AN INJUNCTION GRANTED.
Stockholders of Ore Belt Railroad
Enjoin Southern Railway from
Trespassing on the Former’s
Chartered Rights.
Tiie stockholders of the Ore Belt
Railroad, whose charter provides for
rights of way for a road from Cedar
town to Cave Spring, have enjoined
the Southern Railway from en
croaching on the chartered privileges
of the former company, and as a re
sult, work on the road from Cave
Spring to the scene of the DeBardeie-
ben mining town has temporarily
suspended.
The injunction was granted Tues
day by Judge W. AI. Henry, of the
Rome Circuit, and was obtained by
Blance, Irwin & Wright and J. C.
Walker, counsel for the plaintiffs.
The incorporators of the Ore Belt
Railroad have deeds to rigiits of way
to the most practicable route fora
road between Cedartown and Cave
Spring, and lully three miles have
been graded from Cedartown towards
Cave Spring. The stock holders
allege that the Southern Railway is
encroaching without legal authority
on the chartered rights of the Ore
Belt road, and have asked the courts
to adjudicate their differences.
It is understood that the Ore Belt
road would sell its franchises at a
reasonable figure, and it is hoped
that some sort of a satisfactory
agreement may be reached by the
parties. It is not the purpose of the
Ore Belt people to obstruct develop
ment in that locality in any wav.
but simply to protect themselves and
their rights under their charter.
