that fifty thousand dollars had been left to the lat

Devil may yet be able to find Mathew Davis and

Thomas Wright, a f. ra. e., was arrested
yesterday morning, by eonstnble Blnnce, while in
the met of stealing cotton from the yard of the
lower hydraulic press, and taken to jail. Wright
ia an old offender, this being the third time within
the past few months that be has been arreetod for
the same offence. He will have an examination to
day, before Justico Felt.
J. H. McArthy, charged with buying an J
receiving stolen goods from uegroos, also for trad
ing with them without the consent of their
owners, was arrested yesterday, and taken heforo
Justice Staley, who required him to give bonds to
the amount of $400 in each caso- In default he
was committed to jail.

Bark Felicity.—The cargo of the Br. bark
Felicity, (which put into this port in distross a
short time ago, bound from Kingston, Jamaica, for
Liverpool,) has been discharged and put on board

C. Fraser A Augustus P. Welter have entered into

is hardly necessary that we should trouble our
readers, at this time, either with a comment on
what has already been done, or speculations in

and we have seen no resson to ohange them. We

sole responsibility will rest upon those who have

The South fats no practical interest in the de
claim of this question which sho docs not hold in
commou with every other portion of the Union.

tained. The existence of slavery in Kansas is a
I ope that has long since been given up in despair,
by those who entertained it most fondly. For our
selves. wo never cherished such a thought, or laid
that flattering unctioufto our soul. From th* he.
ginning, we regarded the strugglocf tho South in
that Territory n* one against wind and tide, that
was obliged to result in disappointment and cha
grin. We made up our minds, early in the light,
to be disappointment by nothing. There aro.thcn,
hut twoeunridcrations that influence us in reference
to this question, and to wLicb, we think, the cn-
tiro interest of the South is confined: First,
the peace and quiet of tho Union—the restora
tir.ii of frieudly and patriotic feeling by n
prompt and final settlement of the slavery agi
tation, and all questions thitt contribute ti*
keep up tho strife. A* heforo stuted, all
portions of the confederacy aro as much interested
in this issue as ourselves. The second considera
tion, is tho non-interference of Congress in mat
ters that do not constitutionally belong to it, hut
belong exclusively to others ? The constitution ol
Kbii sus having been framed iu pursuincoul law.and
passed upon and approved by tho lawful authori
ties of th it Territory, Congr«*a bn* no right to
ioterp .se nn objection either to it* matter or th*
formalities that characterised its adoption, Coueod
ing that the government formed by it is a republi
can government. It certainly has no otislitu
tional right to force » new State to a reference of
her constitution for popular ratification, when
the sovereign people thereof have other
wise ordained it. More than u majority of the
constitutin'.* of theso States Intvo never been be
fore the people; the conventions that formed them
were held to ho clothed with popular power, *nd to
ho competed! for final action in the premises. Ii

want of form in tho manner of its adoption? Wu

up a different rulo, we consider it guilty of a
usurpation—an invasion of a great republican prin
ciple, which, if coupled with, an interest, w-nl I
justify tbo sternest resistance on tho part of| those
whoso rights may lie overthrown. Luckily for tho
country, the coineideneu does not exirt in the cate
before u*, or in any probable aspect that it is dei-
tiued to ussurno.
But we still hope for the admission of Kansas
•t thu present session,and without ooy lUHiuiptirm
of powers thnrtlo not belong to tbe federal legis-
ture. The rejected substitute wa* doubtless sent
hack to the ilouso yesterday for u re-consideration,
und wo sincerely trust thut some plan may be de-
visid f»r di-po-ing of tbe questiuu to thu sati-fuc-
tint of all parries. Our despatch—which has not
yet arrived— may bring u* the initiatory steps of
a reconciliation upon a fair and equitable basis.
Wu nre somewhat encouraged to hope that tiic Nesi-
ute's bill may yet puss the House. Many, on tbe
*pjt, think it by no means .improbable, and th*
Washington .Star of Friday expresses its unshaken
co nfidence iu such a result. It say* : “ Wo have
persistently ustured the AVer’s reader* that it i-
ik-stiuc-i to pass the House a* it was originally sent
down from thu Senate. The legislation of yester

“Section 1. That the State of Kansns he and is
hereby admitted into tho Union on an equal foot
ing witli tho original States in all respects what
ever; but iriit-inu.h as it is greatly disputed whoth-
tho constitution with which Kansas is now ad
mitted was fairly made, or expresses the will of
tho people of Kansas, this admission of her into
liiu Union us u State is hero declared to ho upon
this fundamental condition precedent, namely:
That the said constitutional instrument shall be
first submitted to a vote of the people of Kunsas
and assumed to by them or a majority of the voters
at an election to he held for the purpose ; and ns
soon n» such assent shall he given and duly tnnde
known to the President of tho United States, ho
shall nnnounco thu same by proulaiuation, and
thereafter, and without any further proceedings
on thu part of Congress the admission of the said
Stnteof Kansas into thu Union on an equal foot-
ing with tiio original Status, in till respects what
ever, shall ho cotnpleto and absolute. At tho said
election the voting shall ho l»y ballot, and by in
dorsing on his ballot, ns each voter may please
“for the constitution” or“ngnin*t tho constitution”.

out the clause whioh provides that “no person ex
cept citizens of the United States should he per
mitted to vote nt any election”—and suhslitute"«l|
white male inhabitant* of tho said Territory over
twenty one years of ago who aro lugnl voters under
tho laws of Kunsns, and none others sbull be per
mitted to vote.”
