Captain IIartstkinb.—This gallant naval
officer who has been on furlough for some time,
on hearing of tho probable difficulties with Grout
Britain, immediately proceeded to Washington
and roportod himself to Soerotary Toucy us ready
for duty. His thoroughly tried qualities recom
mended him to an oarly appointment, nnd the
Sioretary at onco plaood him in command of tho
aorew-tondor Arctic, of 233 tons, now lying at tho
Brooklyn Navy yard. Sho is to bo fittod out at
once and procoed in soarch of tho notorious Styx,
and see that our commerce is protected. It would
be a singular coincidence if tho sword which was
presented to Captain Hartsteine by the Queen of
England should bo drawn for tho first titno in
battle in defence of our country agtinct hor forces.
The Water WileA is also to go on the same cruise
under the command of Oapt. John Rodgers.

Mr. Editor I notice the movements made
in St. Marys, relntivo to a Hallway oonnoo*
tlon with Savannah. I shall bo ploased, ns will
every one, to seo tho work done, nnd it would bo a
graceful aot on the part of tho State to lend aid
for that objoct to a quarter which has hitherto
received so little of tho publio oonsldoratlon,
though contributing during tho long years past so
largo n quota to the publio interest nnd welfare.—
CitUons of Savannah—proverbially liberal—with
a mint of money alrondy in non-paying roads,
will subscribe, if tboy think proper, to a St. Marys
branch, but I protoit against any further subscrip
tion for this or for any other similar purpose, by
the corporation of tho city. With tho best wUboi
to evory part of the State soeking a connection, it
is time to arrest for the next thirty yoars those sub
scriptions. This fooling has now so far gnlr.od
ground in this community, that thoro is not the
most remote likelihood of such a thing; but If it
Is over started, those who originate It will oucoun-
tor an opposition which they little anticipated. If
that time should come, the non-ooateuts will claim
the right of being heard.

Orleans in the matter of the Tebuantopeo isthmus
road. Look nt tho map and you will boo that from
New Orleans to Ran Francisco, by tbnt Isthmus, is
2,500 to 3,000 miles nearer than by Panama; while
Now York passengers by tho new upper routo,
through Virginia, oto., will bent thoso by Yuloo's
road to New Orleans nt least two days. Nor can
it bo said that cotton witf bo received hero from
Fernandina by tho projected road. It and other
merchandise can be carried for half the prico by
tbo steamers already running.
I concur with thoso who believe thnt wo have
vastly overdone railway constructions. I do not
think the Waynesboro* road was a necessity. With
tho river competition—though un excellent uni
economically administered road, it has paid, I
think, butouo dividond of 2} per cont., and it is
destined to be injuriously ntVuoted by Drayton's
road. Look at the Athens nnd Warrunton
bronchos uf the Georgia road, tho MiliodgevUio
and Eatonton of the Central, tho Opelika,
Ac., for tho proof of tho correctness of my
observation. It is quito titno for all concerned to
calculate their resources, and seo bow much tuoro
money they can afford to sacrifice without any re

files, wo ure frequently struck with the ingenuity
of advertisers to bring thoir wants before tho pub.
lie. In no city is this idea reduced more to a soi-
•ioo than Philadelphia, and in proof of our state
ment we publish n few extracts:
A Singular Discovery.—A gentleman noar the
city, while engaged in boring an Artesian well,
having reached a distance nt nearly seventy feet
from the surface, the auger canto in contact wlin a
hard substance, on penetrating w'iiob, pardons of
a box, the joiner work of which was closrly dis-
corniblo and brought to tho surf ice, there were
also several scraps of newspaper, one of which
contained tho following admonition: "Buy your
clothes of, &o.
A Reporter in a Fix. — \ reuortor was p litoiy
received at tho sossion of the C ithulio Provincial
Council, in Cincinnati, spread Ida noto-hook and
prepared to take notes of their proceedings. Ills
report was very brief, for their proceedings wore
conducted in Latin. Ho muruly wrote a recom
mendation to the readers of the newsp ipers he
represented, to buy all their garments, Ac.
These nro nil vory well in their way, but when
tho store is attractive and the goods woll selected
as tboy will bo found at the splendid establishment
of W. 0. Prico, cornor of Bull and Bay streets. It
needs but the simplo announcement that ho has
moved his stock and is prepared to funiLh everj
style of garment on tbo most reasonable terms to
bring him crowds of customers.
Dwyer’s Elocution.
Mrs. Dwyer, the widuw of perhaps the mostom"
inent elocutionist that we have ever had in thi 3
country, is in this city, for n short time, for th®
purpose of selling copies of n email volumo on elo“
cution, published by her husband just before his
death. The work is the sole leguoy he was able to
bequeath her, and our citizens will be bestowing a
doservod tribute upon departed worth as well us
obtaining a very interesting book, by patronizing
tr.o lady in her calls. Several gentlemen in tills
city were pupils of Mr. Dwyor. who will over re*
member him with feeliugs of pleasure and gratis
tude.
Tho New Orleans Picayune, some months ago
used tho following language, which we willingly
copy: "Mr. Dwyer was a graduate of Trinity Col
lege, Dublin To tbo taste and manners of a gen
tleman, be added great cultivation and intelli
gence, and he was the hest roador wo over had.
Ills widow, in offering his works for sale, is pursu
ing her only means of livelihood, and wo sincerely
trast sho may be as successful in our oity us sho
bau been in others.”—Daily Wisconsin.
Mrs. Dwyer is now in tho city, and will call upon
our oilizens for tbo purpose of disposing of her
books. She bns a lung list of nutugrnphs com.
prehending some of the most prominent men in
this country, who testify to the value of tho work
of her deceased husband.
Swan A Co.—Francis II. G'ane, E.-q., in a letter
to Wm. R. MoLaws, Eiq., says:—"I have no doubt
that all tho proceedings of Swan A Co. are illegal,
and that all the persons in your city who nro en
gaged in this business are Hablo under tho pro
visions of that statue.”
The Atlantic Carle.—Considerable nppreben-
aion was felt ns to the power of any battery to
send a wave of cleotrioity through the length o
this cable now 2,600 milos long. This difficulty,
wo are happy to Blate, is about to be overcome by
a Mr. Hughes, an American, who hns suenrded
in printing through it, though as yet quite slowly
no is making some alterations in his machinery
by which he hopes to increaso the speed to u sat
isfactory point.

authorities as a swindler. It is to be bopod thn
they will hasten an operation which would so much

The guardian of some manumitted slaves in
Virginlo, applied to Joshua Giddings for informa
tion ns to the best plaoe they oould be sent; he re
oommended a certain county in his own State
Ohio. Upon hearing of it, a paper published in tho
oounty selected, remarks:

Man Over Niagara Falls.—A man wont over
the Falls of Niagara on the 10th inst. Ho oame
from the Canada stdo at Chippewa in a sail boa
nearly to the Amerioan shore, and was in tho aci

York Herald of the 23d, oopias of the Now Or

over five days in reaching us. This is the quick

Mr. Editor:—As a question of groat impart-
once is to come before tho Common Council of our
C'ty to-night, for its decision, I think it due to iho
citizens generally, thnt a futl statement of tho cuse
bo laid before them:
At tho May Term of tho City Court of Savan
nah, just adjourned, Christ'phor Hussey, 2.1 Lieut,
of the Mounted Police, was arraigned on two bills
of indictment, in which ho was charged with hav.
ing, sometime anterior to tho Court, committed an
assault and battery on tho persons of a Mr. E.stuy
and a Mr. Woods. Tbo particular circumstances
of the assaults, it is nut necessary to state. Mr.
llussoy, represented hy able c»ua<ol. plead not
guilty to b itli indictments, nnd pnt himself upon
hit country. IIo soloeted hf.-t jury—th a uvideneu
was hoard—his counsel mala a fall defenoo in
otoh case—and in each tho jury roturuo I a verdiot
uf guilty. In pronouncing sentence in pursuance
of tho verdicts, Judge Miilon fined Mr. Hussey one
hundred dollars in each case. This is tbo whole
story.
At tho last tnoHting of Counoil a resolution was
introduced, tho object of which was to take from
the City Treasury two hundred dollars and pay tho
two fines imp-isod ou Mr. llussoy in the two cusos
above named. Tbo snbjeot was thereupon referred
to a committee of throe, who should report at tho
noxt meoting of Council, to be held to-night, whether
or not the floes should bo paid by tha oity. This
is ilie feature in Mr. Hussey’s oaso to which I wish
to call publio attention:
What is tho effect of this proceeding on tho part
of Council? What is It tuntumont to? And to what
will it load ?
In undertaking nn investigation of these oases,
Council are assuming to themsolvos the power and
authority of a Court of Errors. They are review
ing the solotnn judgment of a court, which by thoir
notion, they silently rank as a court of inferior
jurisdiction. Thoy nro saying to tho Oity Court
of Savannah: you may hoar causes and dooido
them, but you must bear in mind tbnt we are a
higher tribunnl, and all errors oommittod by you
can be redressed before us if tho party see fit to
: take an appoal—or n writ of error. They nro sny-
ling ovon inure than this—they aro saying that tho
juries in theso oases may have convictod Hussey
on insufficient proof; th it porhaps ho was not guil
ty under tho ovidonco—wo will look into this mat.
tor—wo will see whether tho witnesses sworo false
ly or truly—and should wo find by the evidence,
thnt Iiusscy did not beat or maltreat tho parlies ho
arrested, wo will in effect set aside your verdict by
extracting tho sting—by payiug out of the rovonuo
of tho oity, whether raised by taxation or other
wise, tbo two hundred dollars which you have so
wrongfully made -dr. llussoy liable to pay by tbnt
verdict.
Further: Council havo already constituted
themselves a Court of Errors, by appointing n
oommittoo to examino into tba eases. What is tho
investigation for if it Is not to see what wrong
has been done to llussoy ? If it doos not mean
this, wbat doos it moan ? Du thoy intend to pay
tho fines, if thoy ooneludo no wrong has boon
(lotio ? Certainly not! But what also do thoy intoud
if thoy oonoludoho was not guilty of tho charges
in tho indiolmonts ? This is the matter directly
undor consideration. And how can thoy investi
gate tho matter to ooms to any conclusion
without going behind tho verdict of tho jury?
And how oan thoy do thnt without assuming to
reviow that verdiot—to see if it bo erroneous—and
by paying tho fine, to declare that it is erroneous
and falso? Thoro is no osoapo from the conclu
sion. Couucil now, at this moment, by tbeir com
mittee, are sitting in judgment on tho wholo pro
ceedings in Hussey’s cases buforo tbo City Court.
But again, to what doos this prooeoding lead ?
What is to be tho offuot of the payment of those
linos by Counoil? Why, not only to render the
verdicts and judgments roadurod in tho City Court
nugatory nnd a faroe, but also to say to ovnry of
ficial and subaltern who may bo so fortuoento ns to
hold office undor Council: you may arrest persons
as you ploaso—boat thorn—ill uso thorn ns your
passions may prompt you; and if you nro arraign
ed before his honor Judgo Millen, nnd oonvietod,
we will overhaul tho verdiot of tho jury—we will
put bis honor Judgo Millen to rights, nnd toaoh
thorn you are not to be fined bsoause yon are an
officer of the city !
Is not this tho plain English of tho notion of
Council. And if it bo, who does not foresee tbo
llconso for lawlessness, and oppression and cruelly
it will give. F it what will an offiuor of the oity
care for convictions and fines, when be knows the
ooffers of the town aro at his baok to pay his pon-
allies? What dlfforenoo to him if bo be fined a
thousand dollars. Tho oity father* will foot the
bill and make tho very jury and Judgo pay thoir
proportion of the fino out of the taxas levied, from
their hard earnings I And this is tha precedent to
be set op in Savannah I This is tbo standard fur
police duty and circumspection!
j|Uut this is not thoondyot. Supposing it wore
true that Council had tho right to review the solemn
judgments of tho City Court, nnd were to find thnt
Uujiey was shamefully convicted by perjury or
bribery, or otherwise, ovon then what right have
they to take money from tbo treasury of the oity
to pay tho flnea Imposed on llussoy? Whoso
umnoy is it thoy are oouslderlog about squander*
ing In this mannor. Is it theirs? Nut a dollar of
it. Thoy are the truetees of thnt fund, and are
bound in duty and by tbolr onthe to apply It to tho
purpoeos for which it was raised. Thoso purposes
are to carry on tho oity government, to pay neoas-
•nry dobts, to defray useful expenses. That fund
is raised by taxation, and tho tax payers have a
right to havo it applied to their bonulit, and not
thrown nway nt will on favorltos.
But lot us look for a moment at tho reason nsslgn-
ed by Cuuocll, or tho Committee, for this investi
gation. It is that Mr. llussoy is nn officer of the
city, and must bo protoctoil in tho discharge of his
duties f Evory man should be protected in tho dis-
ohargo of his duties, and tho laws of Georgia will
protect him as long as ho koeps within tho bounds
of duty. And if Mr. Hussey in arresting a man
should go beyond his duty, and unnecessarily nnd
wilfully boat him, is ho entitled to more protection
than any ono olio, simply because ho is au officer
of tho oity ? Why so ? Is he not paid for his official
services? Doos bo not have full compensation for
tho performance of his duties? If not, ho is nut
cntnpollod to hold his offico. Ho oan resign at any
moment.
Dut, It Issal<l, Hussey was doing bis duty. lie whs
indicted for mV doing his duty—for beating two persons
unlawfully ; am! Iho (act that be wns arresting them U
uo excuse for such treatment. If It wan, he had every
uppoitiuiity to make that defence before the Jury. If it
was not, on what show of reason can Council seizo on
that fact as a ground of excuse I Uutltlssald that one
of the witnesses un whoso testimony llussoy wns con*
victud, bus, siucu the trial, boon nrreitud on a charge of
perjury commuted on IUb trial. There are three answers
to tills. First : the person who swears that tho wit nets
Kitey committed perjury, has mado two separate util la-
Vita about the arrest made by Hussey, which are direct.
/.V contradictory of each other. Secondly : tho charge ot
perjury I* no proof of it; aud thirdly . If It were true
that Kstcy did <woar to a lie, Council have nothing to do
with the matter. They cannot try Kstey for tho of*
fsuos. till t if they pay Hit no)’s lines o u this ground,
they will lu effect try him, for they will proceed on the
»u|ip-sltlon that lie hai'iitwn to a lie. This thoy Lave
no right to do.
Tho Importance of this question Is not tho value of tho
two hundred dollars. If tho fiuoa wore tun thousand
dollars, and were erroneously imposed, and Council had
a right to remit the fine or pay it, there would bo nothing
seiIons in tho caae. Hut tne importance Is soon in th®
ahioluto wrong of the proceedings, and the precedent to
beset If llussoy'alines are to ho paid, why shall not
tho ttnoi of any, and all officers, ho paid hy thorlty?
And If the officers, why net tho fines ofcitfzensf There
is no possible distinction. Nor Is there nny more reason
why the city should not pay the debts of Hussey, if ho
should happen to ho swindled or defrauded. And why 7
Because Council say they will pay these fines un tho
ground that another man has peijuml hlm-elf, and hy
tills villa!uy caused Hussey to be fined. It is hoped tbnt
reason and wise counsel will preside over tho action of
our City Fathers, and came them to dismiss Ibis dan
gerous subject troui their consideration.

and toasted on every occasion with tho greatest
• irdiality. The last account of his being lionised
is in tho Times, ot the 7th inst., tvhioh gives nn
account of a dinner given to him by tho Army
and Navy Club, from the published account of
which wo take tho following extracts ; they nro in
strikiug contrast with tho previous reports we have
received of tho anticipated conduct of tbo English
people towards him :
