Sec. 1. Be It ordained by the May or and Council, of the City o.’ Alba ny, and It Is hereby ordained by-the authority of the same, that in addi tion to the powers and privileges heretofore granted to said Railway Company, the Hollowing additional powers and privileges are hereby granted: The Albany & Northern Railway Company shall have the right and privilege, of constructing Its, track from the Union. Pnssenger * Depot along Front street, to (ho North aide of Pine as slial be hereafter set forth In the plans and specifications provided for In this ordinance, and to construct said track from the North side of Pine street along snld Front street south to the Southern limits of the city, occupying a space fifteen (16) feet wide Immediately west of the center line of said Front street. Sec. 2. Be It further ordained that this ordinance as adopted, and the powers and 'privileges therein set forth, are granted to snld Albany & Northern. Railway Company with the following conditions and restrictions, to-wlt: That said Railway company shall not begin to exercise the aforesaid powers amt privileges until il has agreed In writing to the conditions which may ho^ Imposed upon it In writing by the Mayqr and Council: nnd agreed to and accepted plans and specifications, showing tho manner ami way In whloli said (rack shall lie laid nnd maintained which may ho hereafter adopted by said Mayor and Council, ami further, that said Rail way Company shall furnish said plans and specifications. Sec. 3. Be It further ordained, that said Railway Company, .before work is commenced to carry out said plans nnd specifications, shall furnish good and sufficient bond to the City of A1 bnny, to be approved by Mayor nnd Council, to Indemnify the City of A1 bany against any loss through dam age which might arise or result to adjoining property, nnd to Indemni fy all adjoining property owners from any loss or damage which might arise or result from the carrying out of said plans and specifications, which bond shall give said property owners the right to sue thereon In the name of the city of Albany, for their use, for such damages, and that said bond shall ho considered cumulative to any other , right or cause of action which said property owners might be 'em titled to against said Railway Compa ny, by reason’of the carrying out of said plans and specifications. Sec. 4. Be It further ordained that said plans and specifications shall he submitted to the Mayor and Council by said Railway company 1 within five months from the adoption of this or dinance, nnd work to carry out said elans nnd sneelflcntlona after their eeeontnece by tho Mayor nnd Connc'l shall he cnimoneed within six months from the date of acceptance; else this ordinance becomes null nnd void. Sec. 5. Be it further ordained that Raid Albany & Northern' Railway free ns ny shall, under no circum stances, commence to exercise the powers and privileges conUniplnted In this ordinance until said Company lias agreed In writing to* surrender and waive all the powers nnd privil eges previously conferred unon It by the city of Albnny In so far only as relates to said railway’s powers nnd privileges > heretofore grnntod to run nnd operate steam cars, onglnos or dummies on Washington Btreel, and further agrees in writing to run on said Washington Street In the future nothing but cars propelled by electric Ity, cable or horse power and to run and operate such cars only for the • transnortatlon of pas sengers, provided that the. Raid railway company shall hnvo the right, power and privilege, as here tofore granted, to run and operate steam oars, engines nnd dummies on Washington Btreet from the’ north side of Commerce street south along said Washington street upon Its preR- ent right of way, and unless said agreemen, surrender and waiver, as herein contemplated, Is ton dated with in thirty days from th acceptance of •he above stated plans and specifica tions, tills ordinance shall become null and void. Sec. 7. Be It. ordained by the Mayor and Council, of the City of Albany, and it is hereby ordained by tho an thorlty of the same, that in addition to the powers and privileges here tofore granted to said Railway Com. pany, the following additional pov ors and privileges are hereby granted: The Georgia Northern Railway Com pany shall have the right and privil ege of constructing Its track from the Union Passenger Depot along Front street to the North side of Pine, ns shall be hereafter set forth In the plans and specifications provided for In this ordinance, and to construct said track from the North side Of Pine street along said Front street South across Pine, Broad and Com merce streets as far South as may be necessary for the proper handling of Its cars to and from its depot grounds south of Broad street, occupying a space fifteen (15) feet wide Im mediately east of the center line Of said Front street. Sec. 2. Sec. 6. Be It further ordained that all ordlnaces or parts of ordinances in conflict herewith are hereby re pealed. , DISSOLUTION NOTICE. The firm of Davis & Christian, com. posed of H. S. Davis and E. C. Chris tian, Is this day dissolved by mutual consent, E. C. Christian retiring. The business will be continued by H;*S.
