Oct 2 l!S4 « BY AUTHORITY. AN ACT. T O revive, amend nnd continue in force an act entitled un act, to extend to time of ta king out grunts on surveys made on head rights and bounty warrants. Be it enneted by the Senate and House of Re presentatives of tnc state of Georgia, in General Assembly met, and it is hereby enacted by the authority of the same, That where any person or id-sons have heretofore had surveys made on lead rights thereon have not been obtained, it shull und inuy be Inxvful for sucli person or per sons to upply for and obtain such grant or grants, at any time previous to the 25th of October, 1824, on payment of the usual fees. Sec 2 And be it further enneted by the author ity aforesaid, That where any surveys have here tofore been mude on head rights or bounty xvar- rents, and grants thereon Iiave not been obtained, such lupd snail not be subject to a resurvey un til three months from and after the person or persons claiming under the original surx'ey shall huvo been notified that such re-survey is intend ed to be made, and that in all cases, the persons claiming under the original snrvey, shall be en titled to tho preference of making such re-snr- vcy, until the expiration of three months from the. time of such notification: nnd in the event of there being no claimunt residing on or near the lund'to be thus resurveyed, such notiec shall be perfected by giving three months noticeffy pub lic advertisement, ut the Court House of the county where such land may lie, nnd in one of tbe public Gazettes of this State. Sec 3 And bo it further enacted, That it shall be the duty of all surveyors xvho shall make any such re-survey, to certify on bis return to the sur- x’eyor General, that, due notice according to the provisions of this act had been given, and no grant obtained on such re-survey shall be varied, unless accompanied witli such certificate : Pro vided, nothing in this act shall affect the rights of orplmns or perilous under the age of 21 years, and that all such persons shall be allowc’d one year after they arrive at the age of 21 yearn to take out their grants. Sec 4 And bn it further enacted, That it shall be the duty of the Governor to cause this act to he published in one of the newspapers in Mil- ledgeville, Augusta and Savannah, once in each month, until the expiration of the time appointed by the same for taking out grants. Sec 5 And be it tnrtlier enacted, that all laws, und purls of luxes militating against this act be und the same are hereby repealed.
