The generals, led by General Salvador© Mercado, whose desertion of Chihuahua and whose statements that he had no money to pay his troops are regarded as a virtual breakdown of the Huerta dic tatorship so far as the north of Mexico is concerned, are headed for Ojinaga on the border. It is thought they will cross the river to Presidio. At Presidio they are expected to be ar rested by the United Stats military au thorities, taken to Marfa and thence to San Antonio. Their arrest on crossing the river would follow as a matter of course, under a ruling of Secretary of War Garrison. WHOLE CITY FLEEING. .With the generals are many subordi nate officers, about 2,000 federal regular soldiers and more than a thousand per sons of the wealthier classes of Chihua hua, who took to flight rather than face an attack by the rebels. General Pas- cual Orozco and General Ynez Salazai believed to be with Mercado, are under indictment returned in the federal court in El Paso for violation of the neutral ity law. Salazar is out on bond but Orozco never was arrested. Villa had little hope that his soldiers would be able to overtake the federals, who had left Chihuahua several days be fore the fact of their flight became known. That Mercado, after handing the port folio of state to Frederics Moye, civil governor ad interim, should on behalf of himself and subordinates offer to sur render and then fly to* the border, was regarded by Villa as an unusual pro ceeding. SURRENDER DISCREDITED. “The ohly place they will surrender will be in the United States,’’ said Villa to day. Carlos A. Heberlein, of Los An geles, who came from Chihuahua with the peace commission requesting Vil a to occupy the city, said that before the fed erals left, the penitentiary was emptied of all the political prisoners. “Everything possible was done by Gen eral Mercado to treat the citizens hu manely,’’ said Heberlein. ‘Their patience, however, was worn out. The people had been in a panic for so long they could en dure it no longer. All the money had been withdrawn from the city. There was no money to pay the troops and everybody lost heart.” Driven Out of Victoria City, Feds Make Tampico Capital MEXICO CITY, Dec. 4.—The seaport city of Tampico was today officially de clared the temporary federal capital of the state of Tamaulipas. General Anto nio Rabago, the military governor who was forced to abandon Victoria and who was erroneously reported to have com mitted suicide, has gone to Tampico un der orders from the Mexican government to re-establish his governorship in the temporary capital. The war department announced that General Arizmandi and other federal >f- ficers who fled from Victoria to Cerritos in the state of San Luis Potosi, had been ordered to reorganize their forces and to march again upon Victoria. This task had been entrusted at first to General Rubio Navarrette, who retreated to Monterey after his failure to relieve the hard pressed garrison of Victoria. On account of the nature of the organ ization and equipment as well as the long distances and broken topography of the country, the federal government will find it difficult to handle its various military expeditions without trains, now that the railroads have been practically deprived of oil for fuel by the producing compa nies. On some divisions of the railroad coal may be used but it is probable that all traffic except military trains will soon be suspended. Telegraphic communication along the National railroad has been re-established but it is understood this has been done with the consent of the rebels. They are known to dominate the line south of Sal tillo and to a point within seventy-five miles of San Louis Potosi. GIRLS DRAFTED FOR ARMY. Exeraordinary methods are being em ployed here to secure recruits for the federal army. Servant girls display marked caution when they appear on the streets as they are aware that scores of their fellow servants have been draft ed into the army as female soldiers. One trick utilized by the recruiting of ficers neted the federal army sixty-five conscripts in one haul yesterday. The bills posted outside a moving picture show announced that the exhibition was “for men only.” The little room was crowded some time before the perform ance began. A series of religious pic tures was thrown on the screen, the first being “The Virgin of Gaudalupe”—patron saint of Mexico. The crowd greeted this good naturedly, but when it was followed by two other religious pictures the men, who had looked for a different kind of entertainment, started an uproar. This resulted In a raid by the police who marched off the majority of the men to the barracks where they were at once placed in the ranks of the army. JIM TUCKER EXPECTED ' TO PLEAD SELF DEFENSE (Special Dispatch to The Journal.) ANNISTON, Ala., Dec. 4.—While the attorneys for the defense did not dis close their plea or offer any testimony in behalf of the prisoner, It was Indi cated at the preliminary hearing of Jim Tucker, charged with the murder of I. Wr Kemp, a well-known furniture dealer of Piedmont, that self-defense will be the exterminating circumstance pleaded when the case Is called for trial before Judge Thomas W. Colema, probably at a special term in January. The preliminary was held Friday afternoon before Probate Judge J. J. Arnold, who has ordered that Tucker be held without bail to answer to the grand jury. As was forecasted, Will Davis, his brother-in-law, who accom panied Tucker to Kemp’s store, was the main witness for the state; but he brought out in his testimony that when Kemp was called from the rear of the store by Tucker he had a knife and an orange in his hand, and it was indi cated that the defense will try to prove that Kemp made a threat with the knife. Davis is still in jail with Tuck er in default of a $500 bond, he having been ordered held t as a material wit ness. ROGERS FUR COMPANY* Copt. 134 **• STREET DROPS EIGHT FEET JUST BEHIND TROLLEY CAR CHICAGO, Dec. 4.—A downtown street caved in last night for a dis tance of 125 feet just after a crowded street car had passed over it. The motorman felt the car sinking beneath him and put on full speed. When firm ground was reached passengers and crew left the car and watched, the street level fall until it was eight feet below normal. The peculiar accident occurred on Randolph street, just west of Wabash avenue. Excavation for a new build ing, which included tunneling beneath the street, is believed to have caused It. A twenty-four-inch water main was broken by the tons of sinking pave ment, and a miniature geyser spouted. In a few minutes the depression was half filled with water, which also flowed into the sub-basement of the building under construction. ALBANY, N. Y., Dec. 4.—Attorneys for former Police Lieutenant Charles Becker, under sentence of death for the murder of Herman Rosenthal, the gambler, came here today to make what may prove to be the final fight for his life. A decision is not expected for at least three months. In lengthy briefs in support of their oral arguments, Becker’s attorneys maintain the former police lieutenant was not concerned in any way with tne crime. Their appeal embraces two major points. One is an appeal from the judgment of conviction of murder m the first degree and the consequent serftence of death; the other is an ap peal from the order of Justice Goff denj*1ng a motion for a new trial. THREE MEN ARE ENTOMBED IN GOLDEN CYCLE MINE CRIPPLE CREEK, Col., Dec. 4.—Two of the five men entombed in the Golden Cycle mine here yesterday by a cave-in, have been rescued uninjured, but the fate of the remaining three was unknown early today. Frank M. Woods, son of a prominent Colorado Springs mining man; Samuel Sorenson, of Cripple Creek, and Patrick Kavany, of Goldfield, Nev., are the men who, it is believed, are dead at the 800-foot level. The slide continued to move today, ren dering rescue work particularly difficult. INSANITY PLEA FREES MONTGOMERY LAWYER (Special Dispatch to The Journal.) MONTGOMERY, Ala., Dec. 4.—In two hours today the jury trying Will Joe Ful ler, a young attorney for assault with at tempt to murder, acquitted him by rea son of insanity. Fuller several months ago forced an entrance Into the county jail and shot Bernard Tarver, a negro prisoner. He was seeking revenge on an entirely different negro prisoner for the killing of his brother-in-law and shot Tarver by mistake. "Whether steps will be taken to send Fuller to the insane asylum is undetermined. CHOP SUEY WAR DECLARED BY JAPS AND CHINESE (By Associated Press.) CHICAGO, Dec. 4.—No longer will Japanese waiters serve chop suey in C-.icago’s restaurants. Yesterday the order was given in Chinese restaurants to discharge all Japanese employes. Chinese proprietors declared the Japa- nes have been planning the establish ment of rival chop suey restaurants. The contemplated chop suey war be came known when the Japanese at tempted to secure the services of a Chi nese cook. PRESIDENT WONT REST UNLESS CONGRESS DOES WASHINTON, Dec. 4.—Unless con gress takes a recess during the Christ mas holidays President Wilson will forego his planned ten-day vacation. The determination of Democratic lead ers in the senate not to agree to a re cess unless the currency bill has passed by Christmas was approved by the pres ident today and he let it be known that he would not leave Washington while congress was in session. ROBERT THOMAS SUCCEEDS DEPUTY MARSHAL GLENN VALDOSTA, Ga., Dec. 4.—Deputy U. S. Marshal L. H. Glenn, of Abbeville, who was appointed by U. S. Marshal Davis soon after he took charge of the office, has tendered his resignation, to become effective the first of December. Fcrmer U. S. Marshal Robert -Thomas, of this city, has been named as his successor. Deputy Marshal Thomas served under Marshal George White and is a very competent officer. MAIL CAR,ROBBED OF $87,500 IN BANK NOTES (By Associated Press.) VBRVIERS, Belgium, Dec. 4—A pack age containing $87,500 in German bank notes was extracted from the mail car of the express train which left Brussels for Cologne last night. The money had been forwarded by the National Bank ot Belgium to a bank at Go ogne and was placed in a safe, which was forced by the thieves. His bail was increased to $10,000 after a motion for a new trial had been filed. STUMBLES UNDER TRAIN AND LOSES HIS FOOT I ROME, Ga., Dec. 4.—O. B. Stillwell, a prominent real estate man of this city, had his foot cut off last night by a Cen tral of Georgia train. While endeavoring to board the train at the Broad street crossing, Mr. Stillwell stumbled over a spike near the track and was thrown tinder the train before he could recover his feet. Nellie, his mate, died early last summer and for weeks thereafter Prince, did not eat. The jungle animal’s fast lasted until could weather, but even though the beast began to eat again, Y\e continued to mourn for his partner. 100 DIVORCE CASES ON CHATHAM COUNTY DOCKET SAVANNAH, Ga., Dec. 4.—Savannah is in the midst of the fall terms of vari ous courts that sit here. The superior court, the city court and the United States court began work today on big dockets. The superior court will have an even 100 divorce cases to try before the term is ended. Atlan ta, and Paul Preston Moore, also of At lanta, were turned over the federal au thorities by the police Tuesday after being arrested In a southslde lodging house. Moore is charged with violating the Mann "white slave" avt. According to Information obtained by the polloe, Moore and the Bdmundson girl left Atlanta several months ago together and have lived together In Birmingham. 'When arrested Moore grew Indignant and exhibited a license. Investigation proved, however, that the license was for his first and only wife, from whom he had been divorced.
