It appeared that the ship sailetl from Boston under the command of captain Tims. The seamen at first till-refus cd to serve under Knapp, but at length consented, with the exception of the six persons indicted, who refused to obey his o;ilots, and kept in a body. They were arrested, and on being brought before the District Judge, tlte law was explained to them, but they persisted in their refusal to serve under llietterv master. Judge Story instructed the Jury, that if they believed tlte evidence, the combination to resist the lawful orders of the master was made ont, ’and as the substitution of n new master did not release tlte seamen from their ob ligation to goon tlm voyage, the verdict must lie against them. They were con victed, and sentenced tn a fine of £5 each, jptd sixty days imprisonment.
