I desire to express myself briefly with
regard to the recent liquor law enacted
f .r the benefit of Appling, smoeg other
counties. My reason for requesting
this space is, that you, perhaps, as well
as others view tha operation of the more
recent act differently to myself. In
other wor ts, some, and with apparent
reason, have conceived the idea that the
late act entirely repeals the former;
that now it is entirely unnecessary to
obtain a consent of two thirds of the
free-holders residing within thiec miles
of the place vrhero the seller ptopo.-vs
to sell. I maintain that to comply wi h
the law it is absolutely necessary, aud
he or they that attempts to sell it with
out such consent violates the law an i
is liable to be indieped and punished for
every drop they sell. ini', the iatii
act, as all acts du, states that this iu\v
repeals conflicting laws. But there is
uo conflict between tLe two a.tq and
even it there w a, no law, under our
constitution, .an lo reported bv a mere
reference to Hint law But tiio law
sought to he amended or repealed must
he distinctly described. In this case,
no reference, no description of tho above
law made, litnco, to repeal it in such a
manner wotill be unconstitutional.
Further, the late : ct was not intended
as a repealing measure. Hence the
two thirds majority law is still of force,
and will remain so until repealed iu the
mann r above suggested.
