SENATE ISSUES
1. SCHOOL DESEGREGATION:
Labor-HEW Appropriations Bill
Byrd Amendment
The Senate rejected a motion by Senator Edward Brooke (R.
Mass.) to strike the “Byrd” Amendment, the provision that
prohibits HEW from using funds to require transportation of
students to achieve school desegregation. The vote on June 28,
1977 was 42-51. A vote for the motion was Right, a vote against
it was Wrong.
2. SCHOOL DESEGREGATION:
Ijibor-HEW Appropriations Bill
Eagleton-Biden Amendment
After losing on the first vote, Senator Brooke moved to strike
the Eagleton-Biden Amendment which prohibits HEW from
requiring school districts to pair or cluster schools to achieve
desegregation. The Senate tabled the motion on June 28, 1977,
43-47. A vote for the motion was Right, a vote against was
Wrong.
3. SCHOOL DESEGREGATION:
Elementary and Secondary Education Act
Roth-Biden Amendment
To a bill authorizing funds for Elementary and Secondary
Education, the two Senators from Delaware sought to add an
amendment sharply curtailing the authority of the courts to order
transportation of students to accomplish school desegregation.
The amendment was tabled by a bote of 49-47 on August 23,
1978. A vote to table was Right, a vote against was Wrong.
4. AFFIRMATIVE ACTION:
Labor-HEW Appropriations Bill
Hayakawa Amendment
The Senate rejected an amendment which would have barred
the use of funds by HEW to administer affirmative action
programs in the fields of hiring, promotions and school
admissions. The vote on June 28, 1977 was 31-64. A vote against
the amendment was Right, a vote for it was Wrong.
5. FULL REPRESENTATION FOR D.C.
The Senate approved the Constitutional amendment that
would give voting representation in both the House and Senate to
residents of the District of Columbia. The vote on August 22,
1978 was 67-32. A vote for the bill was Right, a vote against
W rong.
6. MINIMUM WAGE
The Senate rejected an attempt by Senator Peter Domenici (R.
N. Mex.) to establish a subminimum wage rate for full time youth
workers as part of the Federal Minimum Wage Law. The vote on
October 7,1977 was 44-49. A vote against this move was Right, a
vote for it, Wrong.
7. HOUSING FUNDS:
Proxmire-Brooke Amendment
The Senate voted to restore $6.2 billion for assistance to low
and middle income housing programs for fiscal 1978 on May 4,
1977 by a vote of 57-39. A vote for assistance was Right, a vote
against. Wrong.

8. PREGNANCY DISABILITY BILL
A bill prohibiting employers from denying pregnant women
disability benefits overwhelmingly passed the Senate on
September 16, 1977 by a vote of 75-11. A vote for the bill was
Right, a voi against, Wrong.
9. NATIONAL CONSUMER COOPERATIVE BANK BILL
Legislation creating a National Consumer Cooperative Bank
which would make loans to non-profit consumer co-ops and offer
self help development and technical assistance passed the Senate
<;n July 13, 1978 by a vote of 60-33. A vote for the bill was
Right, a vote against, Wrong.
10. LEGAL SERVICES BILL:
Bartlett Amendment
An attempt to prohibit legal services attorneys from providing
legal assistance in litigation involving desegregation of elementary
or secondary schools was defeated by the Senate on October 12,
1977 by a vote of 55-38. A vote against the Bartlett amendment
was Right, a vote for it. Wrong.
11. LABOR LAW REFORM
After five unsuccessful attempts at getting 60 Senators to vote
for cloture and limit debate, the Bill was recommitted to the
Senate Human Resources Committee. Fifty-eight Senators
eventually voted to invoke cloture against the filibuster during
the 19 days that the bill was before the Senate in June 1978. A
vote for cloture was Right, a vote against it, Wrong.
12. ERA EXTENSION:
Garn Amendment
The Senate defeated an amendment by Senator Jake Garn (R.
Utah) that would have permitted states that have ratified ERA to
rescind their action. The vote on October 4, 1978 was 54-44. A
vote against Garm was Right, a vote for it, Wrong.
