THE OBSTRUCTION OF THE ’ VIRGINIA J ’
-CHARGES AND SPECIFICATIONS OF
CHARGES AGAINST: CAPTAIN JOSIAH
TATNALLOFTHE CONFEDERATE STATES
NAVY
CHARO* l3t.
Culpable destruction of an armed steamer of
the Confederate Slates Navy.
•Specification Ist.— ln this, that the said Cap
tain Joaiah Tatnall, on the 11th day of May,
eighteen hundred and culpably, aud
w.thout auflicientreaaou for so doiog, did destroy,
by fire, the Conefderate steamer Virginia, in
Hampton Roads, near Norfolk, Virginia.
Specification 2 d —ln this, that the said Captain
Josiah Tatnall, on the said 11th day of May,
1862, at Hampton Roads, near Norfolk, Virginia,
didcu.pably destroy the said steamer Virginia,
when with the draft to which she had beeu then
aud there, or might have been reduced, she
coaid have been carried up James river to a
place of usefulness, free from immediate dan
ger
CHARGE ri— NKGLiGKNCB.
Specification Ist.— ln this that the said Captain
Josiah Tatnall, on the said 11th day of May, 1862,
at said Hampton Roads, did proceed to lighten
the said steamer Virginia, ter the purpose of.tak
ing her up James River, retaining, however, her
armament, orduance stores, necessary coal, wa
ter aud provisions, without first hav.ng ascer
tained from sources of information within his
reach to what extent the draft of the said steamer
would be reduced bv such lightening.
Specification 2d.—ln this that the said Captain
Josiah Tatnall, after having lightened the said
steamer Virginia to a certain draff, on the said
11th day of May, 1882, at 3aid Hampton Roads,
then and there and before said time, neglected
and failed to ascertain from sources of informa
tion within his reach, the fact that the said
steamer, at arid draft, could have been carried
about forty mUes above the mouth of James
River, to Hog Island.
CHAROS III—IMPROVIDENT CONDUCT.
Specification-- In this, that the said Captain
Josiah Tatnall, on or about the 11th day of May,
1862, when off Seweli's Point, in Hampton Roads,
intending to take the said steamer Virginia up
the James river, did then and there proceed to
lighten said steamer, instead of taking her up
said James river, and there lightening her. when
tfle necessity for so doing arose, and to the extent
of that necessity.
The statement of the parties being thus in pos
session of the Court, the Court was cleared for
deliberation, and having maturely considered the
evidence adduced, find as follows
That the first specification of the first charge
is not proved.
That the second specification of the first charge
is not proved.
And that the accused is not guilty of the first
charge.
That the first specification of the second charge
is not proved.
That the second specification of the second
change is not proved.
And that the accused is not guilty of the se
cond charge.
That the specification of the third charge is
not proved.
Aud that the accused is not guilty of the third
charge
The Court do further find that tne accused had,
while in command of the Virginia, and previous
to ihe evacuation of Norfolk, thrown down the
gage of battle to the enemy’s fleet in Hampton
oads, aud that tbe enemy bad declined to take it
up ; that the day before Norfolk was evacuated a
consultation, at the instance of the Secretary of
the Navy, was held by a joint commission of navy
and army officers, as to tbe best disposition to
be made of tbe ship; that the accused was in favor
o t passing Fortress Monroe and taking the ship
into York River, or, of running down beforsSa*-
vaunah with her i that in this he was overruled
by the conncil, who advised that she should re
main on this side of Fortress Monroe for the pro*
tection of Norfolk and Richmond, and that, in
accordance with this advice, .he proceeded to.
regular her movements: that after the evacua
tion of Norfolk, Westover, on James River, be*
came the most suitable position for her to occus
py ; tbit while in tbe act of lightening her for tbe
purpose of taking her up to that point, tbe pilots,
for tbe first time declared their inability to take
her up.eren though her draftshould be
to its minimum of eighteen feet; that *y the
evacuation of Norfolk and the abandonment of
our forts below Westover, both banks of the
James River below that punt were virtu*,
ally given up to tbe enemy—that tbe ship
being thus cot off from, Norfoic and Richmond
was deprived ot all outward sources of sup"*
ply, save those of the mos precarious and
uncertain character —that her tlores of provisions
would not last for u.ore than tree weeks—that
when, lightened she was made vulnerable to the
attacks of the enemy, and that after having beeu
lightened there were noavaiiaile rneaos of bring
ing tier d‘WQ to her proper daft and fighting
trim, and that she had bit two small boats,
each capable of landing not anrejthan fifteen or
eighteen men at a time even a smooth water.
Such being the facta and under
the influence of which the “7lglnia , ’ found her
self after the evacuation of it was,’ in the
opinion of the Court, only uscAsary for the ene
my to continue to refuse battle as he had done
since it was first offered by Captain Tatnall early
in April, and thenceforward to keep a strict
watch about the “Virginia,” A order when her
provisions were exhausted, t«> nake her hia prize
a.Dd the crew bis prisoners.
Being thus situated, the onlf alternative in tbe
opinion of the Court was tobbapdon and burn
tbe ship, then and there, which, if the judgment
of tbe Court, was deliberately aijd wisely done
by order of the accused.
Wherefore, tbe Court do awaki to the said
Captain Josiah Tatnall aq hon>ral le acquittal.
