In his doclslon Judge Kano wont elaborately
into tho morits of tho Whoolor case, and took high
ground upon tho right of transit ol slaves through
Iroo territory. We copy tho following brief of his
argument from a dispatch in iho Baltimore Sun
of Saturday:
"Tho opinion of tho court is very alnhorato, re
viewing tho whole cuso nml ro affirming the lorm-
wr opinion. It is usactluj that the law ol ii'itioiis
guarantied the right ot iransit of slaves, and every
othor species of property through territory wlmro
slavery was not recognised. If the contrary prin
ciple was sacl toned, the mini might como wlion
the cotton ol Louisiana, tho rice of Carolina, and
the rum ol Now England would bo restricted from
rransportaiion without the hounds of tho Stntes
producing them. Iio maintained that tho Federal
Constitution recognised slaves as property, and up
to 1830 it existed in tho thirteen original Slates —
The suid Williamson’s dmy, then as now, was to
produce Jane Johnson ami her children. If the
petition r were led to abide the action nl the court,
sbo would have Ihe right to be hoard; hut, being
without its jurisdiction, the records ol tho court
cannot he opened for a stringer.”
As expected, the decision has raised a howl of
indignation among tho abolition papers nt tho
North. Greely rsves, snd says tho lime an joyfully
foreseen hy Senator Toombs, when ho should call
the roll ot his slaves on Hunker Hill momunont, is
approaching with rapid strides.
