An Ordinance, To compel the owner or owners of low grounds within the limits of the city of Savannah, to drain and to place and keep the same in a dry state. Whereas it is expedient to.the health of the citi- zena of Savannah, that the low ,lunds or grounds within the limits of the city, should be drained and kept in a dry state, and whereas experience has shewn that individuals owners of said low lands, will not voluntary incur the expence of pla cing and keeping the said low lands in such a state as to render them innoxious. Be it therefore ordained by the Mayor and Al dermen of the city of Savannah in Council assem bled, and it is hereby ordained by the authority of the aame, that the owner or owners of low lands or grounds within the limits of the city of Savan nah, <t their proper expence shall before the first d y of January next, drain the said lands and place the same in a dry state, and shall make; dig, cut, and open such ditches, drains, and canals as shall be necessary for the draining the said lands and keeping the same in a dry state, and shall throw up, make and build atTch dams or mounds a* shall be fit, able and sufficient to resiBt and exclude from the said lanJs the waters from the inland swamp*, a reams and ponds, and also the'usual ebbing and flowing of the tide—and in case the owner or ow ners of any such low lands shall on the clay afore said, have failed or neglected to have drained the said lands or shall have done the same ineffectual ly, or shall have failed or neglected to open, dig, cut, and make such canals, ditches, and drain*, or to throw up, build or make such mounds or dnm* as shall be sufficient to drain and keep the same in a dry mate, and to resist and exclude from the said lame), the water Irom the inland swamps, S'reams, and ponds, aud also the usual ebbing and flowing of tbe tide there, and in such case it shall and may be lawful for the Marshal of s*id city and he is hereby impowered and required to cause the said low lands or any part of them to be drained in the mannev herein contemplated and to cause to be opened, cut and dug such canals, ditches and drains, us shall be necessary for the draining such low lands and keeping tbe same in a dry state and to cause to be. thrown up end made such mounds or dams as will in his opinion be sufficient and able to rpsist and exclude from the said lands, the waters of the inland swamps, streams, or ponds, and also the usual ebbing and flowing of the tide, and if any person or persons shall hinder, disturb or molest the said Marshal or the person or per sons by him employed in the execution of such his or their duties, such person or persons shall on conviction be fined in a sum not exceeding thirty dollars tor each and every such hindrance, distur bance or molestation. And be it further ordained by the authoritv aforesai i, that it shall be the duty of the inspector of Dry Culture from lime to time to visit and in spect the said low lands, and to report the situa tion of the same, and it at any time he shall report the same to be not well drained or shall report the ditches and dams to the same to be foul or requir ing repair dr the dams or mounds to be insufficient there and in such case it shall be the duty of the said Marshal and he is hereby required to notify to the owner dr owners pf such lands, the report of tbe Inspector, and to require him her or them to remedy the evil Compluined of within fifteen days thereafter, and in case any such owner or owners of such lands shall fail or neglect to reme tly the evil complained of within the time prescri bed, then it shall be the duty of the Marshal to cause the same to be done In like manner, as is herein btlore provided and the said owner or ow ners shall be subject to a penalty of five dollars for each and every acre so reported to be not well drained,and which he she or they shall so fail or neglect to drain and put in' proper order within the time prescribed, to be recovered in any court, having competent jurisdiction thereof. And be it further ordained by the authority aforesaid, that all sums of money expended by the Marsh i in the execution of the duties required of him by this ordinance, shall be recoverable by distress and sale of the goods and ohattles of such offender or offenders, or may be recovered in any court; having competent jurisdiction thereof.
