AX ACT making appropriations to comply in part,
with treaty stipulations mnde with certain Indian
Tribes.
The Congress of the Confederate States of America
do enact, That the following sums be and the same
are hereby, appropriated out of any money in the
Treasury, not otherwise appropriated, for the objects
here after expressed.
CREEK INDIANS.
For perpetual annuities for the year eighteen hun
dred and sixty-one, (under article fiity-one of the treaty
made with the Creeks, duly tenth, eighteen hundred
aud sixty-nne,) twenty-four thousand five hundred dol
lars.
For interest for the year eighteen hundred and six-
ty-onc, (under article foriv-«ne of said treaty,) ami
arrearages of same on the sum of two hundred thou
sand Ooilure. in the Treasury of the United States,
and which should have been invested for educational
purposes, twenty-nine thousand dollars.
for annual provision for education for the year
eighteen hundred mid sixty-one, (under article forty-
one of said treaty.) seven thousand dollars.
For annual provisions, (under nrti, le forty-one of
said treaty,) for wagon makers, smiths and smith-
shops, iron and steel, and ngrirultural purposes, for

CHOCTAW AND CHICKASAW INDIANS.
For permanent annuities, and other amounts, pay
ments and allowances, due July first, eighteen hundred
aud sixty-one, to the Choctaws, (under article fifty-
three of treaty made with the Choctows and Chicka-
snws, July twelfth, eighteen hundred aud sixty-one)
ten thousund five hundred and twenty dollars.
For interest due July first, eighteen hundred and
sixty-one, on the sum of five hundred thousand dollars,
(under same article of said treaty.) held in trust for the
Choctaws by the United States, under treaty of Juue
twenty-second, eighteen hundred aud fifty-five, twen
ty-five thousand dollars.
For amount of advance agreed to be made to the
Choctaws, (under article sixtv-one of said treaty,)
fifty thousand dollars.
For permanent annuity, (under article fiflv-six of

on the investments and funds of the Chickasaws in the
Treasury of the United Slates, for the yea; eighteen

SEMINOLE INDIANS.
For arrearages due December thirtieth, eighteen

of schools, (under article thirty-eight of treaty made
with the Seminole*. August first, eighteen hundred

For arrearages due December thirtieth, eighteen
hundred and sixty., of annual provision for agricultu
ral assistance (under article thirty-eight of said treaty,)

ated the treaty. (under article forty-two of same.) five

CHEROKEE INDIANS.
For interest for the year eighteen hundred and six
ty one, payable January first, eighteen hundred and

the Cherokees, October seventh, eighteen hundred
nnd sixty-one/ and arrearages of same on permanent
general fund of the Cherokees, ns invested by the Uni
ted States, forty-three thousand, three hundred and/

two, (undrrsame article of said treaty,) and arrearages
of same on permanent school fund of the Cherokees,
as invested by the United States, seventeen thousand
seven hundred and seventy two dollars.
For advance agreed to he made to the Cherokees,
on account of their lands between the States of Mis
souri and Kansas, (under article forty-eight of said
treaty,) one hundred and fifty thousand dollars.
For moneys due the Cherokee nation, under the
treaty of eighteen hundred and forty-six. ns ascertain

For moneys due the treaty party of tin* Cherokee
nation, or their legal representatives, provided for by

OSAGE INDIANS.
For two smiths aud two assistants, (under article
twenty-three of treaty made with the Osages, October
second, eighteen hundred nnd sixty-one,) for three
months ending February eighteenth, eighteen hundred
and sixty-two, at seventeen hundred and ten dollats
per annum, four hundred and twenty-seven dollars
and fifty cents.
For houses, shops nnd tools for same, (under article
twenty-three of said treaty.) fifteen hundred dol
lars.
For seven hundred and fifty pounds of iron, and
eiglity-five pounds of *te< 1, and coah for the year
eighteen hundred and sixty-two, (under article twenty-

For the hire of one wagon-maker for three months

Section;}. And be it further enacted, That the sum of
three thousand five hundred dollars be, and the same is
hereby, appropriated out ofany money in the Treasury,
not otherwise appropriated, to provide for the contin
gencies of office, office rent, &.e, of the superiutenden
cy of Indian affairs, anil the contingent expenses,repain
&c, of the several Indian agencies, for nine months
ending February eighteenth, eighteen hundred and
sixty-two.
Section I! And be it farther enacted, that of the ag
gregate amount appropriated by this act, the sum ol
two hundred aud sixty-five thousand nine hundred and
twenty-seven dollars, and twenty five cents—being the
whole amount of arrearages, annual payments, and in
terest . due the saiil several Indian tribes, and to be due
by the thirtieth day of December, of the present year,
one thousand eight imndredand sixty-one, may be paid
in coin, if the President shall so direct. And the sum of]
eighty thousand dollars is hereby appropriated for the
purchase of coin, if so much be necessary.
Section 4, And be it further enacted. That the appro
priatioiis hereby made mnv, at the discretion of tin
President, be fortnwitli paid into the hands of the pro
per officers r agents of the Government and transmit
d, in order that they may be promptly paid over to
the said tribes of Indians, under the said treaties, when
the amendments made by this Government shall have
been ratified as parts of said several treaties by the
respective tribes.

AN ACT further supplementory To an act to an
thorize the issue of treasury notes and to pro
vide a war tax for their Redemption.
tier. 1. The Congress of the Confederate States
of America do enact, J hat the Secretary of the
Treasury is hereby authorized to pav over to tin
several banks, which have made advances to thi
government, in anticipation of the issue of Treas
nry Notes, a sufficient amount, not exceeding ten
millions of doilais, for the principal of Treasu
ry notes to pay the principal and interest
clue upon the said advance, according to the enga
gements made with them.
Sec. 2. The time fixed by tho said act, to which
this act is further supplementary, for making as
sessments, is hereby extended to the, first day of
January next, and the time for the completion and
delivery of the lists is extended to the first day of
February next; andthe time for the return of the
said lists to the Chief Collector is extended to the
first day of March next; and cases where the
time thus fixed shall be found insufficient, the
Secretary of the treasury shall have power to
make further extension as circumstances may re
quire.
Sec. 3 The cash on hand, or on deposit in bank
or, elsewhere, mentioned in the fourth section
of said act, is he/eby declared to by. subject
to assessment and taxation; and the money
at interest or invested by individuals in the pur
chase of Bills, Notes, and other securities for
money, shall be deemed to include securities for
money belonging to non-residents, and such se
curities shall be returned, and the tax thereou paid,
by any agent o('trustee having the same in pos
session or under his control. The term merchan
dise shall be construed to include merchandise
belonging to any non-resident and the property
sliaii be returned, and the t;sx paid by any person
having the same in possession as agent attorney
or consignee. Provided, that the wnrds ‘‘money
at interest, as used in the act to which this act is
an amendment shall be so construed as to in
clude all notes, or other evidences of debt bearing
interest without reference to the consideration of
the same. The exception allowed by the twen
tieth section for agricultural products shall be
construed to embrace such product only when in
the hands of the producer, or held f. r his account
But no tax shall be a-sesed or levied on any money
at inti res' whentbe note, bond, bill or other security
taken for its payment shall be worthless from the
insolvency and total inability to pay of the pay
or obliger or person liable to make such pay ment
and all securities for money taxable under this act
shall be assessed according to their value, and the
assessor shall have the same power to assertain
the value ot such securities as the law confers
upon him with respect to other property.
Sec 4, That an amount of money, not exceed
ing twenty five thousand dollars, shall be. and the
same is hereby, appropriated, ont of any money
in the Treasury not otherwise appropriated, to be
disbursed under the authority of the Secretary of
the Treasury, to the Chief State Tax Collectors
for such exp-nscs as shall be actually incurred
for salaries of clerks, office, hire stationery and
incidental charges; but the books and printing
required shall be at the expense of the Depart
ment and subject to its approval.
Sec. 5. The lieu for the tax shall attach from

AN ACT, for the recruiting Service of the Provis
ional army of the Confederate States.
Sec. 1. The Congress of the Confederate States
of America do enact. That Secretary o' War be and
lie is hereby, authorized to adopt measures for re
cruiting and enlisting men to? companies in ser
vice for the war, or three years, which, by the cas
ualties of the service, have been reduced by death
and discharges.
Sec. 2. Anil be it further enacted. That the Sec
retary of War be, and he is hereby, authorized to
detail the company commissioned officers for the
above duty, in such numbers and at such times
as. in his opinion, will bpst comport with tho pub
lic service: the officers thus appointed to enlist
and recruit for their reap ctive companies.

AN ACT in relation to taxes on property which
has been or which is liable to be sequestered as
the Property of alien enemies.
The Congress of the Confederate States of
America do enact as follows;
See. 1. That it shall be the duty of the Receiv
ers under the Sequestration Act, to pay all taxes
upon property of alien enemies, which is liable
therefor within their respective districts, out of
any funds in their hands as Receivers, said pay
ment to be charged to the account of the prop rty
upon which the tax has been paid; provided,
however, if it appear to any Receiver that such
property, in any case is not worth more than the
taxes for which it is liable, he shall report the fact
to the Secretary of (he Treasury whose duty it
shall be instruct the Receiver whe-ther lie shall pay
the taxes or allow the property to be sold for the
taxes.
Sec. 2. That the receivers bo authorized to sell
by order of Court, and in such manner, and upon
such terms, as the Court may prescribe, anv prop-
rty within their respective districts, which lias
been sequestered, or which is liable thereto, for
the purpose of raising money for the payment
of the taxes aforesaid
Sec. 3. That whenever a’Receiver has not funds
in hand over and above lyhatis necessary for other
expenditures, sufficient to pay aaid taxes, and can
not obtain the same by sale as aforesaid within
the time fixed for the payment of said taxes, lie is
lierebvjnithorized to give to the tax collecter -barg

precedent as provided in regard to payment in

Sec 4. That the .Secretary of the Treasury b«
authorized to make agreements with the several
States, counties, cities and tcAvns for the postpone
ment of the collection of taxes for which the prop
erty of alien enemies, sequestered, or liable to
be;and in case any one or more of the States counties
cities or towns consent to tho same be is hereby
empowered to issue certificafos for the amount
due, bearing interest at tho rate of six per cent
per annum which shall bind the Government to
pay the same, and which when paid, shall be char
ged to the Sequestration fund.
Sec. 5. That whenever the property of an
alien enemy sequestered, or liable thereto, has b -en
or shall hereafter be sold fur taxes, the Secretary
of the Treasury is hereby authorized with the as
sent of the State in which the property lias been
old, to redeem the same by the payment of the
urn or sums required to be paid by citizens in
such cases, or by the issue of certificates therefor as
lierein before provided, should lie. deem it adv sa
ble. and in all such case, such property shall go
to the hands ot the Receiver for the district in
which the same is situated and be held andaecoun-
ted for in the same manner as other sequestered
property; provided the amount of the icdeinption
hail be charged to the Sequestration fund.

First. Resolved by the the Congress of the Con
federate States of America, That the thanks ot
Congress are due, and are hereby tendered, to Col
Edward Johnson, and to the officers and men un
der his command for gallantand meritorious servi
ces at the summit of Allegheny Mountain, in A ir-
ginia. on the thirteenth by of December, eighteen
hundred and sixty-one, when for more than six
hours, they, with remarkable courage and constan-
ey, sustained an assault made upon their position
by fourfold their number, and finally drove the
enemy in disorder, and with heavy loss, from the
field.
Second. That the foregoing resolution be com
municated to said command by the Secretary of
War. and be made known in general orders.
