrow, unless some
thing unforeseen arises.

fragettes set fire early today to Seafield
house at Seaforth, four miles north
west of Liverpool, causing $400,000
damage. The members of the , “arson
squad" left a quantity of suffragette lit
erature bn the lawns.

TUCSON, Ariz., Sept. 25.—Dr Nich
olas Camarra, governor of the state of
Yucatan, Mexico, arrived here yesterday
on his way to Hermosillo, Sonora. With
other governors opposing the Huerta
central government, he said he would
confer with Governor Venustiano Car
ranza, of Coahuila, supreme leader of
the constitutionalist movement.

tive of Carranza. The proposed confer
ence at Hermosillo was said to be for
the purpose of bringing into closer rela
tions the various state governments al
ready in arms against the federal gov
ernment. *

ed that the constitutionalists would not
recognize any election condutced by the
Huerta government.

MEXICO CITY, Sept. 25.-—A north
bound train on the Mexican®National
railway has been dynamited by the
rebels near Vanegas, in the northern
part of the state of San Luis Potosi.
From the meager reports received here
it is believed that thirty were killed.
The train left here Saturday night, but
turned back at Vanegas on account of
blOwn-up bridges further south.

LAHEDO, Tex., Sept. 25.—Fifty per
sons were killed when rebels dynamited
a passenger train on the Mexican Na
tional railway, sixty miles south of Sal
tillo, Mexico, Friday afternoon, accord
ing to official reports to Mexican fed
eral headquarter® in Nuevo Laredo to
day. The train was then looted and
the surviving passengers robbed, it is
said.
Forty federal soldiers and ten sec
ond-class passengers comprised the of
ficial death list.

Flee From Mexico

WASHINGTON, Sept. L..—Today’s
diplomatic dispatches reported twenty-
eight American refugees dua in Texas
City tomorrow from Vera Cruz on the
steamer City of Tampico. The consul
at Tampico reported that since August
23 he had sent more than 400 refugees
to Laredo and Galveston and that only
a few more were expected to go from
Tampico. According to advices from
Torreon there are approximately 300
Americans in that city, many anxious
to leave. Many refugees are reported
en route from Durango to Nuevo Laredo
via Mexico City.

cans in State Convention

WASHINGTON, Sept. 25.—Republican
leaders in "Washington, identified from
the first with the demand for a Repub
lican national convention to revise par
ty rules ancl procedure, expressed strong
approval today of the platform adopted
yesterday by the New York Republican
state convention.
They believed the tesolutions adopt
ed by New York Republicans will have
a strong influence toward bringing about
a natipnal Republican convention early
next year for the revision of some of
the more seriously criticised rules of the
party.
The Republican national executive
committee, which last summer agreed
to call the entire national committee,
"within sixty days after adjournment of
congress,” is now being urged to take
action.

Editor The Journal: In yesterday’s
issue of The Journal, appeared a spe
cial telegram from Rome, Ga., in which
it was stated that Floyd county, pro
ducing 5,602 tons of hay a year, holds
the fifth place in rank in hay produc
tion—following Whitfield, Jackson,
Richmond and Walker.
The informatoin interested me, for I
have for years and years, through the
public press ancl by means of booklets
published and distributed at my own
expense, exploited the possibilities of
hiy-making in Georgia and the splendid
opportunity which has been knocking at
our doors and appealing to us to make
hay,a money crop.
Did you know that there are only
eight counties in the .state that belong
to what may be termed the "5,000 tons
class?” It is a fact.
Here are the counties and yield of
hay per annum:
Whitfield, 6,174 tons; Jackson, 6.088
tons; Richmond, 5,914 tons; Walker,
5.779 tons; Floyd, 5,602 tons; DeKalb,
5,337 tons; Houston, 5,208 tons, and Cobb.
5,108 tons.
Now, let us look into the question of
productivity—the yield per acre; because
that is a veery important matter:
DeKalb, 1.63 tons; Whitfield, 1.60
tens; Cobb, 1.24 tons; Walker, 1.13 tons;
Richmond, 1.08 tons; Floyd, 1.02 tons:
Jackson, 1.00 tons, and Houston. 71.8
per cent of a ton per acre.
DeKalb leads them all with a yield
of one ton and sixty-three hundredth.-
of a ton per acre.
We can raise choice hay in Georgia
in great abundance if we should choose
to do so. Why. a large portion of the
work on the average farm, throughout
the crop season, is fighting grass—
fighting crab grass, a volunteer so per
sistent it can scarcely be kept down.
The presence and the persistence of
"General Green” prove his availability,
with cowpeas, as a hay-maker of the
first class. There are, of course, bet
ter combinations but they must be
made: sow ten acres in cowpeas, wait
a short time; you will see crabgrass
breaking through the soil all over the
acreage.
Of the varieties of grasses adapted
to Georgia soil, limited space and time
forbid more than mere mention. Indeed,
they are known to us all. The thing
to do is to utilize them.
Land for a hay crop ought to be as
carefully prepared as for any other crop,
and the plants should be liberally sup
plied with food -t{iat will contribute to
their growth and development—in other
words, it is just as necessary intelligent
ly to use high grade fertilizers with a
hay crop as it is with corn, cotton or
other crop.
The facts, brought out by your Rome
special, can not fail to direct widespread
attention to the desirability of hay*
making in Georgia.

Speaker Alleges That Gunmen
Were Brought Into Capitol
to Overawe Him

NASHVILLE. Tenn., Sept. 25.—When
the legislature met late this morning
interest centered in the house, where
fusion leaders were prepared for a
strenuous fight on the bills making
saloons a nuisance and making the
Webb law effective.
They claimed a clear majority for
the bills and on all preliminary moves
planned. Factional feeling was high,
but so-called “gunmen,” prison guards
on the one side and detectives on the
other were not in evidence when the
session began.
Sensational charges of the bringing of
two suit cases of guns into the office
of the superintendent of the capitol
and of the presence of gunmen in the
hall of the house of representatives
were made yesterday by Speaker
Stanton, who took the floor on a ques
tion of personal privilege.
Following the charges of the speak
er serious trouble for a time seemed
imminent, and several inflammatory
speeches were made. At the after
noon session a motion to investigate
the speaker’s charges and to bring
Superintendent of the Capitol George
C Renfroe before the house was voted
down.
i , Representative McFarland, following
Mr. Stanton, after pulling off his coat
to show that he was not armed, de
nounced the man who "rams down
weapons in his pocket” and declared
that any man guilty of such a prac
tice was "a coward.”
Representative Lex Stone, a once-
famous football player, threw back his
coat to show that he was unarmed,
turned to Mr. McFarland and said;
"Any man who would call a set of
armed men to guard the door of the
legislative hall is just as much a
coward as the man referred to by Mr.
M cFarland.
"Why not send th e gunmen out and
let honest men have a chance,” shout
ed Mr. Stone. He declared that if the
house was to be cleared all armed
thugs should be included, and not just
those who side with the fusionists.
Governor B. W. Hooper sent a special
message to the house relative to yester
day’s exciting situation, declaring any
intimation that he was responsible, di
rectly or indirectly, for the presence of
anybody armed or unarmed about the
legislative halls absolutely false. He
added: "The efforts that are being made
by armed bullies, city detectives and
deputy sheriffs of Davidson county to
intimidate the advocates of law. en
forcement in the legislature are most
reprehensible.”
The presence of the "city guard,”
he said, was doubtless responsible for
the presence of friends of law enforce
ment members. The governor expressed
the belief that neither side needed out
side assistance in considering the bills.
A number of members spoke to ques
tions of personal privilege as a result
of the message.
TEN FIREMEN BURNED

ROME, ,Ga., Sept. 25.—Jefferson
Lemming, superintendent of the plant
of the Crucial Brick company, in West
Rome, was instantly killed this morn
ing by an electric shock from a motor
with which he was working. Lemming
was a large man, apparently in the
best of iya I th, and the current from
the motor would not ordinarily* b e suf
ficient-to cause death, but he fell from
the platform after touching it and died
instantly.

MILWAUKEE, Sept. 25.—Ten firemen
were burned, three seriously, here to
day, during- a fire v/hich destroyed
$75,000 worth of coal, docks and dock
buildings of the Gross Coal company.
The men were burned on the way to
the fire while driving over a viaduct
which was enveloped in flames.

NEWARK, N. J., Sept. 25.—Support
ers of Woodrow Wilson nominated
their candidate for governor at the
New Jersey primaries yesterday, car
rying every county excepting Mercer
and Essex. Fielders majority was
estimated at 20,000.
In Essex the Smith-Nugent assembly
slate was nominated over the Wilson
men and James R. Nugent was re
turned to the Democratic state com
mittee by a majority estimated at
4,000. Everett Colby, father of the
New Idea faction of the Republican
party, which later became the Progres
sive party in the state, won by 2,500
over Edmund B. Osborne in the guber
natorial nomination contest in the
Progressive party.
In the Republican primaries Edward
C. Stokes, former governor, was an
easy winner over his three opponents.

Four firemen were badly burned while
fighting a fire in the plant of the xj..
W. Johns-Manville company, asbestos,
roofting, etc., early today. The loss on
the building, which was partially de
stroyed, and stock is estimated at $85,-
000. Considerable damage was done by
water to the stock of adjoining con
cerns.

Nomination of Candidates for
Judgeships Is Chief Ques
tion at Issue

NEW YORK, Sept. 25.—The nomina
tion of candidates for chief judge and
associate judge of the court of appeals
was the formal task before the Repub
lican state convention that assembled
here today, but the party leaders plan
ned to make the gathering one of wider
importance than this duty signified.
It was the first state Republican rally
since the last state election and sev
eral new questions confronted the dele
gates. The answer to these will be
embodied in the platform that will be
adopted tonight.

SAN JOSE, Cal., Sept. 25.—Replying
to a telegram sent by Dr. Grgsby, of
this city, requesting protection of the
Mexican property of a land company,
Secretary of State Bryan has wired as
follows:
“Department has sent) appropriate tel
egraphic instructions to the American
consul at Hermosillo and consular agent
at Guaymas regarding desired protection
of your property.
“In case of damage to property, de
partment would use its utmost endeav
ors to obtain indemnity to which you
would be entitled by the rules and prin
ciples of international law.
"It has been frequently held that a
sovereign is not ordinarily responsible
to alien residents for injury they may
receive within his territories from in
surgents whose conduct he cannot con
trol.”
Dr. (.rlgsby, his brother, Harry C.
Grigsby and other officials of the com
pany, a San Juos corporation, fled from
Mexico in response to the warning of the
state department.

WEST POINT, Ga., Sept. 25.—The an
nual meeting of the Woman's Mission
ary Union of the Western Baptist asso
ciation convened here this morning with
approximately 100 deelgates in attend
ance. Nearly every church in the asso
ciation is represented.
Dr. A. Y. Napier, of Yanchow, China,
lectured last night. The convention con
tinues today and tomorrow. An elegant
barbecue will be tendered the delegates
at the City park Thursday.

CLEVELAND, Ohio, Sept. 25.—In
common pleas court yesterday two ri
val Chinese tongs bid up to $10,000 for
a Chinese restaurant which is valued
at approximately $800, and the prop
erty was sold to the On Leong tong for
that amount. The Hip Sing tong
withdrew when that figure was
reached. Until six months ago mem
bers of the two tongs operated the res
taurant in partnership and harmony.
A quarrel then grew out of the shoot
ing of a Hip Sing and police reserves
were called out to preserve peace. The
restaurant was then thrown into a re
ceivership until a public auction was
decided upon.

LONDON, Sept. 25.—Aviator Noel flew
in an "aero bus” for seventeen min
utes with seven passengers aboard at
Hendon last evening. This is said to
break the world’s record. The weight
of the pilot and passengers was 1,184
pounds.
