CARROLLTON, Ga., Nov. 10.—-As the! outcome of a prescecution which began j last summer when he was arrested at an ! Atlanta hotel in company with Miss Ef- ; fie McCalman, a pretty and well-connec- j ted Carroll county girl. Dr. M. W. Lewis, of this city 1 Saturday afternoon was bound over to the grand jury on a charge of bigamy, his bond being placed at $800. Emery M. McCalman, of Bowdon Junc tion, brother of the young woman who was arrested with Dr. Lewis, is the prosecutor. He charges Dr. Lewis is in reality Walter L. Franklin, a paroled convict from the Alabama penitentiary, where he served one year for embezzle ment and two years of a three-year sen tence for bigamy. After locating in Carrollton several years ago Dr. Lewis married a young woman of this place. For contratcing this marriage he is charged by Mr. Mc Calman with having committed bigamy in Georgia. Dr. Lewis vigorously denies the charges against him and contends Mc Calman is seeking to ruin* him because of the Atlanta episode, which he also de clares was an unjustifiable prosecution. At the hearing before a justice of the peace Saturday afternoon, Dr. Lewis waived a preliminary trial and made bond. His attorney, John O. WASHINGTON, Nov. 10.—Chief For ester Graves care-taker of the 165,- 000,000 acres of forest land owned by Uncle Sam, who has returned from s tour of inspection, visited virtually all of the 160 forests which are public property. Mr. Graves expressed pleasure over the excellent showing being made in fire fighting. This is a work, he declared which it will take years to bring to complete efficiency, but many millions of dollars worth of good timber already are being saved annually. Bell was made at 3 o’clock this morn ing when an unidentified person fired three shots through the window into the bed occupied by Mr. Bell. One bullet passed within two inches of the mayor’s head. Citizens of Milledgeville have offered a reward of $1,000 for the capture of the would-bo assassin. RETIRED ARMY OFFICERS MAY HAVE TO DO DUTY Change in Rules Providing for Their Use in Emergencies Is Recommended by Chief WASHINGTON, Nov. 10.—-Retired army officers may be forced to take command of troops in certain contin gencies if the war department induces congress to enact the necessary legis lation. The department would be em powered to place a retired army officer In command of a military post when a movement of troops leaves a post with out its garrison. The law at present provides that “officers retired from ac tive service shall be withdrawn for command,” but permits their assign ment to “staff duties not involving service with troops.” As the command of a post, even when its garrison is away, involves command of certain enlisted men of the medical and quartermaster corps as well as certain other enlisted men of the line, the proposed legislation would be necessary to overcome the present prohibition of duties “involving service with troops.” The change is recommended by Major General James B. Aleshire, chief of the quartermaster corps. In the event of its adoption retired officers proba bly would receive the active pay of their grades during temporary service. JIM CONLEY FACES TRIAL ON TUESDAY Jim Conley, the negro sweeper at the National Pencil factory, principal wit ness against Leo M. Frank, who is un der sentence of death for the murder of Mary Phagan on April 26. will be put on trial Tuesday before Judge B. H. Hill, of the criminal division of the Fulton county superior court. Conley is under two indictments, both charging him with being an accessory after the fact in the murder of the Phagan girl. These indictments are based upon his own admission that he assisted Frank in taking the girl’s body to the factory basement and that he wrote the notes found by the body. One of the indictments against Con ley was brought on a section of the criminal code which fixes the offense with which he is charged as a felony, the punishment being five years. The other indictment is based upon another section of the code which classifies the crime of an accessory after the fact in a murder case as a misdemeanor, the maximum penalty for which is one year. MACON, Ga., Nov. 10.—Accused of the murder of John Epps, seventeen years old, December 14, last year, Mrs. Ada Griffith, forty years old, wife of a prom inent farmer of Sparta and mother of five children, and John England, thirty years old, convict guard, have been ar rested and late this afternoon, after a court inquiry were bou-nd over without bail accused of the crime. Both are in jail at Sparta. For several weeks Macon detectives have been at work on the case. Not until a few days ago, however, did they feel safe in causing the arrests. Not until tonight did developments in the year-old tragedy leak out. It is alleged young Epps, the victim, knew the love secrets of the woman and the convict guard. MAN RECOVERS MEMORY AFTER OUTING IN WOODS TARRYTOWN, N. Y., Nov. 10.—A re markable instance of a memory prac tically lost for nine years now recov ered, is the case of Hyman Levy.
