er to sentence any one convicted of an offence puu
hahle by imprisonment and hard labor, to the
penitentiary within the State, though it he out of
the judicial di-triet in which the conviction is had.
Sum ox 2. And h. it further enacted. That the
- iid courts in the northern district of Ohio, and in
ih,‘northern district of Illinois, be authorized to
transfer to the penitentiary of the respective States
any prisoner or prisoners who may now be confined
in jail hi either district, whose offence by law is
punishable by confinement to hard labor in the
penitentiary.
